신규성 상실의 예외 규정의 적용범위 - 헌법재판소 2023. 7. 20. 선고 2020헌바497 결정 및 ‘관련판결’에 대하여 - (Scope of application of exceptions to loss of novelty – Regarding the Constitutional Court of Korea decision sentenced on July 20, 2023, 2020Heonba497 and the 'Relevant Judgment’)

초록

디자인보호법은 산업의 발달을 도모하는 산업정책법으로 신규성을 갖는 디자인만보호하고 있는데 최근 신규성 관련 판결과 법개정이 활발히 이루어지고 있다. 특히디자인보호법에 있어서 신규성 상실의 원칙을 엄격히 고수할 경우에는 디자인출원자가 공개한 자기 디자인에 의하여 디자인권을 받지 못하는 가혹한 경우 등 제도의 취지와 불일치하는 경우가 있을 수 있으므로, 신규성 상실 예외 규정과 관련된 새로운논의가 있다. 또한 디자인보호법의 관련규정 개정은 같은 취지의 제도를 두고 있는특허법과 차이를 벌리고 있다. 이와 관련하여 대상결정은 헌법재판소가 신규성 상실예외 조항에 관하여 최초로 헌법적 판단을 내린 것이기는 하나 그 사안 자체의 한계때문에 심판대상조항인 이 사건 단서 중 정작 위헌성이 깊이 논의되어야 할 부분은심판대상에서 제외되었다. 그러므로 대상결정과 관련판결의 사안을 종합적으로 살펴‘이 사건 단서’ 조항의 합헌성 논의를 할 필요가 있다. 이에 재산권 침해 위헌성 판단기준 검토결과, 이 사건 단서는 광범위한 입법재량에도 불구하고 재산권침해의 소지가 커서 입법형성의 한계를 벗어난 것으로 볼 소지가 있다. 위헌성 해소를 위하여는첫째, 이 사건 단서를 아예 삭제하는 방안, 둘째, 적어도 이 사건 단서 중 ‘의사에 반하는 공지’에는 이 사건 단서가 적용되지 않도록 개정하고, ‘국외’ 부분을 삭제하는 방안이 가능하다. 최근 지식재산권의 헌법적 쟁점에 대한 판시가 많이 등장하고 있음을고려하고, 인공지능(AI)의 급속한 발전 등 지식재산권의 변화가 예상되는 현재 헌법적 심사기준 등 정립론의 활성화를 기대한다.

영어초록

The Design Protection Act(hereinafter referred to as ‘Act’) is the industrial policy law that promotes industrial development and protects only designs with novelty, but recently, rulings and amendments related to novelty have been actively made.
In particular, if the principle of loss of novelty is strictly adhered to in Act, there may be c ases w here t he p urpose o f the system is inconsistent, such a s harsh cases in w hich design rights are not received by the design applicant disclosed.
The revision of related regulations of the Act is different from the Patent Act, which has a system with the same purpose. In this regard, the target decision was the first constitutional judgment by the Constitutional Court on the exception clause for the loss of novelty, but due to the limitations of the case itself, the part where unconstitutionality should be discussed in depth was excluded from the subject of judgment. Therefore, it is necessary to comprehensively examine the issues of the subject decision and the related judgment to discuss the constitutionality of the provisions of the ‘clue of this case’.
Accordingly, as a result of reviewing the criteria for judging unconstitutionality in infringement of property rights, the clues in this case can be seen to be beyond the limits of legislative formation due to the high possibility of infringement of property rights despite extensive legislative discretion. To resolve the unconstitutionality, first, it is possible to delete the clues in this case altogether, and second, at least to amend the clues to this case so that they do not apply to ‘public notice against intention’ among the clues in this case, and to delete the ‘foreign’ part.
Considering the recent emergence of many judgments on constitutional issues of intellectual property rights, it is expected to revitalize the establishment theory, such as the current constitutional examination criteria, where changes in intellectual property rights are expected, such as the rapid development of Artificial Intelligence (AI).
