선(先)보장을 통한 산재보상보험급여의 실효적 지급방식 검토 – 업무상 질병에 대한 요양급여(2020년 기준)의 선보장을 중심으로 – (Review of Advance Payment Method for Industrial Accident Workers' Compensation Insurance Benefits – On Medical Care Benefits for Occupational Disease (As of 2020) –)

초록

우리나라 헌법은 제34조 제2항에서 국가의 사회보장･사회복지 증진에 노력할 의무를 정하고 있으며, 같은 조 제6항은 국가의 재해예방 및 그 위험으로부터 국민을 보호할 의무를 밝히고 있다. 이 헌법규정들은 국가의 사회보장, 재해예방과 그 위험으로부터 국민을 보호할 의무를 적시하고 있는 관계로, 산업재해보상보험법(이하 ‘산재보험법’이라 한다)상의 산재보험급여의 지급뿐 아니라 그 선(先)지급을 검토할 때도 근거규정이 될 것이다.
여기서는 산재보상보험급여(이하 ‘산재보험급여’라 한다)의 주요 재원으로 사용되고 있는 산업재해보상보험 및 예방기금(이하 ‘산재예방기금’이라 한다)의 운용상 여유를 감안하여, 산재로 추정되는 노동자의 보호문제를 검토하였다. 다만 산재보험급여 전체를 대상으로 하기에는 연구의 범위가 너무 넓다고 판단하였다. 일본의 요양급여 중심의 선보장 사례를 참고하여 요양급여를 중심으로 검토하였다. 이때 업무상 재해 중 산재판정을 받는 소요기간이 길어 산재추정 노동자가 산재보험급여를 지급받지 못한 채 막연한 기대 속에 긴 고통의 시간을 감내해야 하는 업무상 질병으로 인한 요양급여에 집중할 필요가 있다고 보았다. 달리 말해 업무상 질병에 대한 요양급여에 대한 검토가 산재보험급여 운영의 실효성과 관련한 선보장의 예시로 효과적일 수 있다고 보았다.
결론적으로 헌법에서 정하고 있는 국가의 의무를 전제로, 산재보험급여의 운용에 있어서 선보장 방식이 산재추정 노동자의 보호에 실효적임을 검토하였고, 산재보험급여의 종류 중 업무상 질병에 대한 요양급여를 대상으로 이를 확인하고자 하였다.

영어초록

The Korean constitution regulates in Article 34 (2) that the state provides the duty to endeavor to promote social security and welfare of the state. And, (6) of the same article sets forth the obligation of the state to prevent disasters and to protect its citizens from such dangers. Since these constitutional provisions specify the obligations of the state to provide social security, disaster prevention, and protect citizens from such risks, it would be a basis for not only the payment of insurance benefits under the Industrial Accident Compensation Insurance Act, but also the pre-payment of insurance benefits to be covered herein.
In this article, in view of the operational margin of the Industrial Accident Compensation Insurance and Prevention Fund, which is used as the main source of funds for industrial accident workers' compensation insurance benefits, I reviewed the protection problem of workers believed to be industrial accidents through prior guarantee, before being recognized as an industrial accident worker.
However, I judged that the scope of the study was too broad to cover the entire worker's compensation insurance benefits. In light of the Japanese case, the review focused on medical care benefits. At this time, I thought it is necessary to concentrate on occupational disease, in which workers who had to endure a long period of suffering in vague expectations without being paid workers' compensation insurance benefits. In other words, I thought that a review of medical care benefits for occupational diseases may be the most effective example of pre-payment related to the effective operation of workers' compensation insurance benefits.
Base on the obligations of the state stipulated in the Korean constitution, I looked at whether the advance guarantee method in the operation of workers' compensation insurance benefits is effective in protecting workers in which may be estimated industrial accident. I wanted to find out these facts through the pre-payment of medical benefits for occupational diseases among the types of workers' compensation insurance benefits.
