사유재산권과 조세의 한계에 관한 실증적 일고찰 (An empirical study on the limits of private property rights and taxes)

초록

문재인 정권이 추진한 부동산 관련 정책은 근대의 형성을 촉진했던 개인의 ‘재산권’을 제한하는 것에서 시작하여 제한하는 것으로 끝냈다. 한 줌 정권이 ‘옳다고 생각하는’ 것을 정책에 투영하기 시작한 이후 부동산 시장의 왜곡은 더 심해졌다. 소수의 정치세력이 스스로를 무오류의 절대선으로 착각하고 자신들과 생각이 다른 국민과 정치세력을 ‘잘못된 사람 혹은 집단’으로 프레이밍 하는 순간 자유 시장이 수행했던 ‘자생적 질서’는 깨진다.
모든 정책의 가치 판단의 유일한 기준은 ‘결과’다. 현 정권의 핵심 세력의 심연은 망해버린 전근대 국가 조선의 사대부이다. 왜 조선이 망했는지에 대한 우리 스스로의 반성 없이 타의로 ‘근대화 되어버린’ 업보는 조선으로의 강력한 반동으로 나타난다.
실제 선언적 규정에 머물고 있으나, 국가이익을 정향하도록 명문으로 규정하고 있는 헌법과 정치관계법이 없다면, 정권의 목표는 지지율 유지 혹은 확장을 통한 정권 재창출 뿐이다. 스스로 근대화 되지 않은 정권의 문제는 좌파와 우파, 진보와 보수를 가리지 않는다. 다만, 시장경제를 중시하는가 그렇지 않은가에 따라 정도의 차이만 있을 뿐이다. 누가 정권을 잡더라도 조세라는 달콤한 유혹에서 빠져나오기는 쉽지 않다. 정권은 조세를 통해 국가를 운영하고 자신들의 정치적 목적을 현실화한다. 정권 입장에서는 소수에 불과한 다주택자나 고가주택 소유자에게 징벌적으로 과세하고 이에 희열을 느끼는 세력으로부터 표를 받을 수 있다. 이렇게 쌓인 조세는 정권 마음대로 원하는 단체의 지원이나 사업을 추진할 수 있다. 그러나, 재산과 소득은 구별되어야 하고 그 내재적 한계도 고려해야 한다. 비교법적으로 보아도 응능과세의 원칙이 헌법전에 명시적으로 삽입되어 있는 경우는 쉽게 찾을 수 있다. 특히, ‘재산’이 아닌 실제 담세력을 확보할 ‘소득’에 주목해야 한다. 물론 징벌적 혹은 압살적 조세 또한 금지된다.
도덕적으로 우월하거나 우월하다고 주장하는 정권이 들어서고 그들이 추진하는 정책이 무오류의 절대선의 정책이라 주장하더라도 소수가 주장하는 ‘옳은 것’은 개별 경제주체가 자신에게 가장 이득이 되도록 행동하여 자연스럽게 형성된 ‘자생적 경제질서’인 시장을 이길 수 없다. 이제라도 절대선의 무오류라 착각하는 정치세력이 ‘조세’라는 무기로 자생적 생태계로 균형을 잡고 있는 주택시장에 개입하는 일이 최소화되기를 앙망한다.

영어초록

The real estate-related policies promoted by the current administration started and ended with restricting individual “property rights” that promoted the formation of the modern era. Distortions in the real estate market have only gotten worse since the regime started projecting what it “thinks right” into its policies. The moment a few political forces mistake themselves for the absolute line of infallibility and frame the people and political forces who have different views from themselves as the “wrong person or group,” the “spontaneous order” implemented by the free market is broken. The only criterion for judging the value of any policy is ‘result’. The abyss of the core power of the current government is the 'nobility' of the ruined pre-modern nation of Jo-sun. The karma that has been ‘modernized’ without our own reflection on why Jo-sun collapsed appears as a powerful reaction to Jo-sun.
Without the Constitution and the Political Relations Act, which remain in declarative regulations aimed at the national interest, the government's goal is to re-create the government by maintaining or expanding the approval rating. The problem of a regime that has not modernized itself does not discriminate between the left and the right, the progressives and the conservatives. However, there is only a difference in degree depending on whether the market economy is emphasized or not. No matter who comes to power, it is not easy to escape from the sweet temptation of tax. Governments run the state through taxes and realize their political goals. From the point of view of the government, punitive taxes are imposed on the few owners of multi or high-priced houses, and they can receive votes from those who are delighted with it. The tax accumulated in this way can support any organization or business that the government wants at will.
However, property and income must be distinguished and their inherent limitations must be considered. Even in comparative law, it is easy to find cases where the principle of adaptive taxation is explicitly inserted in the Constitution. In particular, it is necessary to pay attention to ‘income’, not ‘property’, but ‘income’ that will secure the actual force. Of course, punitive or destructive taxes are also prohibited.
Even if a government that claims to be morally superior or superior comes into power and the policy they are pursuing is a policy of infallible, absolute good, the 'right thing' claimed by a few is a 'self-sustaining economy' naturally formed by individual economic agents acting in their best interests You cannot beat a market that is 'ordered'. Even now, it is hoped that political forces, who mistakenly believe that the absolute good is infallible, will interfere with the housing market, which is balancing with a self-sustaining ecosystem with the weapon of ‘taxation’, to be minimized.
