자율주행자동차의 상용화를 위한 행정법적 쟁점 ― 미국의 이론과 법제도를 중심으로 ― (Administrative Legal Issues for the Commercialization of Autonomous Vehicles — Focusing on the Theory and Legislation of the United States —)

초록

오늘날 자동차산업은 급속한 기술적 발전을 이루고 있다. 자율주행자동차의 시험운행이 진행되고 있는 한편 GPS 등 정보통신기기를 통해 제공된 정보를 바탕으로 운행경로를 설정할 수 있는 자동차는 이미 대중화되었다. 자율주행자동차는 사람인 운전자가 야기할 수 있는 부주의, 졸음으로 인한 사고, 과속운전이나 부적절한 끼어들기로 인한 사고 등의 위험을 제거하고 예정된 프로그램에 따라 정확하게 운행할 수 있다는 점에서 도로상의 안전성을 높일 수 있다고 예측된다. 또한 그동안 자동차의 운전이 불가능했던 사람들이 자율주행자동차를 통해 홀로 이동이 가능하다는 점, 자율주행기능을 통해 다수인의 공동이용이 가능하므로 경제적, 환경적 비용을 절감할 수 있다는 점 등 다양한 유용성을 가진다. 그러나 자율주행자동차가 상용화되어 사람인 운전자의 조작으로 운행되는 자동차와 동일한 도로 위를 동시에 주행하게 되는 경우 비상상황에서의 안전성에 대하여는 아직 확신할 수 없다. 또한 자율주행자동차의 운행에는 인접 자동차들과의 정보교류가 필수적이라는 점에 비추어 볼 때 자율주행자동차로부터 발생되는 수많은 정보자료들의 이용과 관련하여 프라이버시의 보호문제도 야기될 수 있다. 이 논문은 이러한 문제인식 하에서 미국에서의 논의를 중심으로 자율주행자동차의 상용화에 대비하여 필수적으로 요구되는 규범적 내용을 살펴보고 현재의 우리 법제도 하에서 이러한 내용들이 어떻게 반영되어야 할 것인지를 검토해보고자 하였다.
먼저, 자율주행자동차의 안전을 위한 규제적 측면에서 자율주행자동차에 대한 규제권한의 문제가 제기된다. 미국의 경우 자동차의 설계 및 작동에 관한 규제권한은 연방정부가 가지는 반면 운전면허와 도로에서의 차량운행에 대한 규제권한은 주정부가 가진다. 그런데 자율주행자동차는 차량의 설계에 운행시스템이 유기적으로 결합되어 양자의 통합적 규제가 요구된다는 점에서 새로운 규제시스템 필요하다. 우리 법제 역시 차량의 안전성에 대한 규제와 운전자에 대한 면허제도가 별개로 이루어지고 있는데 이제 여기에 자율주행시스템에 대한 규제를 통합하여야 한다. 또한 자율주행자동차의 안전기준은 실행가능하고 자동차 안전에 필수적이며 객관적 용어로 규정되어야 하는데 이는 자동차 및 자동차 부품의 제조자에 대해 안전성을 달성할 수 있는 특정한 방법을 요구하는 기술기준이 아니라 달성해야 하는 안전성을 요구하는 성과기준을 의미한다. 다음으로 정보의 수집 및 이용과 관련하여 프라이버시권에 대한 침해의 문제가 제기될 수 있으며 이는 (1) 정부가 개인정보에 접근하고 이를 이용하는 문제와 (2) 개인정보를 상업적으로 이용하는 문제로 구분하여 볼 수 있다. 미의회는 자율주행자동차 이용자의 프라이버시 보호를 위한 법안을 마련하기 위해 노력하고 있으나 아직 구체적인 법제적 틀은 마련되지 않고 있다.
우리나라는 현재까지 「자동차관리법」을 중심으로 자율주행자동차의 시험운행이 가능하도록 지원하는 범위에서 규율이 이루어지고 있다. 그러나 이제 자율주행자동차의 상용화에 대비하여 도로 위에서의 운행을 위한 전반적인 규율의 틀이 마련되어야 한다. 이 과정에서 의회와 정부로서는 지속적인 연구와 함께 자동차 업계, 소비자, 학계와의 협력이 필수적으로 요구될 것이다. 우리 사회가 자율주행자동차의 유용성을 온전히 활용하기 위하여는 안전성을 확보할 수 있는 객관적이고 실용적인 안전기준의 마련이 무엇보다 중요하다. 이러한 안전기준은 정부의 규제 기준이 됨과 동시에 자동차 업계가 이루어야 할 기술개발의 방향이 될 수 있을 것이다.

영어초록

Today, automotive industry is evolving rapidly on technological innovation. Trials for autonomous vehicles are underway and vehicles equipped with GPS have already become popular. Automated driving is expected to improve road safety by eliminating human driver error(inattention, sleepiness, overspeed or improper intervention) and operating correctly according to the program. Additionally, autonomous vehicle technology could allow people currently unable to drive(such as the elderly, and people with disabilities) to travel alone in autonomous vehicles. Driverless cars also reduces the overall number of cars on the road, as well as unnecessary overlapping trips that contribute to emissions.
However, no one can assure the safety of roads when both ‘autonomous vehicles’ and ‘automobiles operated by human drivers’ run on the same road. Furthermore, data privacy is significant areas of concern arising from autonomous vehicles. These apprehensions stem from the knowledge that self-driving vehicles will rely on some combination of Internet-based communication systems to operate the vehicles without the control of a human driver.
This paper examines the normative contents required for commercialization of autonomous vehicles, focusing on the theory and legal system in the United States. First, there is a problem of regulatory authority for autonomous vehicles. In the United States, the federal government has the authority to regulate the design and operation of vehicles, while states create traffic codes that set standards for vehicle operation and the licensure of drivers to regulate vehicle safety. However, it is required a new regulatory system to treat autonomous vehicle because the design and the operating system of the vehicle are integrated together. We also need to consider integrated regulations on autonomous vehicles. Secondly, the standards for autonomous vehicles are required to be practicable, objective, and meet the need for safety. It must be performance-oriented. Lastly, There is a question of infringement of the right to privacy in relation to the collection and use of information. This can be divided into (1) the government's access to and use of personal information, and (2) the use of personal information for commercial purposes. Presently, the United States has no specific legislation on this question.
In Korea, the autonomous vehicle regulation has been implemented within the scope of supporting the test operation of autonomous vehicles based on the “Automobile Management Act”. However, in order to regulate commercialized autonomous vehicles, an overall regulatory framework for the operation of such vehicles on the road should be established. In this process, Congress and the government should conduct intensive and comprehensive research on autonomous vehicles. In addition, cooperation with the automobile industry, consumers, and academia should be made. In order to fully enjoy the benefits of autonomous vehicles, it is important to establish objective and practical safety standards to ensure their safety. These safety standards can provide direction for the development of the technology that the automotive industry has to achieve.
