지적재조사사업에 의한 소유권의 양적변화에 대한 법정책적 고찰 (Law policy research for the quantitative changes in the ownership of the Cadastral business review)

초록

지적재조사는 일제의 토지조사사업에 의해 시작된 이후에 국가적 차원에서 재조사사업이 시행되지 않은 채 지금까지 이어져 왔다. 그동안 한국전쟁 및 급격한 경제화 등으로 인하여 지적에 대한 측량에 차이가 발생하는 경우가 증가하였다. 그럼에도 적극적인 대처가 없었으나, 지적재조사에 관한 특별법을 제정하고 이에 근거하여 지적불부합지에 대한 지적재조사 사업을 시행하게 되었다.
지적재조사에 관한 특별법은 지적불부합지에 대한 소유자나 이해관계인 간의 발생하는 법적 문제를 해결하고자 하였다. 해결방법으로 당사자 간의 합의에 의한 경계설정을 최우선순위로 두고 있다. 지적재조사의 결과 실제면적이 증가한 경우에는 조정금을 납부케 하거나 반대로 감소한 경우에는 조정금을 지급하는 것이 가장 기본적인 이해조정의 방식이다. 지적재조사에 의해 확정된 경계설정에 대하여 이의를 제기할 수도 있는데, 즉 경계결정위원회의 결정에 불복하게 되면 법원에 의한 권리구제를 하게 된다.
이와 관련하여 지적재조사사업에 의해 발생하는 법적 문제에 대해 법정책적으로 접근할 몇 가지 문제가 있다. 첫째 지적재조사에 의해 발생한 법적 문제를 해결할 방법으로서 조정금의 지급을 규정하고 있는데, 여기서 문제가 되는 것은 조정금의 법적 성질에 관한 것이다. 지적재조사에 관한 특별법에서는 조정금의 법적 성질에 관한 규정이 없다. 지적재조사를 시행하게 되면 토지면적이 감소하여 지급되어야할 조정금이 부족하다고 한다. 이러한 경우에 조정금의 법적 성격이 문제될 수 있으므로 입법정책적인 고려가 필요하다. 둘째 점유취득시효를 인정할 때에 예외적으로 현실경계를 기준으로 점유취득시효를 인정하는 경우가 있다. 원칙적으로는 지적도상의 경계를 기준으로 점유취득시효를 인정하는 것이 판례의 태도이지만 예외적으로 현실경계를 기준으로 인정하게 되면 지적재조사가 무력화될 여지가 있어 문제이다.

영어초록

The purpose of this study is to suggest a Resolution method according to increase and decrease of the area by comparatively examining the Special Act on adastral Resurvey(draft) that drew up at the the Ministry of Land, Transport and Maritime, Korea Cadastral Survey Corporation and National Assembly since 1996. Namely the purpose of this study is presenting a few logical issues related the cadastral resurvey project which has been examined by Ministry of Land, Transport and Maritime affairs recently.
Currently cadastral system doesn't coincide with the present land situation because the existing cadastral records have been written on the papers with an old fashioned technology and equipment. Moreover a lot of land information has been digitized, but cadastral information can't be accurate any longer, so this cadastral system can't integrate with other land information. To solve this problem, Ministry of Land, Transport and Maritime Affairs has been pursued this bill nationwide.
The boundaries are determined by the law review pointed out, the first of its standards, and the borders of the agreement between the parties with priority stipulates that decision through the resolution of the boundary commission decision to the next. This does not made a decision about the road boundary through the process to file a complaint and a lawsuit may be filed to appeal the decision on the appeal.
In this paper, noticing that the Special Act on Cadastral Resurvey does not clearly stipulate on whether there is change in the real right for the ownership scope of adjacent lands and legislative relationship for specie collection and payment, it is attempted to seek verification on its legislative relationship. It is considered that such attempt will be relevant to resolutions in the boundary disputes in the future. Also divided into resolved and other solutions by reviewing the law pointed to the resolution of legal issues arising from the review pointed out, research was focused on problems and solutions for each occurrence.
