장애인 금융거래와 소비자지향적 제도개선 - 장애인차별금지법 및 금융소비자보호법을 중심으로 - (Financial Transactions of People with Disabilities and Consumers-oriented Institutional Improvement -Focusing on Disability Discrimination Act and Financial Consumer Protection Act-)

초록

장애를 이유로 장애인을 배제하거나 차별하는 것은 궁극적으로 인간의 존엄성을 훼손하는 일이다. 이는 인간을 목적으로 보지 않고 수단으로 봤기 때문이다. 본고는 위와 같은 문제의식을 바탕으로, 장애인 금융소비자가 비장애인 금융소비자와 차별 없이 금융상품을 소비할 수 있도록 현행 법제도의 문제점을 살피고, 그 대안을 찾아보고자 하였다. 이에, 장애인 금융소비자의 관점에서 장애인 금융소비자를 위한 일반법이라 할 수 있는 장애인차별금지법과 금융소비자보호법을 개관하고, 그 한계 및 대안을 살펴보았다. 결과적으로 우리의 법제도는 일반적이고 평균적인 소비자를 기준으로법정책이 마련되어 있었다.
본고는 장애인 소비자지향적 제도개선사항을 다음과 같이 제시하였다. 먼저, 장애인차별금지법상 개선사항으로, ① 의무주체의 명확화와 ② 구체적인 정당한 편의제공내용 또는 지침 마련을 제시하였다. 다음으로, 금융소비자보호법상 개선사항으로, ① 차별금지규정의 개정, ② 적합성 원칙 및 적정성 원칙에서 장애의 고려, ③ 설명서에서 장애의 고려 및 ④ 불공정영업행위 및 부당권유행위에 장애를 이용한 행위 금지유형 마련을 제시하였다.
다만, 본고는 금융거래에서 그것도 계약과정에서 한정하여 검토한 한계가 있다. 진정한 인간의 존엄을 추구하고 장애인과 비장애인이 사회적 장벽 없이 생활을 할 수있도록 계속 연구가 진행되어야 할 것이다.

영어초록

Discriminating or excluding people with disabilities due to their disabilities is to ultimately undermine the human dignity, because it means to regard human beings as a measure, not as a goal. On the basis of such a critical idea, this paper aimed to examine problems in the current legal institution and find out an alternative, to allow financial consumers with disabilities to use financial products, without any discrimination from financial consumers without disabilities. To this end, it briefly examined both the disability discrimination act and the financial consumer act, the general acts for financial consumers with disabilities, from the perspective of them, and investigated their limits and an alternative. The Korean legal institution has established the legal policies based on general and average consumers.
This study provided the following methods to improve financial consumers with disabilities-oriented institutions. First, the improvements for the disability discrimination act: ① the specification of responsible subjects, ② the development of the content of or the guidelines on offering specific and proper convenience to them. Second, the improvements for the financial consumer protection act: ① the improvement of the clause that prohibits the discrimination, ② the consideration of disabilities in the principles of suitability and appropriateness, ③ the consideration of disabilities in the manual ④ the establishment of prohibited act types using disabilities for the unfair business activity and the undue recommendation.
This paper, however, has a limit, in that it only examined the contract process in the financial transactions. It would be necessary to continuously conduct research, to pursue the true human dignity and to allow both the disabled and the non-disabled to live without any social barriers.
