연세 형법학의 발자취와 미래 (History and Future of Yonsei Criminal Jurisprudence)

초록

연세에서 법학교육은 일제강점기 연희전문에서 시작되었다. 1921년 법학과목이 독립된 과목으로 개설되어 있었고, 연세에서 형법교육도 이 무렵 시작되었다. 1952년 법학과 창립과 함께 연희대학에 부임한 정영석 교수가 형법을 담당하면서, 연세 형법의 역사는 시작되었다. 연세형법의 역사는 한국형법의 역사와 흐름을 같이 한다. 한국형법학은 해방 후 일본형법학의 영향 하에 일본에서 공부한 학자들에 의해 시작되어 정착되었으며, 이 시기 대표적인 형법학자가 정영석 교수이다. 1980년대는 독일형법이론이 체계적으로 국내에 도입되면서 한국형법학이 큰 변혁과 발전을 이루었으며, 이 시기 대표적인 형법학자가 이형국 교수와 박상기 교수이다. 또한 1980년대 이후 다수의 연세 형법학자들이 배출되어 연세 형법학이 한국 형법학의 중추적인 역할을 하였다.
연세 형법학은 한국 형법의 발전에 따라 각 시대마다 한국 형법학을 이끌어 갔고, 한국형법학의 발전을 주도했다. 이제 인터넷과 디지털 시대에 세계화의 중심이 되는 창의적 법학자 및 법률가의 배출과 새로운 형법이론체계의 모색에 연세형법학은 주도적인 역할을 할 것으로 판단된다. 앞으로 우리 형법학은 대륙법계와 영미법계의 연구가 균형을 이루어야 하고, 이를 토대로 우리 고유의 형법학체계를 구축해가야 할 것이다. 진리와 자유, 정의와 사랑의 정신과 함께 다양성과 창의성을 학풍으로 하는 연세 형법학은 추후 우리 형법학의 이러한 과제의 해결에도 선도적인 역할을 할 것이다.

영어초록

Legal education at Yonsei began at Yeonhee College during the period of the Japanese illegal occupation of Korea. Criminal law lectures at Yonsei were instituted as early as 1921. With the founding of the Department of Law in 1952, Professor Jeong Young-seok, who was appointed at Yonhee University, was in charge of the criminal law education program, and the history of Yonsei criminal law began in earnest. Professor Jeong Young-seok continued with the history of Yonsei Criminal Law until his retirement in 1981. Later, Professor Lee Hyung-guk, who earned a degree in Germany, was appointed at Yonsei University in 1981, laying the groundwork for the continuing development of Yonsei Criminal Law.
The development of the Yonsei Criminal Law program ran parallel with the reform trends in the modern history of Korean Criminal Law. Korean criminal law was developed and reformed with the assistance of scholars who studied in Japan under the influence of Japanese criminal law after World WarⅡ. The most important criminal law scholar of this period is Professor Jeong Young-seok. The 1980s was a period of great transformation and development in Korean criminal law as German criminal law theories were systematically introduced into Korean jurisprudence. Professor Lee Hyeong-guk and Professor Park Sang-ki played a pivotal role in this period. In addition, since the 1980s, many Yonsei criminal law scholars were appointed as law professors at various universities, and Yonsei criminal law scholars have played an important role in the Korean criminal law academia since then.
Yonsei criminal law scholars have led Korean criminal law in each stage of the development of Korean criminal law. Now is the time to enhance the independence of Korean criminal law by referring to not only the admitted achievements of German criminal law, but also to unique aspects of Anglo-American criminal law, and the role of Yonsei criminal law scholars in this process is becoming more important. Yonsei criminal law scholars are indeed contributing to the development of criminal law as it responds to new legal phenomena in accordance with changes in society and science and technology. At a time when it is important for academia to produce creative and enterprising legal scholars and lawyers, conversant with the internet and digital age and fully able to search for innovative criminal law theories and systems, Yonsei criminal law scholars are expected to play a key role in the development of Korean criminal law.
