공직선거법과 군소정당의 관계 (The Relation of POEA and Minor Party)

초록

양당제가 자리잡고 있는 한국의 정치상황에서 군소정당의 의회진출은 매우 어려운 상황에 직면하고 있다. 한국의 정치제도는 군소정당의 의회진출을 막 는 장애물이 되고 있다. 그 중에서도 특히 공직선거법은 구조적으로 기득권 보호에 유리하며, 군소정당과 신진 정치인의 등장을 방해하고 있다. 법은 어렵고 해석의 여지가 넓어 선관위나 법원의 판단이 위법여부를 가리 는 중요한 척도가 된다. 그런데 선관위와 법원의 해석은 주로 기득권을 가진 거대정당과 현역 정치인에게 유리한 방향에서 이루어지게 된다. 또한 규제일 변도의 현행 공직선거법은 민주주의의 활발한 성장까지 막고 있다. 선거운동 은 통상의 정치활동보다 더욱 다양하고 활발하게 벌어지는 것이 상식이다. 하 지만 공직선거법의 지나치게 많은 제한규정은 선거운동을 통상적 정치활동보 다 어렵게 만들고 있다. 개별 규정을 살펴보더라도 공직선거법은 군소정당에게 불리한 내용을 담고 있다. 대표적인 사례 몇 가지를 살펴보자. 비례선거 후보들은 공개장소에서의 연설이나 대담을 할 수 없도록 되어 있다. 재정과 인력이 열악하고, 정치적 영 향력이 크지 않아 언론이 잘 다루지 않는 군소정당의 후보들이 자신과 소속정 당을 홍보할 수 있는 기회가 제한된다. 후보출마자에게 부과되는 기탁금은 그 액수가 과도하여 군소정당과 신진정치인의 의회진출을 막는 진입장벽의 역할 을 하고 있다. 승자독식을 강요하는 소선거구제는 군소정당에 대한 지지를 쓸모없는 것으 로 만든다. 가치와 정책중심의 정당정치는 실종되고, 유권자의 지지는 왜곡된 다. 대통령을 비롯한 주요 공직선거에 결선투표제를 두지 않고 있는 것도 문 제다. 당선가능성이 가장 큰 관심사가 되면서 유권자는 최선의 선택을 할 기 회를 박탈당한다. 이런 문제들은 군소정당을 지지하는 유권자가 도대체 얼마 나 있는지를 알 수 없게 만듦으로써 군소정당의 존재감을 희석시킨다. 근본적인 문제해결을 위해서는 개헌까지도 필요하겠지만, 현행의 법제 아 래서도 군소정당의 문제는 대부분 해결될 수 있다. 다양한 정치세력의 경합을 통해 민주주의가 보다 풍성해질 수 있다. 이를 위해서 군소정당의 정치활동이 보장될 수 있도록 제도의 개선이 필요하다.

It is extremely difficult for minor parties to launch into politics under the circumstances of the two-party system has settled in Korea. The political system of Korea is still the obstacle to the minor parties trying to enter the National Assembly. In particular, the Public Official Election Act (POEA) is the one of the main obstacles because it is structurally favorable to the establishment. Also, it is the barrier to the entry of new politicians. The judgment from the court or Election Commission is the key of the illegality determination because there are numerous possibilities of its interpretation. The problem is that most of the decisions from the court and Election Commission are made in favor of the major parties and incumbent politicians. In addition, too many restrictions to the election campaign from the POEA prevent democracy from flourishing because an election campaign is supposed to be more various and active than a normal political activity. Each regulation from POEA is also disadvantageous to minor parties. For example, proportional representation candidates are not allowed to make a speech and conversation in a public place and, therefore, a minor party has few opportunities to promote itself. This occurs due to the fact that a minor party is not frequently covered by the media due to the weak political leverage. Besides, the excessive amount of trust money is also one of the obstacles to minor parties and entry of new politicians. The single-member district system which imposes the 'winner takes all' rule makes the support given to minor party useless. In The Relation of POEA and Minor Party / Yoon, Hyunsik214 these circumstances, the policy- and value-based party politics is missing and the support of voters is distorted. What is also problematic is that there is no runoff system in the main election for public office, including the presidential election. It means that the possibility of winning the election becomes the main concern. Therefore, it takes away from the voters the opportunity to make their best choice. Consequently, the existence of minor parties becomes faint, as it is difficult to establish how many people support a minor party. It is difficult to solve this fundamental problem by the rearrangement of the current regulations. The problem of political system is eventually related to the issues of the Constitution. However, it is still possible to solve these problems in the current constitutional system. The competition of various political power groups strengthens democracy. For this purpose, the improvement of the system that would guarantee the political activities of minor parties is necessary.
