초록

21대 국회에서 2021년 12월 16일 발의된 장애인체육지원법안(도종환의원등 18인 발의 의안번호 2113921호)와 2021년 12월 10일 발의된 장애인체육진흥법안(이종성의원 등 10인, 의안번호 2113842호)는 21대 국회 임기만료로 폐기되었다. 무엇보다 장애인에게 체육활동은 신체적, 심리적 건강을 증진 시킬 뿐만 아니라 장애인과 비장애인이 함께하는 사회통합 기능도 가지고 있는 등 장애인의 삶 전반에 긍정적인 영향을 미치고 있다. 이처럼 장애인체육의 중요성이 증대되고 있음에도 비장애인 체육에 비해 지원은 여전히 열악하고, 장애인이 이용할 수 있는 시설 역시 부족하다. 더군다나 장애인체육의 법적 근거가 현재로서는 「국민체육진흥법」에 선언적 규정에 불과하여 장애인 생활체육 참여율이 상당히 저조할 수밖에 없다.
이에 본 논문에서는 문제의 제기로 장애인체육의 일관적이고 체계적 추진을 어렵게 하는 장애인체육기본계획의 부재, 장애인스포츠시설이용의 한계, 장애인스포츠용품의 안전성 문제, 장애인스포츠지도자 활용의 문제를 살펴본다.
다음으로 각국의 법령현황에서 패럴림픽에서 좋은 점수를 내고 있는 국가 미국을 비롯하여 포용정책의 독일, 일본, 북유럽국가, 중국, 프랑스와 영국을 검토한다.
장애인체육의 지속적이고 체계적인 보완 등을 통해 장애인과 비장애인간의 통합을 위해서 법적 근거가 마련되기를 바라며 「국민체육진흥법」개정이든 장애인체육의 별도 입법이든 22대 국회에서 재논의를 기대하며 우리사회가 한단계 더 통합사회로 나가길 기대한다.

영어초록

In the 21st National Assembly, the Sports Support for Persons with Disabilities Act (bill number 2113921, proposed by 18 members, including Rep. Do Jong-hwan) and the Sports Promotion Act for the Disabled, proposed on December 10, 2021 (bill number 2113921, proposed by 10 representatives, including Rep. Jong-seong Lee) No. 2113842) was abolished with the expiration of the term of the 21st National Assembly. Above all, for people with disabilities, physical activity not only improves their physical and psychological health, but also has a positive impact on the overall lives of people with disabilities, as it has the function of social integration between disabled and non-disabled people. Although the importance of sports for the disabled is increasing, support for sports for the non-disabled is still poor, and facilities available to the disabled are also lacking. Furthermore, the legal basis for sports for the disabled is currently only a declarative provision in the National Sports Promotion Act, so the participation rate in sports for the disabled is bound to be quite low.
Accordingly, in this paper, we examine the absence of a basic plan for sports for the disabled, which makes it difficult to consistently and systematically promote sports for the disabled, limitations in the use of sports facilities for the disabled, safety issues with sports equipment for the disabled, and the use of sports instructors for the disabled.
Next, we review the status of each country's laws and regulations, including the United States, a country that is scoring well in the Paralympic Games, as well as Germany, Japan, Nordic countries, China, France, and the United Kingdom with inclusive policies.
We hope that a legal basis will be established for the integration of people with disabilities and non-disabled people through continuous and systematic supplementation of sports for the disabled, and we look forward to re-discussions in the 22nd National Assembly, whether it is revision of the National Sports Promotion Act or separate legislation on sports for the disabled, and we hope that our society will take a step forward. I look forward to moving towards a more integrated society.
