초록

소비자지향이란 소비자의 기본적 권익 중심적 사고를 말한다. 시장경제에서 소비자의 기본적인 권리가 보장되도록 하여 소비자 정책을 실현하고자 새롭게 도출한 개념이다. 소비자지향의 개념이 방향적 상대적 특성을 가지는 가운데, 소비자지향적 법제도란 소비시장에 다양한 물품이 공급되는 가운데 소비자의 선택이 더 나은 소비시장을 형성하는데 주요한 원이 되도록 하는 법제도를 말한다. 소비자지향적 제도개선사업은 소비자지향성 평가지침과 소비자지향성 운영지침에 근거하고 있는 가운데, 관계행정기관의 법제도의 평가와 대안 제시 방법을 둘러싸고 다음과 같은 개선 방향을 제시한다.
첫째, 매년 수행하는 소비자지향적 제도개선사업의 결과물이 소비자지향성 개념과 대표사례에 반영되어야 한다. 향후 소비자지향성 평가지침의 개선은 관계행정기관의 소비자 중심의 법제도를 유인하고 이해를 높이는데 기여한다.
둘째, 소비자지향적 제도개선사업은 공급 중심 법제도에 대응하는 수요 중심의 법제도로서 폭넓게 활용이 필요하다. 또한 정부의 규제개선이나 복지서비스 등에서도 소비자지향적 제도개선사업을 통해서 국민의 권익을 증진시킬 수 있다.
셋째, 소비자지향적 제도개선사업은 소비자 권익을 실질적으로 증진하기 위해서 효과적인 대안 도출이 중요하다. 실제 소비생활에서 소비자지향적 제도개선사업의 효용성을 검증할 필요가 있고, 예비개선안을 마련하는 과정에서 전문가 및 소비자의 의견을 수렴할 수 있는 다양한 절차가 모색해야 한다.

영어초록

Consumer orientation refers to the basic interests-centered thinking of consumers. It is a newly derived concept to realize consumer policy by guaranteeing the basic rights of consumers in the market economy. While the concept of consumer orientation has directional and relative characteristics, the consumer-oriented legal system refers to a legal system that allows consumers’ choices to be a major factor in forming a better consumer market amidst the supply of various products to the consumer market. While the consumer-oriented legal system improvement works is based on the consumer-oriented evaluation guidelines and consumer-oriented operation guidelines, the following improvement directions are presented around the method of evaluating the legal system of related administrative agencies and suggesting alternatives.
First, the results of the annual the consumer-oriented legal system improvement works should be reflected in consumer-oriented concepts and representative cases. The improvement of the consumer orientation evaluation guidelines in the future will contribute to attracting the consumer-oriented legal system of related administrative agencies and increasing their understanding.
Second, the consumer-oriented legal system improvement works needs to be widely used as a demand-oriented legal system that responds to the supply-oriented legal system. People’s rights and interests can be promoted through consumer-oriented institutional improvement projects in the government’s regulatory improvement or welfare services.
Third, it is important for the consumer-oriented legal system improvement works to find an effective alternative method to practically promote consumer rights and interests. Verification of the effectiveness of the consumer-oriented legal system improvement works in actual consumption life is required, and various procedures that can collect the opinions of experts and consumers must be continuously sought in the process of preparing preliminary improvement plans.
