초록

최근 4차 산업혁명 및 디지털 인공지능의 교통분야로 “자율주행자동차 등 미래 교통환경 변화 대응”에 대한 부분의 관심이 높아지고 있으며, 자율주행자동차의 상용화와 관련한 사항이 주목되고 있다. 이에 따라 함께 주목되는 것이 바로 자율주행자동차의 관련 법제의 개정이다. 현재의 자동차의 개념에서 새로운 패러다임의 변화로 일컬어 질 수 있을지 모르는 자율주행자동차의 등장은 전 세계적으로 각 법제의 개정을 필요로 하는 상황이다.
국내에서도 다양한 관련 법제의 논의가 있기는 하지만 자율주행자동차가 도로교통에 있어 짊어지게 될 역할을 생각한다면, 그 법제에 있어 대표적인 법은 바로 도로교통법이라 할 수 있으며, 그 중에서도 주요한 자리를 차지하는 것은 일단 이러한 자율주행자동차가 도로교통 상에서 움직이기 위해 필요한 사항이라고 할 수 있기에 도로교통법 상의 운전면허와 관련한 사항이 될 것이다.
따라서 운전면허와 관련한 법이론 및 관련사항들을 고려한다면, 현재까지 도로교통법상의 운전면허 규정이 존재하는 법이론의 바탕은 허용된 위험의 법리로 이는 운전면허는 자동차 또는 교통이라는 위험한 상황에 대해 운전면허라 하는 수단을 이용해 운전면허를 취득한 자에 한해 그 위험을 허용한다는 법리이다.
이에 이러한 기존 운전면허와 관련한 법이론 등을 바탕으로 자율주행자동차와 관련한 운전면허에 대하여 살펴본다면, 자율주행자동차의 경우 기존 사람(人)에 대한 면허와 자율주행이 가능한 즉, 인적요소가 있는 차(車)에 대한 면허의 관점으로 각각 나누어 살펴볼 필요가 있다.
그 결과 기본적으로 운전면허는 일반적으로 운전만을 할 수 있는 능력을 가지고 면허를 주는 것으로 생각되지만, 그 법적 논리 및 평가방법 상의 내용을 살펴본다면 이는 그리 단순하지만은 않다. 일단 운전을 행하기 위한 그 운전자로서 가져야 할 인간의 운전자만이 할 수 있는 다양한 판단 및 대처가 운전면허를 발급받기 위한 요소로 자리 잡고 있고, 이는 자율주행자동차 시대가 도래 한다고 하여도 바뀌어 질 수 없는 기본적인 요소가 분명히 존재하기에 사람에게 부여되는 그 “면허”라는 혹은 “자격”은 반드시 수반될 필요가 있다.
다시말해 운전면허의 발급을 위한 다양한 필요 사항 중 운전이라는 것이 대표적인 사항이라 운전면허라 칭하는 것이지 운전이 전부라는 의미가 아님을 되새길 필요가 있다. 이에 설사 이제 더 이상 사람이 운전이라는 행위를 하지 않더라고 “사용” 혹은 “탑승”이라는 표현이 수반되는 면허라 할 수 있는 그 자격 자체의 필요성은 발생한다.
또한 자율주행자동차가 자율주행기능을 하는 동안엔 이미 충분히 인간의 운전자가 대신할 만한 운전에 관한 인적행위를 수행하고 있기에 도로교통상의 운전면허권 제도내의 도로교통에 관한 법 준수능력 및 그 밖의 어떠한 평가나 절차는 도로교통상의 위험과 장해방지를 위해 반드시 수반될 필요가 있다. 운전자의 개념에 대한 정의 관계를 떠나 분명히 자율주행자동차가 자율주행 동안에는 분명히 도로교통법을 준수하는 등의 운전능력을 필요로 함은 마땅하다.
자율주행 기능이라는 것으로 운전자의 운전능력을 대체함에 있어 기본적으로 운전자가 운전을 할 경우 지켜야 할 도로교통법의 법 준수 등은 단순한 기계의 기능적인 측면보다는 보다 자율주행 시스템의 소프트웨어 측면에서의 평가라 할 수 있다.
그러나 이 경우 자율주행자동차 차체 자체에게 운전면허란 표현을 부여하기엔 현행법상의 현실적으로는 다소 무리가 따른다. 그렇지만 앞서 언급한 자율주행시스템에 관한 위험과 장해를 방지하기 위한 평가나 절차가 우리가 흔히 통상적으로 표현하는 자율주행자동차에 대한 면허라는 뜻으로 이해될 수 있을 여지는 있다.
결국, 자율주행자동차의 상용화 더 나아가 완전자율주행자동차가 도로교통상에서 주행한다고 하여도 인간운전자 또는 이용자 및 탑승자인 사람이 갖추어야 할 기본적인 사항으로의 면허는 존재할 필요가 있다. 나아가 자율주행자동차의 자율주행시스템의 도로교통상의 위험과 장해를 방지하기 위해 운전면허제도권 내의 어떠한 평가 내지 절차도 존재의 가치가 있다.

영어초록

Recently, interest is heightening in “responses to changes in future traffic environments such as autonomous vehicles” in the transportations fields of digital artificial intelligence and the Fourth Industrial Revolution and attention is also being given to matters related to the commercialization of autonomous vehicles. Accordingly, attention is also being given to revisions in legislation associated with autonomous vehicles. As it is unsure whether autonomous vehicles can be included in the concept of automobiles with changes in the new paradigm, revisions are needed in legislation around the world.
While there are discussions regarding various associated laws in Korea, when the role that autonomous vehicles will play in road traffic is taken into account, representative laws in associated legislation can be considered road traffic laws in themselves, and of those, laws that take a primary role can be considered matters necessary in making such autonomous vehicles move through road traffic so they will become matters associated with driver’s licenses following traffic laws.
Therefore, when legal theories associated with driver’s licenses and associated matters are taken into consideration, the basis of legal theories in which driver’s license regulations following traffic laws until now are legal principles of acceptable risk and thus, with regard to the dangerous situations of automobiles and traffic, a driver’s license is a legal principle that allows the acquisitor that risk using the means of a driver’s license.
At this, when driver’s licenses for autonomous vehicles are examined based on legal theories associated with existing driver’s licenses, they should be examined with relatively different viewpoints; one based on licenses given to people and one based on autonomous driving, or in other words, based on automobiles with human elements.
Consequentially, while it is thought that licenses are generally given to those who can drive, examinations made of legal reasoning and of contents following evaluation methods show that the matter is not so simple. First, various judgments and reactions that can only be made by human drivers and that must be possessed as a driver who can perform the act of driving have taken place as elements necessary in the issuance of a driver’s license and even if the age of autonomous vehicles arrives, basic elements that cannot change surely exist, so a “license” or forms of “qualification” given to people must always be involved.
In other words, it should be reviewed that driver’s licenses are called so because driving is the representative matter among the various necessary matters involved in the issuance of driver’s licenses, not because it encases the entire meaning of driving. Even if people do not continue to perform the act of driving, the need for qualifications that can be called “use” or “boarding” licenses will arise.
Also, as autonomous vehicles are already performing human acts of driving that can sufficiently substitute human drivers while performing autonomous driving functions, law abiding abilities regarding road traffic within the driver’s license system of road traffic and any other evaluations or procedures must surely be involved to prevent the danger and hazards of road traffic. Apart from defining relations regarding the concept of drivers, driving abilities such as the observance of traffic laws are surely needed while autonomous vehicles are autonomously driving.
With autonomous driving functions, in substituting the driving abilities of drivers, the observance of traffic laws that must fundamentally be abided by when drivers are driving can be considered evaluations from aspects of autonomous driving system software rather than from the simple functional aspects of machinery.
However in this case, it is slightly irrational to attach the expression of “driver’s license” to autonomous vehicles in themselves within the reality of existing laws. However, evaluations and procedures followed to prevent danger and hazards in association with the autonomous driving system aforementioned can be understood as ‘licenses’ with regard to autonomous vehicles according to the way we commonly express them.
Conclusively, even with the commercialization of autonomous vehicles and further, even if completely autonomous vehicles drive in road traffic, licenses need to exist as a basic item that human drivers, users, or boarders must possess. Further, evaluations or procedures within the driver’s license system should exist for the autonomous driving system of autonomous vehicles in order to prevent danger and hazards in road traffic.
