동물관련 법제의 입법과정에 관한 일고찰: 지각적 존재(sentient beings)와 업(業, karma)을 기준으로 (A study on the legislative process of animal-related legislation: Focus on sentient beings and Karma)

초록

우리 사회와 중국과 일본 등 동아시아 지역은 오랜 기간 동안 불교의 영향 하에 있었다. 불교의 영향을 받은 생명 사상을 가진 사람들은 ‘생명체는 모두 소중’한 것이며 그에 대한 ‘살생은 절대적으로 금지’한다. 그러나 이러한 불교적 바탕에도 불구하고 우리는 더 확대하여 동아시아에서 현재를 살아가는 자들에게 “동물은 그저 ‘물건’일 뿐”이다.
반면에, 서구 사회의 경우 동물은 인간에게 공급되는 자원이었고, 인간은 이를 이용하는 이용자에 불과했다. 서구에서 이러한 사상이 뿌리 내리게 된 것에 대해 많은 이들은 기독교의 영향으로 받아들인다. 아이러니하게도 이러한 기독교 사고 방식하에 있는 서구에서 주도적으로 으로 동물복지 혹은 동물권 문제가 제기 되고 있다. 동양과 서양은 각각 자신들의 철학적 기반에서 정 반대로 달려가고 있다.
동물을 지각적 존재(sentient beings)인가를 기준으로 인(人)과 물(物)의 어디쯤엔가 위치시키려는 서구의 시도는 평가 받아 마땅하다. 또한, 이와 같은 주장을 받아들여 우리 법체계하에서도 지각적 존재인 동물을 물(物)과는 구별하여 보려는 시도 또한 의미 있다. 허나, 공리주의 혹은 권리주의로 대표되는 서구의 동물의 권리와 복지 논의는 고통을 느끼는 지각 있는 동물에 대해 인간이 ‘호의’로 그들의 권리와 복지를 인정해줘야 한다는 차원을 넘어서지 못하고 있다.
그러나 동양적 전통 그 중에서도 업과 윤회의 사상을 통한다면 인간이 동물의 권리와 복지를 인정해야 하는 이유가 인간이 동물에게 베풀어주는 ‘호혜’ 혹은 ‘호의’의 의미를 벗어나게 된다. 인간이 동물을 대하는 태도에 의해 ‘업’이 형성되고 이것이 직접적으로 인간의 윤회에 영향을 끼치게 되므로 인간이 동물을 ‘잘’ 대해주는 것을 ‘권고’하는 수준이 아니라 인간이 동물을 험하게 다루거나 동물의 생명을 이유 없이 빼앗을 경우 업이라는 부정적 요소의 패널티가 인간에게 쌓이는 것이다.
필자는 현재 국내에서 진행되고 있는 동물관련 법제를 크게 5가지로 나누어 보았다.
첫째, 반려 동물관련 법제이다. 반려동물은 5가지 동물의 범주 중 가장 사물이 아닌 동물로 대우받는 집단이다. 반려 동물관련법제는 반려 동물의 관리에 초점을 맞추고 있다.
둘째, 동물원 동물 관련 법제이다. 동물원 동물 관련 법제의 경우 가장 먼저 고려해야할 부분이 동물원을 관리하고 감독할 수 있는 주체의 일원화를 명시하는 것이다.
셋째, 축산 동물 관련 법제이다. 축산 동물 법제의 경우 공장식 축산을 통해 발생하는 살처분 등의 해결을 위한 합리적인 법률 개정은 보이지 않는 문제가 존재한다. 또한 보상금에 대한 보다 구체적인 법률 개정안 도출이 필요하다.
넷째, 실험 동물 관련 법제이다. 인간의 복지와 신약 개발 등을 위해 사용되는 실험동물 법제에서 가장 중요한 부분은 실험동물의 개체 수의 제한이다.
다섯째, 야생 동물 관련 법제이다. 앞서 살핀 4가지의 동물 범주에 들어가지 않는 동물을 야생동물이라 칭할 수 있을 것이다. 본디 동물의 근본적인 습성을 그대로 존속하는 것이다. 그들이 다른 동물의 먹이가 된다 해도 그것이 본디 ‘자연스럽’다면 최상의 가치가 된다.
인간은 동물을 위해야 한다. 그것은 인간이 만물의 영장으로서 베푸는 ‘시혜’가 아니라 윤회와 업이라는 우주 질서에 관한 ‘존중’이기 때문이다.

영어초록

Many East Asian countries including Korea, China, and Japan have been under the influence of Buddhism for a long time. In Buddhism, all lives are considered valuable and taking lives of animals is prohibited. In modern Asian culture, however, animals are viewed as mere objects.
In Western culture, on the other hand, animals used to be considered as a source that is provided to human beings. Christianity had a lot to do with this belief. Ironically, though, issues with animal rights have been getting a lot of attention in the Western culture in modern era. Many Western countries are leading debates and discussions regarding animal rights and welfare in the global society. The East and the West are moving toward the opposite end of the continuum of the philosophy on how they perceive animals.
The effort of the Westerners to decide whether animals are sentient beings and where animals stand on the line between objects and human beings is worth taking notice of. The effort of the East to adopt those changes and to give legal distinctions between animals and objects in their own cultures is also encouraging. However, the Western effort has its limit in that it perceives the deals with animal rights and welfare as a favor of human beings toward non-human beings.
Under the Eastern traditions, especially the concepts of karma and samsara, animal rights and welfare are more than a favor human could do for animals. the Eastern teachings state that human get karma and samsara according to how they treat animals; if they abuse animals, it would come back to them in their next lives. Thus, human beings must treat animals fairly for their own sake.
Legislation addressing animals rights in South Korea can be divided into five categories:The first is the legislation concerning pets. Pets are the only group among the five animal categories that are regarded as beings rather than objects. Laws regarding pets focuses on pet welfare.
The second is the legislation concerning zoo animals. Before addressing cases regarding these animals, one must clearly state agents that are responsible for management of the institution.
The third is the legislation concerning livestock. When it comes to issues with livestock, there are issues and problems of factory farming that are not readily apparent. To draw reasonable solutions for issues such as stamping out of livestock and matters of compensation, more apprehensive and specific law revision is needed.
The fourth is the legislation concerning animal testing. The most important issue to address in this is how to limit the number of animals that are allowed for animal testing.
The fifth is the legislation concerning wild animals. Animals that are not included in the four categories stated above could be regarded as wild animals. Wild animals keep their basic instincts in nature. If they die as a prey of their predators - as long as it happens naturally without any artificial force- that is how their values are uphold the highest by the order of nature.
Human beings should treat animals with compassion and respect not as a favor to inferior beings but as a respect toward the order of universe, karma and samsara.
