자동차 레몬법 중재 연구 (A Study of Automobile Lemon Law Arbitration)

초록

오늘날 자동차는 개인에게 중요한 생활수단이며 재산이고 또한 상당한 위험성을 내포한물건으로 매우 많고 다양한 분쟁의 대상이기도 하다. 이러한 자동차의 특성에 비추어 볼때 자동차의 안전성을 포함한 절적한 품질의 확보라는 소비자의 이익 보호가 중요하다. 자동차 소비자의 이익은 계약법이나 특별법에 의한 법정 품질보증 제도에 의하여 보호되고또한 특히 안전관련 이익은 리콜제도나 제조물책임법 등에 의하여 확보된다.
한국에 레몬법중재와 같은 자동차 교환․환불 분쟁해결제도가 도입되기 위해서는 먼저, 미국의 ‘연방보증(레몬)법이나 EU의 ‘소비재매매와 관련 보증 지침’과 같은, 일반 소비재의교환․환불법, 즉 레몬법의 입법이 시급하다. 소비자 보호를 위하여 개선되어온 많은 외국입법례에도 불구하고 현재 한국의 민법이나 소비자기본법 등의 개정 움직임은 거의 없다.
예컨대, EU의 ‘소비재매매와 관련 보증 지침’에서 매도할 당시 상품의 계약불합치성이존재했고 향후 2년 이내에 나타난 하자에 대해서는 소비자의 청구에 의하여 판매자가 책임진다는 점과 상품 인도 후 6개월 이내에 발생한 불합치성은 인도 시점부터 발생한 것으로추정하여 입증책임을 판매자에게 전환하는 내용은 조속히 우리법에 도입될 필요가 있다.
아울러 캐나다의 ‘소비재 보증 및 책임법’과 같이 명시적 품질보증으로써 묵시적 품질보증을 제한하는 것을 차단하고 ‘구두증거배제법칙’을 폐지하여 비록 서면의 계약이 체결되었어도 계약 시의 구두 보증도 입증만 되면 명시적 품질보증에 포함시키는 내용의 도입을검토하여야 한다.
자동차 레몬법은 우선 그 대상을 예컨대 승용차, 소형트럭의 신차로서 인도 후 1년 혹은주행거리 30,000 킬로미터 중 먼저 도달 하는 기간 내 제작자 측이 합리적인 횟수의 수리시도에도 불구하고 결함을 시정하지 못한 경우에는 구매자는 교환 또는 환불을 요구할 수있는 내용으로 ‘자동차 관리법’의 개정을 통하여 입법할 수 있을 것이다.
각국의 자동차 레몬법 분쟁해결제도들은 전문성, 공평성, 소비자의 부담 경감과 편의성을 추구하고 있다. 미국 레몬법 중재는 그 판정이 제조자 측에만 편면적(片面的) 구속력을갖는다는 점, 그 중재 프로그램의 비용을 가입한 제조자들이 부담한다는 점, 변호사 선임이필요없다는 점에서 소비자의 이익을 도모하고 있다. FTC가 설정한 최소 요건에 따라 도입되는 레몬법 중재 프로그램은 연방 및 주(州)의 공평성 기준에 합치성에 관하여 주(州)법무장관의 승인을 받아 설치되고 주기적인 FTC의 감사를 통해 그 공정성을 확보하고 있다.
소송의 레몬법 중재 전치주의(前置主義)에 대한 빈번한 논란도 확고한 공평성의 확보로 잠재울 수 있을 것이다. 다만 중재인 명부를 통해 소비자가 중재인 선정 등 중재판정부 구성에 참여 할 수 있도록 하고 소비자가 원하는 경우 중재 심리에 참석하여 변론할 기회도보장되어야 할 것이다.
자동차 분쟁 특별법정인 뉴질랜드의 MVDT는 자동차의 전문성, 공평성, 소비자의 편의성이 확보된 우수한 제도이다. 특히 1차적으로 당사자들의 교섭에 의한 분쟁해결 시도와같이 ADR의 장점으로 재판을 보완하고 있으며 원칙적으로 변호사 대리를 금지하여 소송비용을 축소하고 또한 찾아가는 법정으로 소비자의 편의성을 고려하고 있으며 법원의 판결에 의한 분쟁해결로서 공정성 및 집행과 상소절차를 보장하고 있다. 이와 같은 특별법정이 싱가포르의 경우와 같이 ‘특정 이행’의 명령을 제조자에게 내릴 수 있는 권한까지 확보하면 소비자를 보다 두텁게 보호할 수 있을 것이다.
한국의 자동차 교환·환불 분쟁해결제도의 모델로서 단기적으로 미국의 레몬법 중재가적당하다고 생각된다. 한국은 미국과 같이 주요 자동차 산업국가의 하나로서 관련 법제의조화가 중요하다. 예컨대 현대/기아자동차가 미국의 레몬법 중재 프로그램에 가입하였다면 한국에서도 유사한 프로그램에 가입하는 것이 적절해 보인다. 다만 교환 및 환불 문제는계약의 품질보증법제에 출발한다는 점에서 그리고 공평성을 주요가치로 추구해야 한다는점에 정부 주도의 행정형(行政型) 제도 방식보다는 미국처럼 중립적 기관이 담당하는 것이바람직하다. 또한 ‘뉴욕 주(州) 신차 레몬 중재 프로그램’이나 ‘플로리다 주(州) 신차 중재위원회’의 중재와 같이 제작사와 소비자 모두를 구속하는 일반적 의미의 중재방식으로서전문성이 탁월한 중재제도를 레몬법 중재와 병존시키는 것도 중재의 단심제 장점을 살릴수 있는 좋은 방안이라고 생각한다.
장기적으로 레몬법 중재를 통하여 축적된 법리와 전문성을 토대로 하여 자동차 분쟁 특별법정을 창설할 수 있을 것이다.

영어초록

Nowadays, motor vehicles not only are important means of living and assets for an individual but also, as dangerous products, are involved in various disputes. Under the consideration of these characteristics of motor vehicles, it is very important to secure consumers’ interests of the quality including automobile safety. The motor vehicle consumer’s interest is protected by the courts according to warranty systems of contract law or a special law. Also, the interest regarding safety is secured by governmental recall or product liability law and system.
For ideal introduction of dispute resolution system of car exchange and refund, the legislation of ‘Lemon Law’ which is an exchange and refund law of general consumer goods is pressing, such as ‘the Magnusson-Moss Warranty Act’ of the United States and ‘Directive 1999/44/EC…on certain aspects of the sale of consumer goods and associated guarantees,’ of EU. Despite of these revised foreign application of laws for consumer protection, there is no movement to revise the Civil Law or the Basic Act of Consumers in Korea.
It is necessary to introduce the Lemon Law quickly into Korean Law that a seller is responsible for consumer’s claims regarding the existence of non-conformity of goods and any defect within two years after sales and that any non-conformity within six months after goods delivery is presumed as that of the point of delivery according to ‘Directive 1999/44/EC’ of EU, which causes the shift of burden of proof to the seller.
Also, it should be reviewed that the express warranty cannot waive the implied warranty and the exclusion of parole evidence rule in the Consumer Product Warranty and Liability Act of Canada.
The automobile Lemon Law could be legislated by revision of ‘the Automobile Management Act’ of Korea. A customer could claim replace or refund for new cars of which the manufacturer failed to correct the defects despite of reasonable number of repair attempts within one year or thirty thousand km mileage, whichever is earlier.
Each country’s dispute settlement system of lemon law pursues professionalism, impartiality, convenience and the mitigation of consumer’s burden. The Lemon Law arbitrations in the United States try to build up customer’s interests in the point that the award only binds manufacturers, the arbitration program expenses are paid by manufacturers and hiring a layer is not necessary. Lemon law arbitration program. which is introduced based on the minimum requirements of the FTC, is set up by the approval from the Attorney General of the state according to the impartiality standards of state or the United States. Also, the fairness is continuously secured by regular audit of the FTC. Frequent arguments regarding lemon law arbitration bound only the producers would be pacified by establishing firm impartiality. But consumers can compose an arbitral tribunal by selecting arbitrators from its list and should be assured of attending arbitration hearing as well as a defense chance if they want.
The Motor Vehicle Disputes Tribunal of New Zealand is a good system which secures automotive professionalism, impartiality and convenience of consumers. Particularly, it supplements a trial by the merit of ADR which attempts dispute resolution through negotiation, generally reduces the costs of litigation by prohibiting deputy of attorney, considers the consumer’s convenience by visiting court and secures impartiality, execution and appealing process by resolution of dispute through the judgement of court.
If this kind of special court obtains the authority to order ‘specific performance’ to manufacturers in Singapore, consumers would be protected more strongly.
In a short run, the Lemon law arbitrations in the United States seem recommendable as the model of dispute resolution system for automotive replace or refund in Korea. As one of the major automotive industry countries like the United States, the harmony of related legislations is important in Korea. For example, if Hyundai/Kia Motor companies signed up Lemon Law Arbitration Program in the United States, it is recommendable to sign up a similar program in Korea. But based on the fact that the exchange and refund start from warranty of a contract and pursues the impartiality as main value, it is more recommendable for a neutral institution like the United States does, rather than administrative system oriented by government.
In the long run, special court for automotive disputes would be established based on specialty and accumulated legal principles through Lemon Law arbitrations.
