식물신품종보호를 위한 제도 개선방안 연구 (A Study on System Improvement Plan for the Protection of New Varieties of Plants)

초록

최근 식량자급률이 낮아지면서 우리나라도 불안정한 식량수급을 염려하고 있다. 식량안보가 위협받고 있는 이 시점에서 안정적 식량 확보를 위한 우리나라 고유의 종자 및 새로 개발한 신품종에 대한 중요성은 더욱 크다고 할 수 있다. 기존의 종자산업법이 종자의 보증․유통관리 등에 관한 실체적 규정과 품종보호에 관한 절차적 규정이 혼재되어 있어 법의 체계와 내용이 복잡하고 이해하기 어렵다는 지적에 대한 현실적인 반영으로 식물신품종보호법이 제정되었다. 새로운 종자산업법은 대체로 기존의 체제와 내용을 가지고 있지만 분리개정 되면서 중요한 의미를 가진다. 특히 분쟁종자의 대상을 보증종자에서 모든 종자로 확대하고, 그에 따른 수수료 규정과 조정절차를 도입함으로써 일반 무보증 유통종자가 대부분인 현실을 인정하고 동시에 불필요한 분쟁남발을 방지하고자 한 조치이다. 이와 별도로 정부 보급종으로 인한 피해 지원근거를 마련한 것은 민원 해결과 종자분쟁에 있어 매우 의미 있고 선진적인 조치로 받아들여지고 있다.
종자산업 활성화를 위한 민간육종연구단지 설립은 종자산업 전문 인력 육성체계 구축을 통해 현재의 전문 인력 양성 부족문제를 해결하고, 종자산업육성정책 연계를 통한 연구기능 강화를 통해 고부가가치 품종의 육종기술도 기대해 볼 수 있을 것이다. 식물신품종보호를 위한 기탁제도 도입과 식물의 특성을 고려한 규정 마련, 특허법과 특별법의 상이한 보호체계 개선, 품종 육종가를 보호 및 지원하고 품종관련 비즈니스가 지속가능하도록 선진국의 성공적인 로열티제도를 참고하여 국내에 반영할 필요가 있다. 생물다양성과 유전자원 접근제한, 기후변화라는 문제들이 우리나라뿐만 아니라 세계가 공통으로 직면한 과제이기 때문에 이러한 위기를 극복하기 위해서도 종자산업의 중요성은 더욱 대두될 것이다.

영어초록

While a food self-sufficiency rate becomes low these days, our country is also Worried about unstable demand and supply of food. When food security has received the threat, it can be said that the importance for the Korean own seed and the current cultivar developed new varieties of plants of our country for stable food reservation is still larger. Substantive regulation concerning the existing Seed Industry Act a guarantee, distribution management, etc. of a seed and the procedural regulation about kind protection are intermingled, and Law for the Protection of New Varieties of Plants was enacted by the realistic reflection to indication of the system and the contents of law being complicated and being hard to understand. It is said that a new Seed Industry Act has an important meaning while separation revision is carried out, although it has existing organization and the contents generally. It is the measure which thought especially the object of a dispute seed is expanded to all the seeds with a certified seed, a general uncertified circulation seed would mostly come out, a certain reality would be accepted by introducing the commission regulation and adjustment procedure accompanying it, and would prevent an unnecessary dispute excessive issue simultaneously. It is in settlement of civil complaint and seed dispute to have prepared the damage support basis by a government spread kind aside from this, and it is received as it being very meaningful and there being an advanced measure. Probably the private sector breeding research housing complex establishment for seed industry activation could solve the present special staff training insufficient problem through seed industry special personnel training system construction, and could also expect and see the breeding technology of a higher value-added varieties through the research functional enhancement through seed industry training policy cooperation. It is also required the deposition system for Law for the Protection of New Varieties of Plants and to take care of and support the protector system improvement and breeder from whom the regulation and Patent Law in consideration of the characteristic of introduction and a plant, and special law differ, to refer to the successful loyalty system of advanced countries, and to reflect it at home so that varieties related business can be maintained. The importance of seed industry will gain power further, also in order to conquer this crisis, since the problem of biodiversity, genetic resource approach restrictions, and a climate change is a subject which not only our country but the world was common, and was faced.
