지방세조례주의의 실현과 한계에 관한 법적 검토 (Legal review on the realization and limitations of the principle of local tax ordinance)

초록

이 논문에서는 지방자치의 실질적 구현을 위한 필수적 전제인 자치입법권과 자치재정권에 관한 논의로서 지방세조례주의를 살펴보았다. 구체적으로는 먼저 지방자치단체의 자치권과 지방세조례주의에 관한 우리 법제의 입법 현황과 관련 논의를 검토하고, 지방세조례주의의 허용과 한계에 대해 고찰하였다. 그리고 이러한 검토를 바탕으로 지방자치단체의 책임성과 자율성이 보장될 수 있는 지방세조례주의의 입법적·제도적 실현구조와 과제를 제시하였다.
지방자치단체의 과세자주권은 헌법이 보장하고 있는 자치재정권의 핵심 내용으로서, 우리 법제가 조세법률주의를 원칙으로 하고 조례제정권에 대한 법률유보의 한계를 설정하고 있는 상황 속에서도 과세자주권을 실질적으로 보장할 수 있는 구조가 형성되는 것이 필요하다. 과세자주권 확대를 위한 가장 명확한 방안은 궁극적으로는 헌법과 지방자치법 및 지방세 관계법을 개정하는 것이겠으나, 현재로서는 현행법 체계 내에서 지방세조례주의를 어떠한 정도로 실현할 것인지에 대한 논의와 그것이 보장될 수 있는 구조를 갖추는 것이 현실적으로는 중요하다. 또한 지방자치단체 과세자주권의 확대 논의에 있어서는 지방재정의 건전성과 자기책임성의 확보라는 측면을 고려하는 것이 필요하다.
지방자치단체의 입법절차에의 참여와 중앙정부와의 협력제도 또한 조세법률주의와 법률유보의 한계를 보완할 수 있는 방안이다. 이러한 측면에서 지방 4대 협의체 및 연합체의 입법절차 참여와 중앙지방협력회의의 실질적 운영이 중요하다. 또한 지방재정에 대한 주민의 관심과 참여 또한 중요한 의미를 가지며, 이에 관한 가장 중요한 제도인 주민참여예산제의 한계를 개선하여 지방재정의 투명성을 제고하고 지역현안에 관련된 예산의 편성·운영이 이루어지는 것이 필요하다.

In this paper, the local tax ordinance was examined as a discussion on legislative power and finance right of local government, which are essential prerequisites for the actual realization of local autonomy. Specifically, I first reviewed the current state of legislation and related discussions of our legal system on the autonomy of local governments and the principle of local tax ordinance, and considered the permissibility and limitations of the principle of local tax ordinance. And based on this review, the legislative and institutional realization structure and tasks of local tax ordinances that can guarantee the responsibility and autonomy of local governments are presented.
The right to tax of local governments is the core content of the autonomous finance rights guaranteed by the Constitution, and the structure that can practically guarantee this even in the situation where the principle of our law is based on the principle of tax legalism and limits on legal reservations on the right to enact ordinances is required to be formed. Ultimately, the clearest way to expand tax sovereignty would be to revise the Constitution, Local Autonomy Act, and Local Tax-related Acts, but at present, discussions on how to realize the principle of local tax ordinance within the current legal system and the need to establish a structure that can guarantee it that is important in reality. In addition, in discussing the expansion of the autonomy of taxation of local governments, it is necessary to consider the soundness of local finances and the securing of self-responsibility.
Participation in the legislative process of local governments and cooperation with the central government are also ways to supplement the limitations of tax legalism and legal reservation. In this respect, it is necessary for the four major regional councils and associations to participate in the legislative process and to actually operate the Central Regional Cooperation Council. In addition, the interest and participation of residents in local finance is also important, and it is necessary to improve the transparency of local finance by improving the limits of the participatory budgeting system, which is the most important system in this regard, and to organize and operate budgets related to local issues do.
