도매시장법인 「지정」의 법적성질 및 재지정의 보호이익에 대한 검토 (A Study on the Legal Nature in 「Designation」 and on the Protection Benefit in Re-designation of Wholesale Market Corporation)

초록

농수산물 도매시장은 오랜 시간 동안 우리 생활 속에서 안정적인 농수산물의 유통을 책임지고 적정한 가격을 유지하게 함으로써 국민생활의 안정에 이바지 하였다. 이 농수산물 도매시장의 유통구조 안에는 시장에 대한 정보가 없는 출하자 및 출하자 단체를 대변하는 역할을 하는 도매시장법인, 소비자의 이익을 대변하는 역할을 하는 중도매인, 출하자로부터 매수하거나 수탁을 받아 대형유통업체･소매상인･소비자 등에게 판매하는 시장도매법인이 있고, 이들에 의해 농수산물 도매시장은 운영되고 있다. 그리고 이런 유통구조의 근거 법률인 「농수산물 유통 및 가격 안정에 관한 법률(법률 제2962호)」은 1977. 7. 1. 제정･시행된 이래로 여러 차례 개정을 거쳐 현재에 이르렀다. 정부는 이러한 개정을 통해 농어업의 경쟁력 제고와 농어촌의 발전 그리고 국민생활의 안정을 위하여 생산자조직의 기능을 활성화하고, 도매시장의 공익기능을 강화하는 등 산지에서 소비지에 이르기까지 농수산물 유통의 효율화에 기여하는 동시에 생산자와 소비자를 직접 연결하는 다양한 유통경로를 마련함으로써 유통구조를 개선하고자 하였다. 뿐만 아니라 농수산물 산지의 생산자들이 조직화되고 대형유통업체가 등장하는 등 유통환경이 급변함에 따라 도매시장 운영주체의 대응능력을 강화하기 위한 제도도 마련하였고, 산지의 적정한 가격 유지를 위해 다양한 제도를 도입하는 등의 제도적 변화를 통해 본연의 역할을 다하고자 하였다.
위와 같은 노력에도, 최근 일부 언론에서는 도매시장 개설자에 의해 지정된 소수 도매시장법인의 운영상의 문제점을 지적하며, 국내 농수산물 도매시장의 발전을 위해 공정하고 효율적인 시장 운영을 위한 합리적인 제도 개선이 필요하다고 목소리를 높이고 있다. 더욱이 한 지방자치단체에서는 이러한 문제점을 해결하고, 공영도매시장으로서의 공익적 기능을 강화하여 생산자와 소비자의 이익을 보호하기 위한다는 목적으로 도매시장법인의 공모제를 추진하였다가 무산된 일도 있었다.
따라서 본 논문에서는 공정거래질서를 확립･유지하고, 효율적인 유통구조를 개선･발전시키기 위반 방안으로 과연 지정유효기간이 만료된 도매시장법인을 재지정하지 않고 신규공모를 통해 지정하는 공모제가 근본적인 해결책인지에 대하여 면밀히 검토하고, 이에 대한 법적 문제점은 없는지, 나아가 다른 합리적인 해결방안은 없는지에 대하여 고찰하고자 한다. 이를 위해 이하에서는 관련 법률과 시행령, 시행규칙, 도매시장이 개설된 각 지방자치단체의 조례를 분석하고, 도매시장법인에 대한 변천과정을 검토하는 등의 법사학적 방법과 법과 사회의 연관성을 실증적으로 분석하는 법사회학적 방법, 기존 저서나 논문, 판례 등을 중심으로 하는 문헌조사방법을 활용하도록 한다.

영어초록

Agricultural & Marine Products Market has contributed to stabilizing national life through maintaining a reasonable price with taking responsibility for the stable agricultural & fishery distribution amidst our life for a long time. The distribution structure of this Agricultural & Marine Products Market is included a forwarder who has no information on market, a wholesale market corporation that plays a role of representing a group of shipment, a jobber who functions as speaking for the consumer interest, and a wholesale market trader who sells to large-scale distributors, retail dealers and consumers after buying or receiving trust from a shipper. The Agricultural & Marine Products Market is being operated by these entities. And 「law on Agricultural & Fishery Marketing and Price Stability(Law Serial No. 2962)」, which is the Act based on this distribution structure, has reached the present after passing through many revisions since its enactment and enforcement dated on July 1, 1977. In order to step up the competitive edge of agriculture and fishery, to develop a farming and fishing village and to stabilize national life through this revision, the government planned to improve the distribution structure through arranging diverse distribution routes of directly connecting producers and consumers, simultaneously with contributing to the efficiency of agricultural and fishery marketing ranging from the producing area to the consumption site such as vitalizing the function of the producer organization and intensifying the commonweal function of wholesale market. In addition, the aim was to arrange a system for strengthening a coping ability of the wholesale-market operator according to a rapid change in distribution environment such as being organized the producers in the agriculture & fishery producing district and as being appeared a large distributor, and to do own natural role through an institutional change such as introducing various systems for keeping a reasonable price in a producing area.
Despite the above efforts, the indication is appearing as saying that a rational system reform is needed for operating a fair and transparent market in order to develop the domestic Agricultural & Marine Products Market while many problem in wholesale market operators are sitting on a hot stove these days. It has ever been recently miscarried what one local government tried to drive the public subscription system of wholesale market corporation for a reason of protecting the producer-and-consumer interests through enhancing this and reinforcing the public function of a government-supervised wholesale market.
Accordingly, this study intends to closely examine about whether the fundamental solution is really only to designate it through new public subscription without re-designating the wholesale market corporation with the expiration of the specified effective period at this time of requiring the improvement in distribution structure and the reinforcement in transparency, and to consider of whether there is no legal problem about this and of whether there is other reasonable solution. To do this, it makes use of a legally historical method such as analyzing relevant laws, ordinances, and enforcement regulations, and the by-law of each local government and as figuring out transition process of wholesale market corporation, and a legally sociological method, which empirically analyzes a correlation between law and society, and a documentary survey method of centering on the existing books, theses or precedents.
