범죄예방과 수사에 있어서 빅데이터 활용과 한계에 관한 연구 (Study on the Application and Legal Limits of Big Data for Crime Prevention and Investigation)

초록

수사의 일반원칙상 강제처분은 법률상 근거가 있어야 하나, 빅데이터 분석은 우리 형사소송법이 예정하고 있지 않은 새로운 형태의 수사방법으로 보아야 한다. 급격한 과학기술의 발달로 인하여 형사소송법이 예상하지 못한 수사방법도 기존의 법체계안에 포함하여 탄력적으로 운영할 현실적 필요성이 있다. 빅데이터 분석은 전통적인 수사방법과는 명백히 다른 의미를 갖는 만큼 빅데이터 분석행위에 대한 법적 성격을 규명해볼 필요가 있다.
국가기관이 보유하고 있는 데이터베이스를 활용하고, 분석하는 행위가 기본권을 침해하는 행위에 해당된다면 법률유보의 원칙이나 강제처분 법정주의에 따라 법적근거가 필요하겠지만, 기본권 침해행위로 볼 수 없다면, 별도의 법적 근거 없이 경찰활동의 하나로서 가능하다는 결론에 도달할 수 있다. 데이터베이스를 활용해 빅데이터 분석 시스템을 설계 운영하는 것은 현재의 범죄 수사 목적이 아닌 미래의 범죄 수사를위해 그 단서정보를 분석하는 행위로서 내사나 수사와는 구별되는 경찰법상의 정보수집활동에 해당된다고 보아야 한다. 따라서 데이터베이스 구축행위의 적법성 판단은 형사소송법상 규정이나 일반원칙이 아닌 경찰법상의 규정과 일반원칙이 적용된다.
빅데이터 분석 시스템은 국가기관이 정당하게 보유하고 있는 데이터베이스를 대상으로 시스템 구축이 이루어져야 하며, 데이터 분석을 위한 원자료의 활용도 실정법에 위배되면 안된다. 범죄예방과 범죄수사에 있어서 빅데이터 활용하기 위해서는 국가기관간 데이터베이스가 상호 연동되어야 하며, 이를 위해서는 별도의 법적 근거를 마련할 필요가 있다.

영어초록

The big data is used not only in the industry but also in the scope of social safety, welfare, national economy, national infrastructure, and science & technology. Though it is on the initial state, it is also used for the crime prevention and criminal investigation in the criminal laws. The cases of using the big data in US, UK, Germany and Singapore have also been introduced in the government reports. The study on the good functions and negative functions of the big data was made by researching the overseas cases in terms of how to use the big data, and its effect, legal ground and system.
The use of big data to solve the criminal cases which occurred is a part of the investigation activities and in this process, the general principle of the investigation is applied. The forceful disposition needs the legal ground under the general principle of investigation. But, the analysis of big data should be considered to be the new type of investigation as our criminal procedure act does not describe it.
It is necessary to flexibly operate the investigation method which has not been expected by the current Criminal Procedure Act due to the rapid development of the scientific technology. But, as it has the clearly different meaning from the traditional investigation method, the study was conducted under what proper investigation method it should be carried out.
Though the analysis of bid data is said to be the possible investigation method under the current laws, it is another to decide if the data generated from the analysis of big data can be used as the evidence. It shall be judged from the general principle under the laws related to the evidence. Accordingly, even though the evidence submitted though the analysis of big data is not the legal evidence, it was studied as to whether it can be used as the evidence in the court if it is legally collected. The study on the criminal policy was also conducted as to under which circumstance it should be recognized to have the capability of evidence.
