간통죄의 위헌 의견에 관한 윤리신학적 비판 (A Moral-theological Comment about the Supportive Opinion on Adultery Law’s Unconstitutionality)

초록

이 글은 2008년 10월 30일 헌법재판소가 간통죄 조항에 대해 과반수의 위헌 의견을 낸 것에 대해 그것의 부당함을 윤리신학적으로 비판해 본 것이다. 간통죄 폐지의 부당함은 다음과 같은 근거에서 나온다. 맨 먼저, 국가 사회의 근간이며 헌법과 공동선의 가치인 혼인과 가족생활이 요구하는 것이라는 점, 개인 간의 손해배상을 다투는 민법적인 권익보호가 국가 사회를 수호하는 형법적인 권익보호를 대체할 수는 없다는 점, 간통죄는 단순히 도덕적 비난의 대상이 아니라 배우자와 자녀의 기본 유익을 침해한 범죄라는 점, 혼인을 맺음으로써 성적 자기결정권은 이미 행사되었다는 점, 배우자를 속이기 위한 사생활 은폐권 및 가족동거를 해체할 신체 자유의 권리보다는 배우자의 알권리와 가족의 안정된 동거권리가 더 크다는 점, 혼인 파괴와 가족 해체의 위험으로부터 정당방어를 할 최후의 법적 수단이라는 점, 징역형만을 규정한 것이 과잉제한금지 위배가 아니라는 점, 남용하는 사례 때문에 법조문 자체를 삭제할 수는 없다는 점, 다른 친고죄들과 마찬가지로 고소취하의 사례들은 고소권 남용이 아니라 정당한 심경 변화라는 점, 사회적 강자인 국회의원과 법조인의 법의식과 사회적 약자인 국민 대다수의 법의식에는 상당한 차이가 있다는 점, 일반 국민에게는 간통 예방과 여성 보호의 기능을 하고 있다는 점 등이다. 가톨릭교회는 피해자의 별거권을 인정하지만, 그러나 사랑으로 용서하고 혼인-가정을 지키도록 권고한다.

영어초록

In this essay, I criticize moral-theologically the supportive opinion on the unconstitutionality of Adultery Law evoked by five out of the nine justices of the constitutional court of Korea. The unfairness of Adultery Law’s unconstitutionality lays on the following grounds.
Firstly, the Adultery Law is intended to protect marriage, which is the bedrock of family life. And a family is the root of nation and the reason for constitution to be existed. Secondly, the benefits of civil law which usually deals with damage between individuals cannot replace those of penal law, which has more essential mission to protect the nation. Thirdly, the adultery is not only an immoral behavior but a crime to destruct the other family member’s basic rights. Fourthly, the sexual self-determination is exercised by marriage. It thus is meaningless to discuss the sexual self-determination of the married. Fifthly, a spouse’s right to know as well as a family’s basic right is much heavier than the right of individual choice in sexual relations and the right to privacy, which can deceive a spouse and break up a family. Sixthly, the Adultery Law is a legal defense as the final step to protect a family legally from breaking up. Seventhly, the Adultery Law is not against the principle banning excessive punishment when it compared with criminal assault. In many cases, the accused is sentenced a stay of execution or a probation in consideration of his or her circumstances. Eighthly, the provision cannot be abolished easily just because it’s misused. Ninthly, in case of Adultery, retracting a charge is common but it can’t be understood as the abuse of locus standi. Actually, a lot of married women, the social weak, retract the charge because of her financial difficulty since the Adultery law is applicable only when a spouse files a suit on the premise that she would file a divorce suit at the same time. Tenthly, there are much difference between the legal consciousness of justices of the constitutional court, the social strong and that of petit bourgeois, the social weak. Eleventhly, the Adultery Law is a safeguard against the adultery and also a protect policy for women.
Catholic church admits the right of marriage separation but advice to forgive each other with love and keep a family strong.
