디지털사회 온라인도박의 실효적 규제방안에 관한 고찰 (A Study on Effective Regulation against Online Gambling in the Digital Society)

초록

온라인도박은 인터넷기술의 발전과 함께 급속히 확산되어 세계적으로 중요한 사회적·경제적 현상으로 자리 잡았다. 온라인도박은 초기에는 단순한 형태의 카지노게임과 스포츠베팅으로 시작되었으나, 기술진보와 함께 가상현실(VR), 블록체인, 인공지능(AI) 등 다양한 첨단기술이 도입되며 그 형태와 규모가 급격히 변화하고 있다. 이러한 변화는 도박산업의 새로운 가능성을 열어주는 동시에 사회적 문제와 법적 쟁점을 제기하고 있다.
서두에서는 온라인도박의 역사적 배경과 진화과정을 살펴보고, 현대사회에서 온라인도박이 미치는 경제적·사회적 영향을 살펴보며, 특히 온라인도박 확산이 청소년도박중독, 범죄유발, 개인정보유출 등의 부정적 영향을 초래하고 있음을 지적한 후, 이에 대한 효과적 규제방안을 모색하였다.
다음, 온라인도박의 진화과정을 기술적·산업적 측면에서 고찰한다. 초기단계의 온라인카지노와 스포츠베팅에서 시작하여, 모바일도박, e스포츠베팅, 암호화폐를 이용한 도박 등으로의 확장을 분석하고, AI와 빅데이터를 활용한 맞춤형 도박서비스의 등장과 그 윤리적 문제점을 논의한다. 또한 온라인도박이 사회에 미치는 영향을 다각적으로 분석하되, 경제적 측면에서는 일자리창출과 세수증가 등의 긍정적 효과를, 사회적 측면에서는 도박중독, 가정파탄, 범죄증가 등의 부정적 영향을 검토하며, 특히 청소년 등 취약계층에 미치는 영향을 심층적으로 다루었다.
이어서 국내외 온라인도박관련 법규제현황을 살펴보되, WTO, EU 등 국제기구와 미국, 영국, 중국, 호주, 스웨덴, 우리나라 등 각국의 규제현황과 현행법제를 살펴보고 나아가 국제협력과 표준화의 필요성을 강조하였다. 아울러, 온라인도박의 부정적 영향을 최소화하기 위한 법정책적 방안으로, 도박중독 예방 및 치료프로그램 강화, 청소년보호를 위한 연령확인시스템 도입, 암호화폐 이용 도박에 대한 규제강화 등을 포함한 종합적 접근방안을 모색하고, AI와 빅데이터를 활용한 실시간 모니터링시스템 구축과 국제협력체계 강화방안도 제시하였다.
이 논문은 온라인도박관련 기술혁신과 사회적 책임의 균형을 강조하고, 온라인도박의 성장을 억제하는 것에 그치지 않고 적절히 규제하고 관리함으로써 사회적 피해를 최소화하고 경제적 이익을 극대화할 수 있는 방안을 모색하였으며, 나아가 온라인도박의 진화와 그에 따른 법적 쟁점의 변화를 분석하여 정책입안자, 학계, 산업계 모두에 유용한 지침을 제공하고, 이를 통해 온라인도박이 사회에 미치는 영향을 합리적으로 관리하고 건전한 도박문화를 정착시키는데 기여하고자 한다.

Online gambling has rapidly expanded alongside advancements in internet technology, establishing itself as a significant social and economic phenomenon worldwide. Initially, online gambling began with simple forms of casino games and sports betting. However, with technological progress, the introduction of advanced technologies such as virtual reality (VR), blockchain, and artificial intelligence (AI) has led to dramatic changes in its forms and scale. These changes have opened new possibilities for the gambling industry while simultaneously giving rise to social issues and legal challenges.
This paper examines the historical background and evolution of online gambling, explores its economic and social impacts in modern society, and highlights the negative consequences of its proliferation, such as youth gambling addiction, crime induction, and personal data breaches. It then seeks to identify effective regulatory measures to address these issues.
First, the evolution of online gambling is analyzed from technological and industrial perspectives. Starting from early online casinos and sports betting, the paper explores its expansion into mobile gambling, e-sports betting, and cryptocurrency-based gambling. It also discusses the emergence of personalized gambling services utilizing AI and big data, along with their ethical implications. Furthermore, the paper examines the multifaceted societal impacts of online gambling. On the economic front, it considers positive effects such as job creation and increased tax revenue, while on the social front, it reviews negative impacts like gambling addiction, family breakdown, and rising crime rates, with a particular focus on vulnerable groups such as youth.
Additionally, the paper provides a comparative analysis of legal regulations on online gambling in various countries and regions, including the United States, the United Kingdom, and the European Union. By evaluating current legal frameworks and their limitations, it emphasizes the need for international cooperation and standardization. It also proposes legal and policy alternatives to minimize the negative effects of online gambling. For instance, it suggests comprehensive approaches, including strengthening prevention and treatment programs for gambling addiction, implementing strict age verification systems to protect youth, and enhancing regulations on cryptocurrency gambling. It also advocates for the establishment of real-time monitoring systems using AI and big data, as well as the reinforcement of international cooperation mechanisms.
Finally, this paper emphasizes the balance between technological innovation and social responsibility for the sustainable development of online gambling. Rather than suppressing its growth, it seeks to identify ways to regulate and manage it appropriately, thereby minimizing social harm and maximizing economic benefits. By systematically analyzing the evolution of online gambling and the necessity of legal regulation, this paper aims to provide useful guidelines for policymakers, academia, and industry stakeholders. It seeks to contribute to the rational management of online gambling`s societal impact and the establishment of a healthy gambling culture.
