초록

재산권이란 재산의 다과와 상관없이 경제적 가치가 있는 공법상, 사법상의 권리이다. 근대시민사회는 소유권 절대의 원칙과 계약의 자유가 중심이 된다. 이 때문에 재산권은 자유권적 성격이 강하다. 근대사회에서 재산권의 자유권적 성격을 강하게 인정하였지만, 현대사회는 개인 재산에 대한 규제와 조정이 강화되고 있다. 이 때문에 현대 헌법은 정도의 차이가 있지만, 재산권의 사회적 제약성을 수용하고 있다. 재산권의 보장 관련 핵심적 내용은 재산의 개념, 보장과 제한 범위, 제한의 범위, 보상이다. 국제적인 인권조약에서는 재산권도 하나의 자유권적 성격을 가진 인권이지만, 국가의 정치적, 경제적 차이로 권리 목록에 포섭하는 경우가 드물다. 지역적 인권보장 체계 중 높게 평가 받는 유럽인권협약에서는 협약 본문이 아닌 추가의정서의 형식으로 재산권을 보장하고 있다. 그 이유는 재산권을 인권으로 보장해야 하는 권리목록이지만 체약국의 사정 때문에 선택적 비준을 할 수 있는 의정서에 포함시키고 있다. 또한 유럽재판소는 재산권 침해여부를 판단할 때 체약국의 판단의 재량을 넓게 인정함으로써 기본적 권리 보장과 체약국의 다양한 상황을 균형을 고려하고 있다.

영어초록

A property right is the judicial and official right that has economic value regardless of many or few properties. Modern civil society is centrally led by the principle of absolute ownership and the freedom of contract. This causes property right to be strong in a character based on the right of freedom. Modern society was intensively acknowledged a character based on the right of freedom in property right. But contemporary society is being strengthened a regulation and an adjustment of personal property. This leads to what the modern constitution has a matter of degree, but is accepting a social restriction to property right. The core contents relevant to the security of property right include a concept of property, the guaranteed & restricted range, the limited range, and compensation. In the international convention on human rights, even the property right is a human right that has a character based on the right of freedom. However, there is a rare case that brings it over to the list of rights for a reason of political and economic differences in a country. The European Convention on Human Rights, which is rated highly among regional human rights systems, is being secured a property right in the form of protocol, not of textual agreement. That is because of including it in the protocol available for selective ratification due to the conditions of the treaty powers even if being the list of rights that should secure a property right as a civil right. Also, the European Court of Human Rights gives wide recognition to discretion of judgment in treaty powers when deciding the property rights violation status, thereby considering measuredly the basic rights guarantee and diverse situations of treaty powers.
