국회 의원입법 공동발의 제도에 관한 시론적 비평 (Introducing Criticism about ‘Joint initiative’ in the Legislation Process by Assemblymen)

초록

‘공동발의’라고 불리는 작업은 입법과정의 가장 초기 단계다. 의원실에서 내부적으로 마련한 법안을 처음으로 외부에 공개하는 단계이기도 하다. 입법은 사회 모든 구성원을 다스리는 규범이고 국가의 운영 원리이다. 따라서 가급적이면 성숙된법안 검토가 필요하다. 그러나 의원입법 공동발의 과정에서 불공정하고 미성숙한행태들이 만연해 있다. 공동발의라는 용어는 임의적, 실무적, 편의적, 다의적인 표현이라는 점을 주의할 필요가 있다. 국회법은 공동발의를 위해 10명의 국회의원이참여하는 것을 요구하고 있다. 여기서‘발의의원’과‘찬성의원’을 구분하게 된다.
그런데 발의의원과 찬성의원은 의미가 매우 흡사해 문제가 있다. 용어의 구분을 명확하게 해야 한다. 또한, 법안에 아무런 기여를 한 것이 없는데도 발의의원으로 지위가 부여되고 의정활동 성과로 인정받게 되는 불공정함이 있다. 공동발의가 의원이나 보좌진의 친분에 따라 좌우되기도 한다. 공동발의가 서로서로 거래하듯이 이뤄지기도 한다. 공동발의가 정당 간의 대립을 고착시키는 효과를 발생시키기도 한다. 이런 문제점들을 해결하기 위해서는 국회법 개정을 통해 의원입법안에 대한 성숙된 검토 환경이 마련되도록 해야 한다. 예를 들어 공동발의가 서면이 아닌 전자시스템을 통해서 이뤄지도록 전환할 필요가 있다. 친분주의나 요식절차에 불과해진 공동발의 과정 자체를 과감하게 혁신해야 한다. 국회의원 한 사람만의 단독발의가 가능한 체제로 과감히 전환하는 것이 요망된다.

영어초록

A 'joint initiative' is the most initial stage of the legislative process. It is also the stage that a bill prepared in the congressman's office is disclosed for the first time. Legislation is the norms governing all members of society and the operating principle of the state. Therefore, mature review of a bill is indispensable.
However, unethical and immature behaviors are widespread in the lawmaker's Joint initiative process. The term, joint initiative is arbitrary, practical, opportunistic, and polysemantic expression. According to the parliamentary law, more than ten Members of the National Assembly must participate in the joint initiative. There is the distinction between the 'assemblymen proposed a bill' and 'assemblyman approved a bill'. However, it is controversial that the term 'assemblymen proposed a bill' and 'assemblyman approved a bill' are similar in their meaning. It is necessary to clarify distinction between the terms. In addition, it is a problem that an assemblyman who has not contributed to legislation has the status as an 'assemblymen proposed a bill' and it is recognized as performance of legislative activity. The joint initiative also depends on close relations between lawmakers or between lawmaker's assistants. Sometimes, assemblymen deal with the 'joint initiative' such as trading goods. The joint initiative also raises the effect of fixing the confrontation between the political parties. In order to solve these problems, the mature review of lawmakers' legislation is necessary and the amendment of the parliamentary law is prerequisite to that. For example, it is necessary to switch the process of a 'joint initiative' from paper work to the work through electronic system. It is necessary to innovate the 'joint initiative' process itself that became just a formal act that depends on closeness between congressmen. It is desirable to switch to the system that single member of the national Assembly is able to propose a bill.
