안마사의 안마업무의 범위에 관한 검토 (A study on the scope of Massagist's massage services)

초록

우리나라 의료법상 안마업무는 시각장애인으로서 안마사 자격을 지닌 자만 수행할 수 있기 때문에 안마사가 아닌 자는 안마업무를 수행할 수 없음은 물론 안마시술소 또는 안마원을 개설할 수 없게 된다. 그런데 현장에서 안마사의 안마업무와 안마사가 아닌 자의 마사지 행위를 구별하기가 쉽지 않고, 의료기사법의 물리치료행위나 공중위생관리법상의 피부미용행위로 파악될 소지도 있기 때문에 혼란이 초래될 수밖에 없다. 이에 본고에서는 안마업무, 물리치료행위, 피부미용행위 간에 차이점을 현행법령과 판례를 토대로 비교 검토하여 안마업무의 범위가 어떠한지 및 안마사 제도의 향후 규제 방향을 설정해보고자 한다.
안마업무의 경계를 나누어 본다면, 안마업무가 신체에 대하여 상당한 물리적 충격을 가하여 보건위생상 위해가 생길 우려가 있다면 의료행위에 해당한다고 할 것이나, 단순한 피로회복을 위하여 시술하는 데 그치는 것이라면 비의료 건강관리서비스로 파악할 수 있을 것이다. 한편 안마업무, 물리치료행위, 피부관리행위 모두 ‘손이나 도구를 이용하여’ ‘인체 외부에 물리적인 힘 내지 외력’을 가한다는 점에서는 공통점이 있다. 다만 각각의 방법이나 물리력의 정도, 인체에 미치는 영향에 따라 의료행위나 비의료 건강관리서비스에 해당하는지 여부가 달라지는 것으로 이해할 수 있을 것이다.
나아가 안마사제도가 유지되기 위해서는 안마사가 설립할 수 있는 안마시술소와 피부미용사가 설립할 수 있는 피부미용업에 해당하는 마사지업소를 국민들이 직접 구분하여 결정할 수 있도록 해야 할 것이다. 이를 위해서는 앞서와 같이 안마업무가 지니는 특성을 명확히 해주어야 하고, 국민들이 느끼기에 단순한 미용을 넘어서 건강증진의 효과를 일부 지니고 있다는 점을 강화해야 할 필요가 있다. 그러므로 안마사가 되기 위한 교육과정을 공개하는 것에 더하여 안마업무와 관련된 기술을 개발 및 개선하는 등 특화를 위한 지속적인 노력이 요청된다.

영어초록

According to the Medical Act of South Korea, massage services can only be performed by visually impaired persons who are qualified as massagists, so non-massagists cannot perform massage services and open massage parlors or massage centers. However, it is not easy to distinguish between massage services by massagists and massage services by non-massagists in the field, and since it can be considered as physical therapy under the Medical Technician Act or skin care services under the Public Health Management Act, confusion is bound to arise. In this paper, we will compare and review the differences between massage services, physical therapy services, and skin care services based on current laws and precedents to determine the scope of massage services and the future regulatory direction of the massagist system.
If we divide the boundaries of massage services, if massage services inflict considerable physical impact on the body and there is a risk of health and hygiene hazards, it can be considered a medical practice, but if it is simply performed for the purpose of recovering from fatigue, it can be considered a non-medical health care service. On the other hand, massage work, physical therapy, and skin care all have in common that they apply ‘physical force or external force to the outside of the human body’ ‘using hands or tools.’ However, it can be understood that whether they are medical or non-medical health care services varies depending on the method, degree of physical force, and effect on the human body.
Furthermore, in order for the massage therapist system to be maintained, the public should be able to directly distinguish and decide between massage parlors that can be established by massagists and massage businesses that can be established by skin care therapists. To this end, the characteristics of the massage business should be clearly stated as mentioned above, and it is necessary to reinforce the fact that the public feels that it has some health promotion effects beyond simple beauty. Therefore, in addition to disclosing the training course to become a massagist, continuous efforts for specialization such as developing and improving technologies related to the massage business are required.
