초록

디지털 전환이 시대적 화두로 등장하고 있다. 이는 전통적인 사회 구조의 전면적 변화를 의미하는 것이고, 그에 따라 법규범에 관한 인식 또한 변화시킬 것으로 예상된다. 그러나 이러한 변화를 사전에 예측하는 것은 어렵다. 그 이유는 법이론적 관점에서 볼 때 디지털 전환의 속성상 법의 불확정성을 더욱 증폭시킬 것으로 보이기 때문이다. 이런 측면에서 이미 정립된 법규범보다는 법현실을 정확하게 인식하는 것이 더욱 중요한 상황이 전개될 것이다. 이는 달리 말하여, 법규범과 법현실의 괴리 현상을 파악하는 것이 미래 법교육의 중심적 논제가 될 것이라는 점을 보여주는 것이다. 따라서 디지털 전환의 미래 환경에서는 이제까지의 법교육에 대해 새롭게 접근해 나가야할 필요가 있다. 이를 위하여 이 논문은 법규범과 법현실의 괴리 문제에 주목하고 있는 법사회학적 접근에 관해 살펴본다. 현재 학교 교육과정에 나타나 있는 법교육의 내용은 이미 정립된 법규범의 준수를 강조하는 맥락에 서 있다. 그런 의미에서 이는 본질주의적이고 객관주의적인 인식론을 전제로 하고 있는 것으로 평가할 수 있다. 그러나 이러한 인식론적 토대 위에서는, 변화하고 있는 법현실에 효과적으로 대응할 수 있는 법교육을 효과적으로 수행하기 어렵다. 이 지점에서 사회 현상으로서의 법, 그리고 법현실에 주목하고 있는 법사회학적 접근방식은 상당한 시사점을 제공해줄 수 있을 것으로 기대된다. 이러한 법사회학적 접근을 기반으로 이 논문은 다음과 같은 현재 법교육의 중장기적인 발전 방향을 제언하였다. (ⅰ) 사회변화에 따른 법변동에 관한 내용을 교육과정에 포함시킬 필요가 있다. (ⅱ) 법문화에 관한 내용을 교육과정에 반영할 필요가 있다. (ⅲ) 생활 법교육은 학교 교육과정이 아니라 사회 법교육의 기회와 연계하여 이루어지도록 할 필요가 있다. (ⅳ) 법학적 지식체계를 탈피하여 다른 교과 영역에 포함시켜 교육할 수 있는 융합적 접근을 시도해야 한다. (ⅴ) 법교육 교사 양성과 관련하여 기초법학에 관한 교육이 이루어져야 한다.

Digital transformation is emerging as a topic of the present age. This means a full-scale change in the traditional social structure, and it is expected that the perception of legal norms will also change accordingly. However, it is difficult to predict these changes in advance. The reason is that, from the viewpoint of legal theory, the nature of digital transformation is expected to further amplify the indeterminacy of the law. In this respect, a situation will develop in which it is more important to appropriately recognize the ‘legal reality’ rather than the already ‘established legal norms’. In other words, it shows that understanding the gap between legal norms and legal reality will be the central topic of future law-related education. Therefore, in the future environment of digital transformation, it is necessary to take a new approach to law-related education. To this end, this article examines the approach in the perspective of Sociology of Law that focuses on the gap between legal norms and legal reality. The content of law-related education in the current school curriculum is in the context of emphasizing compliance with established legal norms. In that sense, it can be evaluated as premised on essentialistic and objectivistic epistemology. However, on this epistemological basis, it is difficult to effectively conduct law-related education that can effectively respond to the changing legal reality. At this point, it is expected that the approach in the perspective of Sociology of Law that pays attention to the ‘law as a social phenomenon’ or the ‘legal reality’ can provide significant implications. Based on this approach, this article suggests the following medium-and long-term development directions for current law-related education. (i) It is necessary to include contents related to legal changes in accordance with social changes in the curriculum. (ii) It is necessary to reflect the contents of legal culture in the curriculum. (iii) the education on life law needs to be conducted in connection with social law education opportunities, not school curriculum. (iv) A convergent approach to education that can be included in other subject areas beyond the legal knowledge system should be attempted. (v) In relation to the training of law education teachers, education on basic jurisprudence(philosophy of law, sociology of law, etc.) should be provided.
