노인장기요양시설 CCTV 설치 입법의 평가와 과제 (Problems of CCTV Installation Legislation for Long-Term Care Facilities for the Elderly in Korea)

초록

노인장기요양시설의 CCTV 설치를 의무화한 2023년 개정 노인장기요양법 제33조의2 이하는 어린이집 CCTV 설치를 의무화한 2015년 개정 영유아보육법 제15조의4 이하를답습한 것이다. 어린이집과 노인장기요양시설의 CCTV 설치는 아동 학대 또는 노인 학대의 예방·사고 방지라는 공익적 목적과 각 공간에서 생활하는 이용자와 그곳에서 보육과 요양 서비스를 제공하는 종사자의 초상과 프라이버시 등 인격권과 개인정보에 관한자기결정권 또는 종사자의 근로 조건 내지 근로 환경에 관한 권리 사이에 법익 충돌 내지 기본권 침해의 문제를 발생시킨다.
어린이집 및 노인장기요양시설의 CCTV 설치는 각각 영유아보육법 제15조의4와 노인장기요양법 제33조2의 CCTV 설치의무 규정 또는 개인정보보호법에 따라 합법적 요건을갖추고 있다 하더라도 헌법상 기본권 제한에 대한 과잉금지의 원칙에 합치하여야 한다.
다만, 사생활의 비밀 및 자유의 보호는 그 권리 주체가 처분할 수 없는 것은 아니므로본인이 그 침해의 위험을 알고 이에 동의한 경우에는 원칙적으로 기본권 제한의 문제는발생하지 않는다.
따라서 법률상의 근거 유무와 관계없이 CCTV 설치와 그 영상의 수집에 의하여 영향을 받는 권리 주체들이 권리 침해의 가능성에 대하여 충분한 설명을 듣고 이에 동의하도록 함으로써 CCTV 설치의 공익 목적과 기본권 침해 사이에 조화로운 해결을 꾀할 필요가 있다.
그러나 영유아보육법은 CCTV를 설치하지 않는 경우에만 보호자 전원의 동의를 얻도록 규정하고 있을 뿐, CCTV 설치 자체에 대하여는 영유아의 친권자 등 보호자의 동의나보육교사 등 종사자의 동의에 관하여는 규정하고 있지 않다. 반대로 CCTV 설치 의무화의 예외로서 이를 설치하지 않거나 개인정보 침해의 위험이 보다 높은 네트워크 카메라설치로 이를 대체하는 경우에 대해서만 보호자의 동의를 규정하고 있다. 이러한 법상태는 CCTV 설치에 관한 개정 노인장기요양보험법 제33조의2에 있어서도 마찬가지이다.
노인장기요양시설의 CCTV 설치 의무화는 그곳에서 거주 생활하는 노인들의 일상이적나라하게 노출될 수 있다는 점, 어린이집 CCTV 설치 의무화에서는 그 부모들의 동의를 사실상 전제하고 있으나 노인장기요양시설 CCTV 설치의무화에 있어서는 그 보호자가 당연히 CCTV 설치에 대한 동의권을 갖는 것은 아니라는 점에 유의할 필요가 있다.
특히, 노인장기요양시설 내 침실은 그곳이 공동생활의 공간이라고 하더라도 일상의 내밀한 생활 모습이 적나라하게 노출되는 공간이라는 점에서 거주 노인의 동의 없는 영상의촬영과 그 저장은 사생활의 비밀과 자유에 대한 본질적 내용에 대한 침해로서 허용될 수없다. 따라서 침실에 CCTV를 설치할 경우, 원칙적으로 해당 방실에 거주하는 노인 전원의 동의가 필요하다. 다만, 노인장기요양시설 입소 노인의 특성상 전형적으로 신상에 관한 결정능력이 손상되는 경우가 적지 않다. 따라서 그들의 사생활의 비밀과 자유에 관한처분의 결정(CCTV 설치에 대한 동의)에 대하여 필요한 의사결정의 지원과 예외적으로 그들이 스스로 결정할 수 없는 경우 신상결정을 대행하는 사람과 그 방법을 정하기 위한법률 개정이 필요하다.

영어초록

Article 33(2) of the Elderly Long-Term Care Act of 2023, which mandates the installation of CCTV in long-term care facilities for the elderly, is a replication of Article 15(4) of the Infant and Child Care Act of 2015, which mandates the installation of CCTV in daycare centers for children. The installation of CCTV in daycare centres for children and long-term care facilities for the elderly raises issues of conflict of legal interests and infringement of constitutional human rights between the public purpose of preventing child abuse or elder abuse and preventing accidents, and the personality right and the right to self-determination of privacy, such as the portrait and privacy of users living in each space and workers providing child care and care services there, and the right to working conditions and working environment of workers.
The installation of CCTV in daycare centres for children and long-term care facilities for the elderly must be consistent with the principle of prohibition of excessive restrictions on constitutional human rights under the Korean Constitution, even if it is legally required under the provisions of Article 15(4) of the Infant and Child Care Act and Article 33(2) of the Elderly Long-Term Care Act, respectively, or the Personal Data Protection Act. However, since the protection of the secrecy and freedom of private life is at the disposal of the subject of the right, if the person is aware of the risk of infringement and consents to the installation of CCTV, the issue of restriction of constitutional human rights does not arise in principle.
Therefore, it is necessary to find a harmonious solution between the public interest purpose of CCTV installation and the infringement of constitutional human rights by ensuring that the rights holders affected by the installation of CCTV and the collection of images are fully informed of the possible infringement of their rights and given the chance for their consent.
However, it is important to note that in the case of the mandatory CCTV installation in elderly care facilities, the family member or guardian to protect the elderly does not necessarily have the right to consent to the installation of CCTV. In particular, the bedroom in a long-term care facility for the elderly is a space where intimate life is exposed, even if it is a space for communal living, so the recording and storage of footage without the consent of the resident cannot be permitted as an intrusion into the essential content of the right to privacy and freedom. Therefore, when installing CCTV in a bedroom, the consent of all the elderly living in the room is required in principle. However, as the characteristics of elderly people living in long-term care facilities typically impair their ability to make decisions about their personal affairs, it is necessary to amend the law to provide support for decision-making on dispositive decisions concerning their privacy and freedom (consent to the installation of CCTV) and, in exceptional cases where they are unable to make decisions on their own, to determine who and how to make decisions on their behalf concerning their privacy and freedom.
