초록

지방부패는 지역주민의 대리인으로 주인인 지역주민을 배신하는 행위로서 매우 중대한 문제라고 인식하지 않을 수 없다. 국제투명성기구가 발표한 2012년 우리나라 부패인식도는 세계 45위로 중하위로 평가되고 있으며, 지방공직자의 부정과 부패는 좀처럼 수그러들 기미가 안 보인다. 이는 지방선출직 공직자들이 풀뿌리 민주주의의 이념을 구현하기 보다는 지방의원직을 하나의 이권 챙기는 자리로 생각하는 그릇된 의식에서도 비롯된다고 볼 수 있다. 이런 상황에서 지방의회 무용론이 나오고 지방의원 자질 문제를 따지는 것이 무리가 아닌 듯 싶다.
지방의원들의 부정중에서 가장 대표적인 것이 로비를 받고 청탁․알선하는 행위인데 지방의원이 각종 이권을 미끼로 하여 그 대가로 직접 요구하는 행태라든지, 도의원이나 시의원, 지방의 군의원의 경우 지역자치단체의 유지로서 행사함으로써 담당공무원에게 이권을 청탁한다든지 군수에게 인사 청탁을 요청하는 경우가 허다하다고 볼 수 있다.
문제는 우리나라 지방의회 의원을 선출하는 시스템을 지적할 수 있는데 지방의원공천에서부터 돈공천 파동이 발생하고 당선된 후에 부패를 발생하는 경우가 많다는 사실이다. 우리나라는 민주주의 원리에 따라 정당공천 제도를 시행하였지만 그 순기능보다는 역기능이 많이 발생하였고 정당공천 과정상의 비리와 부패가 심각한 지경이다. 즉 지방자치가 풀뿌리 민주주의라는 인식을 망각한 행태가 여기저기서 발생하고 있는 사실이다. 이와 같은 측면에서 본 논문은 정당공천제도 폐해와 정당참여 배제방향을 연구하였다.

영어초록

Korean local government has been struggling to provide a moral and transparent public service for citizens and to curb bureaucratic corruption. Immoral public service has resulted in a dysfunction that has corroded public confidence and raised conflicts between the government and the people. The Korean autonomy experience in dealing with ethics in public service has shown that a lack of ethical strategies can raise serious obstacles against all efforts to increase social discipline.
Korean local government has long suffered from discrepancies between the expected level of performance and its actual performance because of corruption in public service. Many local authorities have been the bastion of influence peddling, bribery, embezzlement and other types of corruption. It is no secret that mayors and council members usually try to recoup their excessive spending of campaign funds after taking office. It appears to be almost impossible to root out corruption unless revolutionary measures are taken immediately. We thus see that a democratic country normally has obligations for pursuing justice and devoting itself to the public interest.
These obligations consist of laws, systems, and institutions which are implemented and controlled by the administrative parts of the government. However, it follows that if the government stays blind to the duties of the officials and the corruption of a few of its local elites, then mistrust and confusion in its society will never disappear. Corruption in Korean local government even acted as a foundation spring‐board for the careers of public servants, and as a lubricant for obtaining a sanction and approval.
Unless we eradicate corruption from our local society, even the basic frameworks of our nation would be threatened ; and by not acting we can not strengthen our competitiveness. Thus, the issue of ‘corruption’ has to be explored for many reasons, and we must analyze how to create effective implementation of anti‐corruption measures.


This research paper is trying to cast light on corruption from many different viewpoints.
The key points the co-authors emphasize are as follows:First, to examine the cases of corrupted bribery accidents which were noted for their party in local autonomy.
Second, to define each of the functions and problems of those local election systems, which are the local councils in the USA, Japan and European countries.
Lastly, to understand hwo we review the current legal situation with respect to Korean local corruption, and to find possible countermeasures by focusing on the local council and government of Korea.
