「항공안전법」상 행정처분 제도의 개선에 관한 소고 (Study on the improvement of the administrative measures under 「Aviation Safety Act」)

초록

동 논문은 항공안전에 대한 다양한 정책과 법제화 노력에 발맞추어 안전기준 위반에 관한 제재 수단인 행정처분의 실효성 담보를 통하여 「항공안전법」상 행정처분제도의 집행에 있어 명확성과 형평성을 향상시키기 위한 처분제도에 있어 가중감경 기준안 마련에 관하여 다루고 있다. 항공 안전의 위반에 관한 행정처분에 관한 가중감경 여부는 타 제도와 마찬가지로 행정청의 재량에 속하는 행정행위로 그 처분 기준과 적용 여부는 다양한 요인 등을 고려하여 결정되는 부분이다. 하지만, 이러한 행정청의 재량행위에 대하여 법제도와 같은 구체적인 기준 명시를 통한 제도화가 법적 안정성과 형평성 차원에서 필요하다고도 볼 수 있다. 행정처분제도란 의무 이행 담보를 위하여 직접적 혹은 간접적 제재수단을 부과하는 것으로 행정청의 재량행위라고 볼 수도 있으나, 하나의 제도로 운영되는 만큼 보다 명확한 기준에 따라 적용되어야 하는 것이 중요하기 때문이다. 아울러 이행을 위하여 부과되는 제재인 만큼 그 실효성 확보 차원에서 행위와 처분의 적절성 또한 제도상의 형평성의 측면뿐만 아니라 수범자의 입장에서 능동적으로 준수의무를 가지게 된다는 면을 고려할 때 이러한 부분은 신중하게 고려되어야 할 것이라고 보여 진다.
현행 「항공안전법」은 분법화를 통하여 그 목적과 세부 내용이 간결하여 그 운영과 적용에 있어 간명하게 재구조화 되었다는 점에서 그 효율성이 증진되었다고 평가할 수 있다. 하지만, 행정처분의 경우에는 여전히 구 항공법과 동일하게 규정되어 있기에 기존에 제기되어 왔던 그 적용과 가중감경 기준에 대한 사안별 적용 여부 등에 있어서는 여전히 개선이 필요한 부분이라 할 수 있다. 안전기준 준수는 사고를 미연에 방지하고, 큰 사고를 예방한다는 점에서 중요하며, 사고 유무와 직접적으로 관계가 없을지라도 준수해야 하는 의무라 볼 수 있으나, 그 위반에 따른 제재와 가중ㆍ감경여부는 보다 형평에 맞게 부과되는 것이 실효성 측면에서도 의미가 크기 때문이다.
이는 의무 위반에 따른 제재를 과하는 행정처분에 있어 관리ㆍ감독에 있어서의 효율성과 준수에 있어 경중에 따른 자발성과 중요성 판단을 위한 명확한 제도와 적용은 반드시 전제되어야 할 부분이다. 따라서 본고에서 논의한 행정처분 가중감경기준으로 제안된 사안별 유형은 처분의 객관적인 기준으로 그 역할을 할 뿐만 아니라 향후 안전사고 예방을 위해 적용될 행정처분에 있어 보다 명확하고, 체계적인 제도로 작용할 수 있으리라고 본다. 수범자의 제도에 관한 분명한 이해와 자발적 준수 행위를 도모하는 것은 불필요한 행정력의 집행을 방지하고, 행정청의 처분에 대한 적극적 이행으로 연결될 수 있기에 우리 항공안전법의 취지와 같이 항공안전 확보라는 목적 달성에 긍정적으로 역할을 하게 될 것이기 때문이다.

영어초록

This paper addresses the need to establish criteria for aggravation and mitigation in the system concerning dispositions designed to enhance clarity and equity in the execution of the system of administrative measures stipulated in the 「Aviation Safety Act」 by securing efficient administrative measures as a means of imposing sanctions against violations of safety standards, in step with the diverse aviation safety-related policies and legislative efforts made by the government. As in other systems, whether there is a need for aggravation and mitigation concerning administrative measures related to violations of aviation safety falls within an administrative agency’s discretion, so the criteria of dispositions and applications should be decided in consideration of diverse factors.
However, it can be said that, with regard to such an act of discretion by an administrative agency, it is necessary to institutionalize it by providing specific criteria such as laws and systems from the perspective of legal stability and equity. That is because it is important to apply the system of administrative measures based on definite criteria, as in other systems, although it can be viewed as an act of discretion on the part of an administrative agency to impose a direct/indirect means of sanction to ensure the fulfillment of certain obligations. It is thought that such a matter should be considered discreetly, given that the parties to whom such a measure applies are obligated to observe it, and given that it entails factors to be considered in terms of the propriety of acts and dispositions and the equity of the system in connection with the need to secure its efficacy as a sanction.
It can be said that the efficiency of the current 「Aviation Safety Act」 has been enhanced in that its operation and application have been segmented and restructured in a way that has simplified its purpose and detailed contents. However, as regards the administrative measures, they are stipulated in the current 「Aviation Safety Act」 just as they were in the old 「Aviation Act」, and thus it can be said that it is still necessary to make an improvement concerning their application and the application of the criteria for aggravation and mitigation in individual cases, as discussed previously. The strict observance of safety standards is important to the prevention of accidents - particularly serious accidents - and safety standards must be observed regardless of their direct relevance to accidents, but sanctions imposed on violations and aggravation and mitigation should be adequate in terms of equity in consideration of their efficacy.
As regards the administrative measures taken as sanctions against defaults on obligations, clear-cut systems and their adequate application to decide spontaneity and importance according to the seriousness of the matter in terms of observance and efficiency in their management/supervision are prerequisites. It is thought that types of cases proposed as criteria for aggravation and mitigation of administrative measures discussed in this paper will serve as the objective criteria for dispositions and as a more clear-cut and systematic system of administrative measures to be applied for the prevention of safety accidents. It will prevent the unnecessary exercise of administrative power and lead to positive execution of dispositions taken by an administrative agency in order to try to gain a clear-cut understanding and seek a voluntary act of observance concerning the system in which a law applies to the relevant parties, and such will play a positive role in attaining the objective of aviation safety stipulated in the country’s 「Aviation Safety Act」.
