초록

이 논문은 로마법과 교회법 안에서 취득시효을 위한 선의bona fides에대해서 다루고 있다.
⟪악의는 손해가 되지 않는다mala fides superveniens non nocet⟫라는 로마법과 세속법의 원칙과 법에 대한 교의적인 해석의 열매인⟪악의는 손해를 야기한다 mala fides superveniens nocet⟫라는 서로 명백히 상반되는 두원칙이 공존하면서 현실 안에서 법적인 충돌이 발생한다.
교회법은 시효에 관한 해당 국가의 법률을 그대로 수용하지만, 교회법전에 규정된 것들은 예외로 하고 있다. 즉, 우리나라에서는 민법의 규정에따라 권리의 시효가 정해지고, 취득 혹은 소멸한다. 민법이 정한 시효의만료, 시효의 경과 시작과 정지, 포기에 이르기까지 교회법과 동일한 효력을 가진다.
하지만 교회법 제198조는 “시효는 그 시초뿐 아니라 시효에 요구되는기간 중 줄곧 선의에 근거하지 아니하는 한 무효다. 다만 교회법 제1362조의 규정은 보존된다.”고 규정하고 있다. 즉, 교회법은 시효의 효력을 발생시키는 필요 요건으로 선의의 지속bona fidei continuativa을 요구하고 있다.
반면 로마법의 전통을 계승한 우리 민법은 시효가 개시될 시점에만 선의를 요구할 뿐, 시효가 만료되기까지 모든 기간의 선의를 요구하지 않는다.
교회법은 선의가 시효의 시작부터 만료 시까지 유지됨을 전제로 하여 민법의 시효에 관한 법률을 준용한다. 따라서 민법상으로 시효에 의해서재산을 취득했다 하더라도, 실제로 선의가 시효의 시작되는 시점에서 만료하는 시점까지 계속 이어지지 않았다면 교회법상으로는 무효이다.
이러한 법적인 충돌에도 불구하고 규정을 유지하는 이유는, 교회법상의선의에 관한 규정은 “영혼의 구원 salvezza dell’amina”을 목표로 하는 영원법과 자연법에 권원을 두고 있기 때문이다.

영어초록

This paper deals with the problem of bona fides for usucapio in the Roman law and Canon law.
There is a legal conflict in reality between clearly opposed two principles, the principle of the Roman law and the Civil law that is⟪If bad faith later occurs, it does not invalidate: male fides superveniens non nocet⟫and the principle of the Canon law that is⟪If bad faith later occurs, it invalidate: male fides superveniens nocet⟫as the fruit of the doctrinal interpretation of the law.
The Canon law accepts the laws of the state concerned about the prescription, but excludes those prescribed in the Canon law. In other words, in Korea, the prescription of the right is determined according to the provisions of the civil law, and then it is acquired or extinguished. It has the same effect like the Canon law until the renunciation, the expiration, the passage, and the start and stop of the prescription set by the Civil law.
However, Article 198 of the Canon Law prescribe that “No prescription is valid unless it is based on good faith not only at the beginning but also through the entire course of time required for prescription, without prejudice to the prescript of Can. 1362.” In other words, the Canon law requires the continuation of bona fides as a necessary requirement for the effect of prescription.
On the other hand, the Korean Civil Law, which inherited the tradition of Roman law, demands good faith(bona fides) only at the time when the prescription begins, and does not require good faith throughout all periods until the time expires.
The Canon law shall apply the Korean Civil Law to the presumption that good faith should be maintained from the beginning to the expiration of the prescription.
Therefore, even if property is acquired by the Korean Civil law, it is invalid under the Canon law as long as good faith lasts from the time when it begins to the time when it expires because the good faith in the Canon law is based on the eternal and natural law which aims at “the salvation of souls.”
