농지 객토재로 골재부산물의 활용방안에 관한 법적 고찰 (Legal Study on Utilization Method of Aggregate Byproducts as Soil Addition Material for Farmland)

초록

무기성 폐기물로서 매립 또는 야적되는 골재부산물은 2013년 한해만 1,660만m³ 이상으로 추정된다. 하지만 농림수산식품부 연구보고서(2008)에 의하면, 골재부산물에는 중금속이 전혀 문제되지 않을 뿐만 아니라 화학물질 함유량이 토양환경보전법의 ‘토양오염우려기준’ 이하로 사람의 건강이나 주변환경에 위해가 없다고 한다. 또한 탈수·건조된 골재부산물은 그 물리적 특성상 1차 광물로서 자연토양과 유사하다고 한다. 이점을 고려할 때, 최소한 국가가 지정한 채석단지 또는 골재채취단지 내 비금속광물분쇄시설이나 토사세척시설에서 발생하는 무기성 오니는 폐기물관리법의 적용대상에서 제외하는 것이 타당하다. 한편 농지의 객토재·성토재 등으로 골재부산물의 사용에 관한 엄격한 규제는 건전한 물질순환의 고리가 차단되는 현상을 초래하게 된다. 이와 같은 현실은 환경부하의 증대, 최종적인 폐기물 처리장소의 부족, 자원의 새로운 이용기회의 상실 등의 결과를 낳게 된다. 그리고 골재부산물의 평균 유효수분함량은 2.71%로 모래의 5.1% 보다 적으므로, 물이 잘 빠지지 않는 중점토(重粘土) 및 퇴화점토(退化粘土)의 객토재로 활용이 가능하다. 따라서 사람의 건강이나 주변환경에 위해가 없는 골재부산물을 별도의 신고 없이 농지의 객토재·성토재로 활용할 수 있도록 폐기물관련법을 개정하는 것이 바람직하다고 할 것이다.

영어초록

Aggregate byproducts landfilled or stored in the open as inorganic wastes are estimated to be more than 16.6 million m³ for just one year of 2013. However, according to a research report of the Ministry of Agriculture, Food and Rural Affairs (2008), aggregate byproducts do not have any problems caused by heavy metal at all, and the content of chemical substances in aggregate byproducts is less than the soil contamination standards specified in the Soil Environment Conservation Act, affecting no injury to human health or surrounding environment. In addition, it is noted that dehydrated and dried aggregate byproducts are classified as primary mineral, similar to natural soil in terms of their physical characteristics. When considering this, it is appropriate to exclude at least inorganic sludge produced from non-metallic mineral crushing facilities or earth/sand washing facilities in a quarry complex or an aggregate collecting complex designated by the country from applicable objects of the Waste Control Act. On the other hand, strict regulations on use of aggregate byproducts as soil addition material or earth-up material, etc. for farmland cause a phenomenon that the link of a virtuous circle of material is blocked. The realities like this bring forth such results as increase of environmental load, lack of final waste disposal places, loss of opportunities for the recycling of resources, etc. Also, average effective moisture content of aggregate byproducts is 2.71%, less than 5.1% of sand, so it is possible to utilize aggregate byproducts as soil addition material for heavy clay and degraded clay which drain badly. Therefore, it is desirable to revise waste related laws so that aggregate byproducts not injurious to human health or surrounding environment may be utilized as soil addition material or earth-up material for farmland without having to report separately.
