법인세법상 이월결손금이 회계이익과 과세소득의 차이에 미치는 영향 (The effect of Tax Carryforwards under the corporate tax law on the Book-Tax Differences)

초록

본 논문은 법인세법상 이월결손금이 이익조정에 영향을 미치는 지를 분석하였다. 이익조정대용치로는 회계이익과 과세소득의 차이를 사용하였으며 이월결손금이 존재하는 경우 과세소득은 감소하므로 회계이익을 재량적으로 극대화하려는 유인이 존재할 수 있다. 따라서 이월결손금이 존재하는 경우 과세소득을 줄이면서 보고이익을 증가시키는 지를 분석하였다 그리고 이월결손금의 규모에 따른 회계이익과 과세소득의 차이에 어떠한 영향을 미치는지를 분석하였다. 분석기간은 2014년부터 2017년까지로 상장기업을 대상으로 금융업 및 자료미비인 기업을 제외한 12월 결산법인 중 2,117개 기업을 최종표본으로 하여 이용하였다.
실증분석 결과를 살펴보면 가설 1과 관련하여 이월결손금의 존재 여부가 회계이익과 과세소득 차이에 1%수준에서 유의한 양의 관계를 나타내고 있다. 이는 이월결손금을 통하여 회계이익을 높게 보고하고 과세소득은 감소 또는 일정한 수준으로 유지하는 경영자의 이익조정이 가능하다는 것을 의미한다. 가설 2와 관련하여 이월결손금 규모에 따른 회계이익과 과세소득의 차이에 대하여는 1%수준에서 유의한 양의 관계를 나타내고 있다. 이러한 결과는 법인세법상 이월결손금의 규모가 클수록 보고되는 회계이익을 더 높게 계상하여 이익조정을 하는 것으로 보인다. 그러므로 추가분석에서는 기업의 지배구조 특성에 따른 이익조정이 이루어지는지 여부를 분석하였다. 감사위원회가 설치된 기업일수록, 그 중에서 자율적으로 설치한 기업이 회계이익과 과세소득의 차이가 유의한 음의 관계가 나타나 이익조정을 감소시키는 역할을 한다는 것을 확인하였다.
본 연구의 한계점으로는 모형상의 통제변수 중에서 제외된 변수가 존재할 수 있으며 결과상의 해석에 있어서 주의가 필요하며 향후연구와 관련해서는 이월결손금과 관련한 조세회피와 관련된 연구가 필요하다고 사료된다.

영어초록

This paper analyzed whether the carry-over loss affects the adjustment of profits under the corporate tax law. As a countermeasure for profit adjustment, the difference between accounting profit and taxable income is used and the taxable profit is reduced if the carrying amount is present, so there may be an incentive to make a discretionary maximize of accounting profit. Therefore, it was analyzed whether to increase the reporting profit by reducing the taxable profit if the carry-over loss existed and how it would affect the difference between accounting profit and taxable income depending on the size of the carry-over loss. The analysis period was from 2014 to 2017, when 2,117 of the December settlement companies were used as final samples for listed companies, excluding those with insufficient financial and data. The empirical analysis results show that the existence of carry-over losses in relation to hypothesis 1 is a significant positive relationship between 1% and 1% of the difference in accounting profit and taxable income. In relation to hypothesis 2, the difference between accounting profit and taxable profit by the size of the carrying amount of the carrying amount is: A significant positive relationship at the 1% level is indicated. This result is seen as a result that the larger the amount of the carryover loss under the income tax law, the higher the reported accounting profit is calculated and adjusted for profit. Therefore, the additional analysis analyzed whether the adjustment of profits is based on the characteristics of the entity's governance structure. The more companies the audit committee was set up, the more it was confirmed that among them self-imposed entities, the more significant the difference between accounting profit and taxable income, the more significant the negative relationship that played a role in reducing profit adjustment.
The limitations of this study are that the variables excluded from the control variables in the model may be present. It is believed that there is a need for caution in the interpretation of the results and for future studies, studies related to tax credits related to carry forward losses are necessary.
