현행 헌법상 권력구조의 문제점 (A Study on the Problem of Political Power Structure under the Current Constitution)

초록

미국의 대통령제가 그 제도적 결함에도 불구하고 200년이 넘게 미국의 정치제도를 대표하고 있는 이유는, 오로지 미국만의 고유한 그 인적·물적 조건의 결과가 아닐 수 없다. 정치적 자유주의의 기초로서의 종교, 내향적인 지방주의, 정치적 이데올로기의 동질성, 지방분권적 정당, 그리고 앵글로 색슨적 정치적 우수성 등과 같은 것이 바로 미국 대통령제의 운용에 있어서의 그 성공적인 기초가 아닐 수 없다. 따라서 미국과 같은 이러한 정치적․사회적 여건이 결여될 때에는, 대통령제는 고유한 기능을 발휘할 수 없거나, 또는 중․남미와 아시아․아프리카에서와 같은 행정권의 절대우위의 변형된 대통령제로 변질되게 된다. 그럼에도 불구하고 오늘날 이러한 대통령제에로의 경향이 범세계적으로 확대되고 있다.
대통령 직선제의 부활, 5년 단임제, 대통령의 국회해산권 폐지, 국정감사권과 지방자치의 부활로 요약되는 1987년 현행 헌법체제에 대한 정치권의 성찰의 목소리가 커지고 있다. 제왕적 대통령제의 폐해를 극복하고 통치불능 상태를 해소하려는 논의가 정치권에서 활발히 진행되고 있는 것이다. 개헌에 대한 여․야 의원들의 관심이 커지고 있는 것은 최근의 정치상황과도 무관하지 않다. 정권이 바뀌어도 여야의 첨예한 대립 구조는 전혀 바뀌지 않는 정치 현실을 어떻게 극복할 것인가라는 문제의식이 개헌을 통한 권력구조 개편 논의의 확산으로 이어지고 있다는 분석이다. 여․야 강경파가 주도하는 강대강 대치정국에 지친 중도파 의원들 사이에서 개헌 목소리가 힘을 얻는 것도 이런 흐름을 반영한다.
이번에 일고 있는 개헌논의의 윤곽은 어느 정도 잡혀있다고 할 수 있다. 대통령 개인에게 집중되어 있는 ‘만기총람(萬機總攬)’식의 ‘제왕적 대통령제’의 문제를 이념이 아닌, 실사구시적으로 접근하여 그 제도적인 해결방법을 모색하는 것이다. 미국식 대통령제가 공통적으로 지니고 있는 가장 기본적인 문제는 대통령과 국회 사이에 어떻게 ‘견제와 균형’을 유지하느냐 이며, 이는 대통령은 강력한 권한을 가지면서도 전제적이어서는 안 된다는 요구를 어떻게 실현하느냐의 문제이다. 따라서 이번 개헌논의에 있어서 결코 빠뜨려서는 안 될 부분이 바로 하부구조인 정치문화의 개선을 함께 추구해야 하는 점이다. 정부형태가 순기능하기 위해서는 그 하부구조인 정치문화의 개선을 추구하는 것이 중요한 과제이다. 특히 우리나라 정치문화의 고질적 병폐는 유교 전통에 기초를 둔 권위주의적 행태, 정당정치의 불안정성, 흑백논리에 따른 타협에 대한 부정적 시각, 지역주의에 따른 극한적 대립, 부당하고 불법적인 떼 법 등에 있는데, 이를 극복하는 것이 입헌주의가 순기능하기 위한 근본적 과제이다. 특히 정당제도, 선거제도의 개선 없이는 불가능하다고 생각한다. 앞에서 본 유일한 성공모델인 미국의 사례는 우리에게 많은 시사점을 주고 있다.

A voice of concern and self-examination has been raised over the existing Constitution of 1987, the focal points of which consist of the revival of the direct election system for presidency, the single term system for presidency for five years, the abolition of presidential power to dissolve the General Assembly, the revival of the investigative power of the General Assembly, and the revival of local self-governments. For example, there have been very active political discussions to overcome the abusiveness of imperial presidentship and to put the current out-of-control governing system back in order. The growing interest in constitutional amendment among the members of the National Assembly from both the ruling and opposition parties has a lot to do with the current political atmosphere. Unfortunately, a change in political regime has not led to the reduction of the acute political power struggles between ruling and opposition parties. A serious concern over the methods as to how to overcome this kind of political problem has resulted in the recent discussion for reformation and revision of power structure through constitutional amendments. A group of moderate congressmen who are tired of zero-sum confrontational political situation controlled by a group of extreme hardline congressmen from the ruling and opposition parties have raised their voices for constitutional amendment which reflects the current needs for political reformation discussed above.
It seems that the overall framework for constitutional amendment has been set up to some extent. For instance, a problem of imperial presidentship in which a president has to control and manage all of the governing aspects will be attempted to be solved structurally by taking an approach to reach the truth through fact-finding rather than following political ideologies. The most common fundamental problem in the presidentship in the U.S. is how to maintain the ‘check and balance’ of powers between the president and Congress. In other words, this is a matter of how not to become imperial or dictatorial for the U.S. presidents while maintaining powerful control over the government. Accordingly, one of the important points for discussion on the constitutional amendment in Korea is to pursue the improvement of political cultures at the same time. In order for the government to function rightfully, it is so much important to pursue the improvement of political cultures which make up the infrastructure of government. Especially, the chronic vice of the political cultures in Korea is based on the following traditions: authoritarian conducts based on Confucian tradition; the unstability of politics of political parties; negative views on compromise due to the black-and-white reasoning; the extreme confrontation based on regionalism; and unreasonable and stubborn demands based on illegal cause. In order to make constitutionalism function adequately, overcoming these kinds of problems is a fundamental challenge. Especially, the improvement on political party system and electoral system must be revised to do so. The precedent examples of the U.S. which is the only successful model seems to provide Korea with a lot of points to learn. With the prospects of achieving the unification of Korea and the national per capita income of $40,000, multi-layered and complex approaches are necessary.
