환유로서 법해석, 은유로서 정의 (Legal Interpretation as Metonymy, Justice as Metaphor)

초록

이 논문은 법해석의 배후에 대한 철학적 탐구로서 라캉의 정신분석학이론의 적용을 시도한다. 라캉은 프로이트의 무의식 이론에 야콥슨의 구조주의적 언어철학을 응용하여 자신의 정신분석학이론을 무의식도 하나의 언어처럼 구조화되어 있다는 명제로 압축하였다. 이 무의식에 대한 언어적 해석은 상징적 거세로 생성된 결핍이 오히려 욕망이라는 삶의 동력으로 작용하는 인간 주체에 관하여 논한 것이다. 그 해석에 활용된 은유와 환유라는 수사학 용어가 지닌 범용성 덕분에, 법학이 언어철학과 문학이론의 사유를 거쳐 정신분석학의 통찰로부터 힘입을 수 있는 계기가 마련되었다.
이성법언어를 통해 형성된 법해석의 주체는 정의를 욕망하기 시작한다. 주체는 보편적인 법과 개별사안 사이에서 의미를 지니는 정의의 충만함을 향해 욕망이 담긴 법언어들을 나열한다. 하지만 이러한 법해석만으로 정의가 실현되지 못한다. 법언어의 의미가 명확하지 않으며 정의를 담기에 부적절하기 때문이다. 오히려 법언어의 나열을 통해 그 궤적을 되돌아보고 성찰하며 이러한 법해석을 통해 정의에 도달하는 것에 회의를 품기 시작할 때야말로 법이 해체되는 순간이자 의미를 창조하는 은유의 찰나이다. 이는 법의 체계내적 또는 자기준거적인 형태의 정의 실현이 아니다. 오히려 법 외부에 준거를 두고 법에서 미끄러짐으로써 법 밖에서 법의 총체적인 모습을 보아야만 기존 법을 해체하고 미래의 법을 꿈꿀 수 있는 것이다.
근대법의 자기성찰은 법해석을 환유로 볼 때, 다시 말해 법해석의 결과물들을 정의가 아니라 정의를 좇는 과정에서 치환된 형성물로 보고 그 형성물들을 소급적으로 의식화함으로써 이성법언어가 무엇을 억압하고 검열했는지 성찰할 때, 시적 정의의 실현까지 가능하다.

영어초록

This article is trying to understand the interpretation of the law based on the Lacanian psychoanalytical theory. Jacques Lacan summed up his theory in the proposition that the unconsciousness “is structured like a language” through re-reading the Freudian theory on the unconsciousness with Roman Jakobson’s structural linguistics. It is that the linguistic interpretation on the unconsciousness tries to point out that the deficiencies generated by means of symbolic castration paradoxically works as driving forces of life, that is, desire of the human subject. It is by virtue of the versatility of metaphor and metonymy employed on that interpretation, that law can owe the psychoanalytical insight through connections among philosophy of language, literary theory and psychoanalysis made by Jakobson and Lacan.
The subject who interpretates the law formed through the language of rational modern law starts to desire to realize justice. The subject arrays the legal languages filled with desire to fully satisfy the justice which signify itself between universality of law and singularity of particular cases. However, the justice cannot be satisfied solely through that kind of legal interpretation due to uncertainty of legal signifier to indicate the signified and inappropriateness to bear justice. Rather by reflecting on the trajectory of the array of legal signifers appeared and becoming skeptical about the current justice which the language of rational modern law seeks to approach, the subject can deconstruct the law and receive metaphoric instant that creates sense from non-sense. This kind of justice, the deconstruction of law, is neither a inter- systemic realization of justice nor a self-referential one. Rather by sliding from the law, predicating from the outside of the law, and seeing the totality of the law which is possible only at the exteriority of the law, the subject can deconstruct the current law and wait for the advent of the suspended future law.
It is only possible for the modern law to reflect on itself by regarding legal interpretation as metonymy. In other words, the subject should consider results of the interpretation of the law not as outcome of justice, but as formations displaced on the process of seeking justice, like formations of the unconsciousness generated by repression of the consciousness, and contemplate on what the language of the rational modern law has repressed and censored, through conscientization those formations retroactively which can be lead to realization of the poetic justice.
