국가와 지방자치단체 간의 관계-제주특별자치도는 얼마나 특별한 道일 수 있는가?- (On the Relationship between State and Local Governments)

초록

이 글은 현행 특별법이 제주도의 특별한 발전을 위하여 규정하고 있는 내용을 중심으로 국가와 지방자치단체, 여기서는 특히 국가와 제주특별자치도의 관계에 관하여 살펴보았다. 이를 통하여 제주도가 정말 특별한 자치도로 발전할 수 있는 가능성을 탐색하였다.
제주도를 국제적인 도시로 발전시키기 위한 노력은 오래 전부터 시작되었다. 1999년에 제정되었던 제주도개발특별법에 이어서 2002년에는 제주국제자유도시 특별법이 제정된 바 있다. 2002년의 법은 한층 개방적이고 혁신적인 내용을 담고 있다고 평가할 수 있다. 경제자유구역 및 제주국제자유도시의 외국교육기관 설립․운영에 관한 특별법은 2005년에 제정되어 국제도시의 면모를 갖추기 위한 뒷받침을 제공하고 있다.
2006년의 제주특별자치도의 설치 및 국제자유도시 조성을 위한 특별법은 종래 추진하던 국제자유도시 조성과 함께 지방분권의 강화를 주요 골자로 하고 있다. 이는 국제도시 추진을 위하여 제주도에 대한 지방자치권 강화가 필수적이라는 인식이 공감을 얻은 데 연유하는 것으로 생각한다.
국가와 제주특별자치도는 지원과 협력을 통한 동반자 관계에 있다고 할 수 있겠다. 제주특별자치도 조성의 한 축은 고도의 지방분권을 이루기 위한 것이나 현재는 국제자유도시의 건설 이라는 목적에 초점이 맞추어져 있으며 지방자치의 이상은 그 하위 개념이 되고 있다. 이는 제주특별자치도 기초자치단체를 폐지하고 행정시로 변경한 데서도 잘 나타난다.
제주특별자치도는 아직 재정이 열악하여 국가의 지원과 조성을 필요로 하는 측면이 크다. 그런데 국가 주도의 조성사업은 제주도가 지향하는 사람과 상품과 자본의 이동이 자유로운 국제도시의 건설에는 다소 부담이 되는 측면도 있을 것이다. 긴 안목에서 보면 外國人과 外製와 外資가 자유롭게 드나들 수 있도록 국가는 한 걸음 물러서 있는 것도 현명한 방법이 아닐까 생각해 본다. 물론 이를 위해서는 국민의 이해와 국민적 합의가 전제되어야 할 것이다.

영어초록

This study investigates the relationship between the nation and local government in Korea, especially that of the nation and Jeju Special Self‐Governing Province, centering on the content of the Special Act on the special development of Jeju Island in the current Special Law for Jeju Free International City. Through this study, the potential for Jeju Island to be developed into a truly special Self‐Governing Province is explored.
Efforts to develop Jeju Island into an international city started long ago. Following the Jeju‐do Special Development Law enacted in 1999, the Special Law for Jeju free International City was enacted in 2002. The law of 2002 contains more open and revolutionary change. The special law on the free economic zone and establishing and operating foreign educational organizations in Jeju international free city which was enacted in 2005 provides proper support to form Jeju into an international city.
The main point of the Special Law on establishing the Jeju Special Self‐Governing Province and building Jeju free International City enacted in 2006 is to promote decentralization of power together with the existing efforts to make Jeju a free international city. This is considered to be a result of the wide‐spread recognition that granting the status of a special self‐governing entity to Jeju Island is essential for the acceleration of efforts for it to become an international city.
The central government and the Jeju Special Self‐Governing Province can be regarded as having a partnership for the support of and cooperation with each other. One important step in building the Jeju Special Self‐Governing Province is to achieve high degree of decentralization of power, but the focus is now more on the goal of building a free international city, and the goal of decentralization has become a subordinate concept to that. This was clear when the Self‐Governing Provincial Council was dismantled and Jeju was changed to an administrative city.
The finances of the Jeju Special Self‐Governing Province are limited, and the island needs national support and assistance. However, the establishment project driven by the nation could become a burden in the development of a free international city where people, goods and capital move freely, which is the goal of Jesu Island. In the long run, it would be better for the nation to step back to allow foreign professionals, foreign goods and foreign capital to move freely in and out of Jeju. To realize that, of course, it will need national understanding, and national consensus should be a precondition.
