眺望利益 侵害시 私法的 救濟法理의 再檢討 (Reconsideration of Protection Principle of Law for Prospect Benefit)

초록

조망이익이란 토지나 건물의 소유자가 인근 건물의 신축으로 그 시야를 차단당하지 않고 주변의 경관을 조망하여 미적 만족감이나 정신적 만족을 누릴 수 있는 생활 이익이다. 조망이익의 침해는 조망대상과 침해받는 건물 사이의 토지 위에 방해물이 존재하지 않는다는 우연한 사정에 의하여 사실상 이익을 누린다는 점에서 일조권 침해와 공통점이 있다. 일조권에 관하여는 우리 대법원 판례가 그 권리성을 인정하고 있으나, 조망이익 침해의 경우에는 법적으로 보호의 대상은 되지만 이를 권리로 인정함에 대하여는 다소 엄격한 경향이라고 할 수 있다.
그리고 대법원 판례는 조망이익의 침해와 경관이익의 침해를 구별하지 않는다. 그러나 조망이익이 개인적이고 재산적 이익의 성격을 갖는다면, 경관이익은 사회적이고 공공적 이익에 대한 침해이므로 경관이익의 침해시의 사법적 구제방법도 차이를 두어야 할 것이다. 즉, 경관이익이 건강하고 쾌적한 생활을 유지하기 위한 생활이익이므로 그 침해가 인정되면 불법행위에 기초한 사후적인 손해배상청구권은 인정될 수 있다. 그러나 경관이익을 사법상의 권리로 보호할 명확한 실체를 지니는 권리로 보기 어렵다는 점에서 사전적인 중지청구권을 인정하기는 어렵다고 본다. 그리고 경관이익을 보호하기 위한 특별법으로 경관법이 제정되어 2007년부터 시행하고 있다. 이 법에 따르면 토지소유자들이 아름다운 경관의 보전하기 위하여 경관협정을 체결하고 그에 대한 자금지원을 할 수 있는데, 경관협정을 체결하는 행위는 사법상의 계약으로 볼 수 있다. 경관협정을 체결한 후 경관위원회의 심의와 지방자치단체의 인가를 통하여 공고하면 그 효력이 발생하고 이는 부분사회의 내부를 규율하는 자치법규라고 할 수 있다.
조망이익의 침해는 두 가지 측면으로 나타난다. 특정한 자연적 또는 인공적 경관을 바라보는 적극적 요소로서의 전경조망이익과, 주택의 창면적에서 하늘이 보이는 면적 비율을 의미하는 천공률 침해에 따른 압박감과 폐쇄감을 갖지 않도록 하는 소극적 요소로서의 천공조망이익이 있다. 조망이익은 건강하고 쾌적한 생활을 유지하기 위한 생활이익이므로 그 침해가 인정되면 사후적으로 불법행위에 기초한 손해배상청구권을 인정할 수 있다. 그러나 조망이익을 침해하였다고 하더라도 私法上의 權利로 인정할 만한 실체를 가졌다고 볼 수 없으므로, 민법 제2조의 권리남용이 인정되지 않는 한, 사전적인 방지청구권을 인정할 수는 어렵다고 본다.
요컨대, 주거조망이익은 전경조망이익과 천공조망이익으로 구분하여 파악할 필요가 있고, 사후적인 손해배상청구를 인정하는 것은 그 권리성을 인정하지 않아도 민법 제750조에 근거하여 청구할 수 있다. 그러나 사전적인 방지청구권은 그 인정근거를 달리하여 보아야 할 것이다. 즉, 전경조망이익의 경우에는 원칙적으로 손해배상청구 외에 사전적인 방지청구권을 인정할 수 없으나, 예외적으로 민법 제2조의 권리남용의 요건을 충족하는 경우에는 그 권리남용의 상태로서 방해물의 제거로서 방지청구가 인정된다고 본다. 그러나 천공조망이익의 침해의 경우에는 민법 제217조의 생활방해로 인한 적당한 조처의 내용으로서 방지청구권이 인정될 수 있다고 본다.

영어초록

Prospect benefit is an interest in life the owner of a land or a building can enjoy aesthetic satisfaction or mental satisfaction by taking view of surrounding landscape without his or her view not being interrupted due to construction of a nearby building. In that the infringement of prospect benefit enjoys actual benefit by an accidental circumstance that there is no obstacle on the land between the prospect object and the building infringed, it has something in common with the infringement of right to enjoy sunshine. Concerning right to enjoy sunshine, our Supreme Court's precedent recognizes its nature of right, but in case of infringement of prospect benefit, it becomes an object of protection in law, but it is somewhat strict tendency that this is recognized as a right.
And Supreme Court's precedent does not distinguish the infringement of prospect benefit and that of landscape benefit. However prospect benefit has the nature of individual and property benefit, while landscape benefit is an infringement to social and public interest, so there should be a difference in judicial remedy in case of infringement on landscape benefit should make a difference. That is to day, landscape benefit is an interest in life to maintain a healthy and pleasant life, so if the infringement is accepted, then a follow-up claim for damages based on a tort can be accepted. However in that landscape benefit can not be seen as a right having a definite substance to be protected as a right in private law, it looks difficult to accept a prior claim for suspension. And Scenic Conservation Act as a special law to protect landscape benefit was established and has been come into effect since 2007. According to this Act, land owners can enter into a landscape agreement to conserve beautiful landscape and support fund for that, and an action to conclude the landscape agreement can be seen as a contract in private law. If the landscape entered into and made public through the deliberation of the landscape commission and authorization of local government, it takes effect, which can be said to be a legislation of self-government to regulate its internal side of a partial society.
The infringement of prospect benefit is indicated as two aspects a whole view prospect benefit looking at a specific natural or artificial landscape, a sky prospect benefit as a passive factor not to have a sense of pressure and a sense of closing according to the infringement of sky ratio meaning the ratio of area the sky is seen from the window area in a house. Prospect benefit is an interest in life to maintain a healthy and pleasant life, so if the infringement is accepted, a claim for damages based on a tort can be admitted afterwards. However, if prospect benefit was infringed, but it can not be seen as having a substance acceptable as a right in private law, so long as abuse of right is not recognized under Article 2, the Civil Law, it looks difficult to accept a prior claim for suspension. Provided however in case there is an infringement in sky prospect benefit of prospect benefit, it can be said to exercise a prior claim for suspension about the removal and prevention of the affected building as the content of a proper action due to life nuisance of Article 217, the Civil Law in order to maintain an essential life environment for a living worthy of human dignity according to a sense of pressure and loss of a sense openness in the same way as the infringement of right enjoy sunshine.
