법인지방소득세의 과세적합성과 개선방향에 대한 연구 (A Study on the Taxation Suitability and the Improvement Direction of Corporate Local Income Tax)

초록

[연구목적] 지방소득세는 2010년에 신설되어 소득세와 법인세에 부가적 방식으로 과세되어 오다가 지방소득세의 기능을 강화하기 위해 2014년 독립적인 과세체계를 갖추게 되었다. 본 연구는 법인지방소득세의 과세현황과 구조를 분석하여 법인지방소득세제의 문제점들과 이에 대한 개선방향을 제시하고자 하였다.
[연구방법] 본 연구는 현행 지방소득세의 과세구조에 대하여 이론적으로 고찰하고 2014년이후의 관련 선행연구들을 살펴본다. 또한 지방세통계연감의 통계자료를 통해 지방소득세의 과세현황을 분석한다. 동시에 우리나라와 외국의 지방소득세제의 비교를 통해 법인지방소득세의 문제점과 개선방향을 모색하였다.
[연구결과] 현행 법인지방소득세는 국세인 법인세의 과세표준 구간과 누진세율체계를 동일하게 적용하는 과세구조이다. 이는 법인의 이익에 기초하여 조세부담이 이루어지는 과세구조로서 지방세의 기본적 과세특성인 편익원칙에 부합하지 않는다. 또한 법인사업장이 소재한 지자체별 세수의 안분은 종업원 수와 사업장 면적이 적용된다. 따라서 법인의 수와 규모에 따라 지방자치단체별 세수의 편중성이 크게 발생되었다. 이렇게 편익원칙과 과세보편성측면에서 볼 때 법인지방소득세는 지방세로서의 과세적합성이 낮다고 판단된다.
[연구의 시사점] 편익원칙의 부합성과 지방세로서의 과세적합성을 제고할 수 있도록 누진세율에서 단일비례세율로의 전환과 공동징수 및 세입배분의 공동세 방식의 개선이 필요하다. 본 연구가 제시한 개선방향에 따라 향후 법인지방소득세의 보다 효율적인 운용과 지방세 및 지방재정구조 개편에 작게나마 유용한 자료 제공이 될 수 있을 것으로 기대한다.

영어초록

[Purpose] Local income tax was newly established in 2010 and taxed in an additional way to income tax and corporate tax, and in 2014 it became independent taxation system to strengthen the function of local income tax. This study aims to suggest problems of corporate local income tax system and improvement plans by analyzing the current status and structure of corporate local income tax.
[Methodology] This study theoretically examines the current tax structure of local income tax and examines the related precedent studies after 2014. In addition, the current state of local income tax is analyzed through statistical data of the statistical yearbook of local tax, and the problems and improvement plans of corporate local income tax are sought through comparison of local income tax system between Korea and foreign countries.
[Findings] The current corporate local income tax is a taxation structure that applies the same tax base section and progressive tax rate system as the national tax. This is a tax structure in which tax burden is made based on the profits of corporations, and does not meet the principle of benefit, which is the basic taxation characteristic of local taxes. In addition, the number of employees and the area of the workplace are applied to the tax revenues of each local government where the corporation is located. Therefore, the tax revenues of each local government are greatly increased according to the number and size of the corporation. In terms of benefits principle and tax universality, it is judged that corporate local income tax is low in tax suitability as local tax.
[Implications] In order to improve the conformity of the principle of benefit and the tax suitability as local taxes, it is necessary to change from the progressive tax rate to the single proportional tax rate and to improve the joint tax method of joint collection and distribution of revenue. The improvement plans proposed in this study are expected to provide useful data for the efficient operation of corporate local income tax and the reorganization of local tax and local financial structure in the future.
