초록

우리나라의 국가보훈정책은 「국가보훈 기본법」 제1조를 기본으로 하여 국가유공자들의 조국과 민족을 위한 희생을 우리 모두 다 기리고 이를 통하여 국민들의 나라사랑정신을 위한 목적으로 수행되는 것이다. 이처럼 보훈정책은 국가의 정체성과 관련되어 있으며, 이를 나타내 주는 중요한 행정작용의 하나로 나라들 마다 서로 다른 역사적 배경과 환경에 따라 형성된 이념을 통하여 보훈정책을 시행해 나가고 있다.
우리나라는 헌법에서는 국가유공자 등의 유가족에 대해서 근로의 기회를 우선적으로 부여받도록 하며, 국가보훈기본법 및 국가유공자 등 예우 및 지원에 관한 법률에서 국가유공자의 대상과 종류 및 보상 등을 규정하고 있다. 이에 대해 입법적 측면에서 살펴보면 독립유공자, 참전유공자, 사회유공자, 기타 유공자로 그 유형을 분류하고 있으며, 개개의 법률에서 개별적으로 마련되어 시행되고 있다. 이렇듯 개별 법률의 기준으로 인하여 체계적이고 합리적이지 못한 국가유공자 인정 기준은 그 업무를 수행하거나 국가유공자의 인정을 심의·의결하는데 여러 문제점이 나타나고 있다. 국가유공자 인정 기준은 그 업무를 수행하거나 국가유공자의 인정을 심의·의결하는 국가보훈처나 보훈심사위원회의 이원화에서 보훈심사위원회를 합의제 행정청으로 하여 일원화하고, 국가유공자인정에 대한 입증체제를 신청자의 입증체제에서 국가의 입증체제로 전환하여야 한다. 또한 심의·의결에 대한 투명성 제고를 위한 정보공개도 실시해야 하며 객관적인 인정기준에 관하여 공표하여야 할 것이다. 그리고 잘못된 국가유공자의 인정 결과는 인정 후에 그 절차나 제도상의 문제점 등을 확인하는 후속 검증이 제대로 이루어지지 않았기 때문에 나타난 결과로 인한 문제점을 해결하기 위한 국가유공자 인정 결과의 검증을 관장할 수 있는 상설독립기구의 설치를 통해 과거에 잘못된 국가유공자 인정을 바로잡아 국가를 위해 공헌한 국가유공자의 존엄과 가치를 인정해야 할 것이다.

영어초록

Our country's policies for patriots and veterans are primarily intended to admire the sacrifices of meritorious people for the nation to inspire people with patriotism in accordance with Article 1 of the Framework Act on Veterans Affairs. Accordingly, these policies are linked to national identity, and every country pushes ahead with this sort of policies in their own ways as one of administrative measures to represent national identity on the basis of the dominant ideology that has been built on its historical background and circumstances.
The Constitution of our country provides an opportunity of work for the families of persons of national merit on the preferential basis, and the Framework Act on Veterans Affairs and the acts on treatment and support for national meritorious persons include regulations on eligibility, the types of national meritorious persons and compensation. According to these acts, there are four types of national meritorious persons: fighters for national independence, war veterans, social contributors and others. And there are separate acts to respectively deal with the four types of persons of national merit. The different standards of the separate acts result in detracting from the systemicity and rationality of recognition criteria for persons of national merit, and there are consequently various problems with deliberation and decision on the recognition of these persons and with related work performance Currently, two different organizations that are the Ministry of Patriots & Veterans Affairs and the Patriots and Veterans Review Commission are responsible for deliberation and decision on the recognition and related work performance. In the future, the Patriots and Veterans Review Commission should assume the exclusive responsibility as a collegiate administrative agency. In addition, applicants have to prove their eligibility at present, and it's required for the government to prove their eligibility, instead. Information release also is necessary to ensure the transparency of deliberation and decision, and objective recognition criteria should be announced. When those who are not eligible are recognized as persons of national merit, it gives rise to problems because there is no follow-up review to check if there's anything wrong with it. Therefore a permanent independent organ should be established to review the results of the recognition to correct wrong recognition cases to pay respect to persons of national merit who sacrificed themselves for the country.
