독일과 오스트리아의 자영업자 고용보험 사례연구 (A Study on Employment Insurance in Germany and Austria)

초록

이 연구는 독일과 오스트리아 자영업자 고용보험을 분석하여 최근 화두가 되고 있는 자영업자를 포함한 고용보험의 단계적 확대와 관련된 시사점을 도출하고자 수행되었다. 이들 국가들의 자영업자 고용보험은 임금노동자로 있으면서 실업보험금을 납입하다가 자영업자로 전환한 사람들에게 고용보험의 연속성을 부여하기 위하여 임의가입형 실업보험제도를 운용하고 있으며, 실업부조제도도 함께 운영하고 있다. 특히, 독일은 일반 자영업자는 가입할 수 없으며, 근로자에서 자영업자로 전환한 사람들이 가입할 수 있으나, 수급 요건이 까다로워 가입률이 저조한 편이다. 정부가 별도로 재정 지원하는 것은 없으며, 실업보험기금이 자체적으로 재정을 충당하고 있다. 따라서 고용보험료가 높은 편이며, 자영업자의 소득기준도 정부가 일방적으로 제시하고 있다.
독일과 오스트리아에 비해 우리나라의 자영업자 고용보험제도는 상대적으로 자영업자 친화적이라 할 수 있다. 고용보험 수급금액에 비해 보험료 수준이 낮고 가입이 자유롭기 때문이다. 하지만 독일과 오스트리아에서는 폐업자영업자에 대해 실업부조제도를 통해 지원하고 있기 때문에 이들에 대한 사회보호제도가 미흡하다고 평가하기는 어렵다. 실업부조제도가 없는 우리나라의 경우 고용보험을 가입하지 않은 자영업자는 정책의 사각지대에 놓여있다고 볼 수 있기 때문이다. 정책의 사각지대 해소를 위해서는 무엇보다도 자영업자 고용보험 가입제한 업종을 축소시킬 필요가 있다. 그리고 장기적으로는 임의가입형 고용보험 외에도 실업부조제도를 도입하여 중층적 실업보호 시스템을 마련할 필요가 있다.

영어초록

The purpose of this study is to reveal the characteristics of the unemployment insurance systems for the self-employed in Germany and Austria and to check whether the system could be employed in Korea. The unemployment insurance systems in those countries are designed for wage workers who want to transition to self-employment to have a condition of entitlement to unemployment benefits. Therefore, it is restricted for the self-unemployed to join the unemployment insurance and thus is a voluntary base only for those who are eligible. However, the eligibility criteria for unemployment benefits are relatively hard for the self-employed to meet. Under these restrictions, it is not surprising that the rate of participation in the system is low. Another reason for their low participation rate is partly due to the fact that those countries operate an unemployment assistance system as well as unemployment insurance. Instead of participating in an expensive unemployment insurance system, the self-employed can be supported by unemployment assistance when they are bankrupt.
Compared with the unemployment insurance system for the self-employed in Germany and Austria, the unemployment insurance in Korea is designed to be relatively self-employed friendly. The insurance payment is relatively low in Korea and it is even cheaper when the central and regional governments support the payment. However, the generosity of the Korean unemployment insurance system would be caused by the unavailability of the unemployment assistance system.
Without unemployment assistance, it seems necessary to leave no dark corner by enlarging the coverage of the unemployment insurance system in the short run. Ultimately, the unemployment assistance system needs to be implemented to complement unemployment insurance in the long run.
