「중국 민법전」과 중국 지식재산권 법제 간의 조화방안 및 향후 과제 (A Study of the Harmonization Between the Chinese Civil Code and the Chinese Intellectual Property Legislation and its Future Tasks)

초록

중국은 1949년부터 민사법률 체계를 통합하는 민법전의 제정을 위해 노력해왔으며 그 결실인 중국 민법전은 2021년 1월 1일부터 제정 및 시행되었다.
민법전 제정 과정에서 민법전과 지식재산권 법제를 어떻게 조화 시킬 것 인지에 대한 논의가 지속되었다. 학계는 크게 연계형과 분리형으로 나뉘어 각 입법방식의 장단점을 검토하였고, 최종적으로는 지식재산권 관련 일반규정을 두고 지식재산권 단행법률을 민사특별법으로 독자적으로 운영하는 양자 간의 연계형 입법방식을 채택하였다. 이는 민법전의 안정성을 담보함과 동시에 지식재산권의 다변성을 추구한 결과로 보인다. 민법전 내 지식재산권 관련 규정은 대부분 기존의 민법 체계에서 사용되었던 규정을 그대로 가지고 왔지만 민법총칙의 지식재산권 객체에 대한 정의조항과 계약편 내 징벌적 손해배상, 전형계약 중 기술계약 부분이 일부 수정되어 입법 되었다. 현재 중국에서는 민법전이 안정적으로 시행됨에 따라 향후 지식재산권 법제를 어떻게 정비할 것 인가가 새로운 과제로 대두 된다. 이에 중국의 지식재산강국 건설이라는 국가 전략을 달성하기 위해서는 민법전과 지식재산권 단행법률을 아우를 수 있는 지식재산권 기본법률의 제정되어야 할 것이다. 중국의 이러한 논의를 살펴보는 것은 이미 성숙기에 접어든 한국의 지식재산권 법률체계의 향후 개정 및 운영에 있어 시사점을 줄 수 있을 것으로 생각한다.

영어초록

Since 1949, China has been striving to enact a civil code that integrates the civil law system, and the fruit of it, the Chinese Civil Code, was enacted and implemented on January 1, 2021. In the process of enacting the Civil Code, discussions continued on how to harmonize the Civil Code and the Intellectual Property L aw l egislation. A cademia suggested t wo d ifferent m ethod, L inking a nd Separating system, and reviewed the advantages and disadvantages of each legislative method, and finally adopted a linking legislative method that general regulations on intellectual property rights stays in the Civil Code,while Intellectual Property Law operates independently the as a special civil law. This seems to be the result of ensuring the stability of the Civil Code, at the same time pursuing the diversity of intellectual property rights. Most of the regulations related to intellectual property rights in the Civil Code carried the provisions used in the existing civil law system, but the definitions of intellectual property objects in the General Civil Code, punitive damages and technical contracts in the Contract Provision were partially revised.
Currently, as the Civil Code is stably implemented in China, how to reorganize the intellectual property rights legislation in the future emerges as a new task.
Accordingly, in order to achieve China’s national strategy of building an intellectual property powerhouse, a basic law on intellectual property rights that encompasses the Civil Code and the Intellectual Property Law should be enacted. These discussions in China will be somehow inspiring for the future revision and operation of Korea’s intellectual property legal system, which has already reached maturity.
