중국 직접판매업의 제도적 문제점과 개선방안 (Research on Legal Problems and Improvement Suggestions of Direct Selling Industry in China)

초록

중국은 개혁 개방 이후, 시장경제의 발전에 따라 서방기업의 경영모델과 경영이념을 받아들이고 있다. 이러한 일환으로 1990년대에 이르러 직접판매(直销)도 중국시장에 진입하였다. 직접판매는 소비자에게 개성화, 편리성의 서비스를 향유하게 할 수 있으며, 기업에게 투자 수익률을 높이게 할 수 있고, 보통 시민에게 직접판매를 통해 업무시간의 융통성을 가질 수 있게 할 수 있어 상대적으로 요구가 낮은 취업과 창업 기회 등을 가질 수 있다는 특이점이 있다.
비록 중국 직접판매업종의 발전 역사는 길지 않지만, 직접판매업종의 도입에서부터 개방까지, 그 후에 전면적인 금지, 현재는 전면으로 독려하고 있다. 2005년 입법 이래, 중국 직접판매업은 계속하여 안정적이고 일정한 성장을 취하였지만, 중국 직접판매법률체계의 핵심 법규와 직접판매시장 간에 심각하게 균형을 잃어 실제 업무에서 문제점이 나타나고 있다. 여기에는 불법행위자의 고의적인 직접판매와 다단계판매행위의 모호성, 시장질서 파괴, 직접판매 관련제도 방면의 허점 등이 보편적으로 존재하고 있다. 이를 해결하기 위하여 직접판매업종에 대한 감독관리의 합법성과 합리성이 강조됨과 동시에 하나의 유효한 제약규제를 수립하고, 신용평가체계로 하여 구속할 필요가 있다.
오늘날 중국은 시장경제가 발전하는 단계이다. 직접판매기업의 운용도 발전하는 초급단계에 있다. 이러한 때에 중국의 판매업종의 발전은 서방 선진국의 직접판매제도와 같은 수준에 도달할 수 있는지, 또한 어떠한 직접판매모델을 취할 수 있는지 등의 관점에서 출발하여 현재의 입법과 그 제도적 문제점 및 그에 대한 개선 방안이 무엇인가에 관한 부분을 이해하여 볼 필요가 있다.

영어초록

Chinese direct selling enterprises have gone through a period of ups and downs during its short history compared with other developed countries. From introducing selling system to opening up for it, then totally banning it, now fully encouraging, the attitudes of Chinese government changes from time to time. There are some serious problems inside China’s direct selling industry, such as the outlaws deliberately fuzzing idea between the pyramid selling and direct selling behavior, destroying the market order, and also the drawbacks of the regulating of the direct selling system. ect. Due to the not well-repaired legislation of the direct selling system, many market behaviors have been exceeded the supervising scope. The related laws have become invalid in some areas. For example, the law only approve the single-level direct selling model, however, the China’s domestic enterprises are all using the hybrid model. The laws also has restrictions on the scope of the products, but in the practise, the direct selling companies also sell the products which are beyond the five categories and do not get approvals by the government authorizes. To sum up, China’s current legal system relating to direct selling can not meet the need of the direct marketing industry, now becoming an obstacle to the further development of the direct selling industry. How to learn from the experience of other advanced countries’ legislation, combined with the China’s current situation to make reform of the corresponding legal system is the expectation of the whole industry.
It has been ten years since the beginning of the direct selling, but there are only two regulations in China: Direct Selling Regulation and Prohibition of Pyramid Selling Regulation. To some extent, these two regulations are out of date and bring practical problems now. Supervision of direct marketing industry is no longer just can be effectively achieved by legislation only. It needs to establish an effective control system, and create a credit rating system and a industry association to supervise the direct selling industry. This paper based on the current situation and the legislation development of China’s direct selling, points out that the regulations of the direct selling has been unable to meet the development needs of the whole system. In order to fix the problem, this paper proposes the solutions by remodeling regulations in China’s direct selling system, then respecting a well development of this industry.
