초록

디지털에 의한 성범죄가 사회문제화 된 것은 이미 오랜 시간이 지났으며 특히 아동청소년도 피해자가 될 것이라는 우려는 2000년 이후 인터넷의 보급 초기 시점부터 충분히 예견되어 왔다. 그러나 우리 사회는 2020년 경악할 만한 사건을 겪고 나서야 관련 법률의 정비를 서두르게 되었고, 급기야 마약 등의 범죄에서만 예외적으로 허용되는 함정수사를 수사 특례라는 명칭으로 도입 하기에 이르렀다.
수사 특례는 기존에 볼 수 없었던 방식으로, 절차상 발생할 수 있는 문제점을 가급적 희석시키면서도 인터넷 공간에서 발생하고 있는 다양한 유형의 범죄를 예방할 수 있을 정도로 치밀하게 구성되어야 한다.
그러나 현 조문 중 신분비공개수사는 지나치게 형식적으로 규정되었다고 보여진다. 물론 절차적 정당성을 확보하기 위한 조치들로 이해할 수도 있지만 수사 특례를 시행하는 이유는 아동청소년을 대상으로 한 디지털 성범죄가 더 이상 일반적인 수사로 예방할 수 없기 때문이며 이러한 절차적 규정들은 궁극적으로 조문의 실효성을 떨어뜨리는 것이 아닌가 우려된다.
또한 수사 특례 중 신분위장수사는 문서 등을 변경해서까지 신분을 위장하고 그 위장신분으로 계약이나 거래를 하며 성착취물을 판매까지 할 수 있게 규정된 것은 문제가 있다. 특히 성폭력범죄의 처벌 등에 관한 특례법상의 촬영물과 아동청소년 성착취물도 사용할 수 있다고 규정한 것은 더욱 큰 문제라고 볼 수 있다.
따라서 수사특례는 신분비공개수사의 경우 지나치게 형식적으로 규정된 부분은 실질적인 부분이 재고되어야 하며, 신분위장수사의 경우 범의유발형 함정수사에 해당되지 않도록 전반적인 수정과 함께 사용할 수 있는 자료들에 원천적인 검토가 필요하여 향후 해당조문은 이러한 부분들을 고려한 전반적인 개선이 필요하다고 판단된다.

영어초록

It has been a long time since digital sexual crimes have become a social issue, and the concern that children and adolescents could be victims has been sufficiently anticipated since the early 2000s, at the initial stage of the internet's proliferation.
However, it was only after a shocking incident around 2020 that our society hastened to revise related laws, eventually introducing entrapment investigations, which were exceptionally allowed only for crimes such as drugs, under the name of special investigation measures.
Special investigation measures must be meticulously designed to prevent various types of crimes occurring in cyberspace while minimizing procedural issues that may arise, which were unprecedented in the past.
However, the current provision on undisclosed identity investigations seems to be excessively formalistic. While these measures can be understood as steps to ensure procedural legitimacy, the reason for implementing special investigation measures is that digital sexual crimes targeting children and adolescents can no longer be prevented by conventional investigations, and such procedural regulations ultimately may diminish the effectiveness of the provisions.
Additi onally, there is a problem with the provision that allows identity disguise investigations to alter documents to disguise identity, and to engage in contracts or transactions with the disguised identity and even sell sexually exploitative materials. It is especially problematic that the provision permits the use of recordings under the Act on Special Cases Concerning the Punishment of Sexual Crimes and child and adolescent sexually exploitative materials.
Therefore, for undisclosed identity investigations under special investigation measures, the overly formalistic parts should be reconsidered to become more substantive, and for identity disguise investigations, comprehensive revisions are needed to ensure they do not fall under entrapment investigations that induce criminal intent, and a fundamental review of the materials that can be used is necessary. It is judged that the relevant provisions need overall improvement considering these aspects.
