초록

헌법 제23조 제1항은 재산권을 헌법상 기본권으로 보장하면서 그 내용과 한계는 법률로 정한다고 한다. 이 글은 이 규정의 사법(私法), 특히 민법에 대한 의미를 탐색하는 것을 목적으로 한다.
이 규정의 가장 큰 특징은 헌법 제37조 제2항에 의하여 그 제한에 엄격한 요건이 부과되어 있는 기본권 자체가 법률에 의하여 형성되어야 한다는 점이다. 종래 공법에서는 재산권의 일반적 제한(헌법 제23조 제2항)과 보상이 필요한 제한(헌법 제23조 제3항) 사이의 구별이, 사회보장법에서는 사회보장급여청구권의 재산권으로서의 성격과 특수성이 문제되었으나, 사법에서는 대부분의 사법 규정이 재산권형성법률에 해당한다는 점이 중요하다. 이는 헌법재판소의 재산권 형성 입법에 대한 규범통제의 맥락에서는 형식상 헌법에 의한 심사가 이루어지지만 실제로는 사법, 가령 민법 내에서 발전된 법 원칙과 이익형량의 결과가 입법에까지 관철되는 형태로 발현된다. 즉 재산권 보장 조항에 의하는 규범통제는 체계정당성 심사로 축소되는 경향을 보인다. 또한 일반법원의 사법 규정 해석의 맥락에서는 기본권의 대사인효(對私人效)가 인정될 여지가 없고, 오히려 관습법이나 법관에 의한 법형성의 한계 내에서도 새로운 재산권의 형성은 예외적으로 허용되지 아니하는 것인지 여부가 문제된다.

영어초록

According to article 23, section 1 of the Constitution, a property right shall be guarantied as a fundamental right, while the object, content, and limit of it shall be determined by the statute. According to article 37, section 2 of the Constitution, a restraint of a fundamental right should follow the principle of proportionality and the indispensable core of it shall not be infringed. These two provisions of the Constitution provide a puzzle: The legislator has a wide discretionary power in forming or reforming a property right while he has only restricted power in restraining a pre-existing property right; There exists no reliable criteria to discern forming or reforming from restraining. In this article, one aspect of this puzzle which should have been addressed earlier but did not would be examined: The meaning the constitutional protection of property right has to private law.
Undeniably, private property is the most important part of property in article 23, section 1 of the Constitution. Legislation regarding private law is also subject to constitutional review by the Constitutional Court. As the Constitution does not tell the specification of property right but just delegates it to statutes including private law legislation, however, the Constitutional Court cannot derive the criteria for the review from the Constitution itself; It has no choice but to develop the criteria from the statute, which means that the review would be mostly reduced to that of consistency of private law. In short, the constitutional protection of property right empowers the principle of private law itself and enhances its internal consistency rather than introduces external–constitutional–value into private law.
Property right, as a fundamental right, also binds general courts. The so-called horizontal effect of fundamental right, however, has little meaning when it comes to private property, because it depends on private law legislation: The most important function of so-called horizontal effect is to introduce external–constitutional–value into private law which private property right lacks. As article 23, section 1 of the Constitution vests the power to form a property right to the legislation, however, not only any creation of property right by the Constitution itself but also any judicial lawmaking regarding it might be excluded.
