북미 대륙사와 정착민 식민주의에 비추어 재해석한 미국 연방제의 기원 (Continental History, Settler Colonialism, and the Origins of the U.S. Federal System)

초록

근래 역사학계에서는 미국 헌정체제의 형성 과정을 건국기 엘리트 중심으로만 바라보는 시각에서 벗어나, 18세기 영제국에서부터 이어진 보다 길고 점진적인 정치와 제도의 변화, 그리고 민중을 포함한 보다 폭넓은 사회사적 맥락 속에서 파악하려는 노력이 활기를 띄고 있다. 미국의 헌정체제 중에서도 연방제의 수립은 특히 광대한 영토를 놓고 중심부와 주변부 간의 관계를 설정하는 정치적 작업을 수반했기에, 그 사회사적 기원을 온전히 파악하기 위해서는 북미 대륙의 여러 원주민과 정착민, 복수의 주 정부와 연방 정부 등이 서로 갈등과 타협을 벌이며 건국기에 새로운 힘의 균형을 만들어 나간 과정을 보다 면밀히 살펴볼 필요가 있다. 본고에서는 18세기 북미 대륙사의 다원성을 강조하는 근래 연구들과 정착민 식민주의의 정치적, 사회적, 문화적 유산을 강조하는 최근 연구들에 비추어, 건국기 내륙 정착민들의 분산되고 적극적인 식민 팽창과 정치적 요구가 미국 연방제의 형성에 미친 영향을 분석한다. 독립혁명 직전의 영제국 관료들과 마찬가지로 건국기 미국 연방정부의 정치지도자들도 원주민들과 가급적 평화적인 관계 속에서 점진적이고 질서정연하며 중앙화된 영토 팽창을 추구했으나, 이런 기도는 내륙 정착민들의 무법적이고 공격적인 식민주의 때문에 번번이 무산되곤 하였다. 신생 연방정부는 취약한 중심부의 권력만으로 주변부를 통제할 수 없었기에, 결국 주변부 정착민들의 정치적 요구를 상당 부분 들어주면서 비로소 제한적인 중앙집권화와 체제 안정을 이루어낼 수 있었다. 이는 곧 정착민들의 지역 내 자율성을 상당 부분 용인하면서, 그들이 원주민들을 상대로 식민 팽창을 하는 데 대해서만큼은 연방정부가 군사적, 외교적, 재정적 지원을 해준다는 것을 의미했다. 그렇게 형성된 새로운 연방제의 기틀은, 원주민의 자주권을 철저히 배제하고 그들의 땅 위에 계속해서 새로운 사유지와 사회를 건설하며, 이에 앞장선 식민자들의 권리를 국가의 최고 권력으로 보장해줌으로써 새로운 식민지들을 속속 연방에 포섭시키고 국토를 확대해 나간다는 것이었다.

영어초록

Recent historical scholarship on American constitutionalism has underlined the significance of founding-era popular constitutionalism and the British imperial constitution’s legacy. These studies open up new ways to explore the constitutional system’s evolution by placing it in a broader socio-historical context and a longer trajectory of politico-institutional development. The origins of the U.S. federal system, in particular, can be seen in a new light by following this approach. Given that the political and constitutional relationship between the republic’s center and peripheries lay at the heart of the federal system, a full explication of its historical origins would have to take into account the complex interactions and shifting balances of power among multiple indigenous groups, settlers, and imperial, federal, and state governments throughout the later half of the eighteenth century. By bringing together recent historical studies that foreground the staggering socio-political plurality of the eighteenth-century North American continent with theoretical studies that explore the far-reaching impact of settler colonialism on the development of early American society, culture, and politics, this essay analyzes how the decentralized but aggressive colonialism and political demands of founding-era settlers impacted the shaping of the U.S. federal system. Much like their counterparts in the earlier British American Empire, the federal leadership of the newborn United States initially sought to steer territorial expansion in a centralized, gradual, and orderly fashion by pursuing peaceful relationships with the powerful indigenous nations of the interior. Such centralizing ambitions quickly proved futile, however, in face of the often lawless and violent colonial expansion led by settlers. Unable to control the peripheries with its meager authority, the incipient federal government ultimately managed to attain a degree of centralization and stability only by acceding to most of the settlers’ demands. The result was a de facto constitutional contract between the nation’s center and peripheries in which the settlers, in return for pledging allegiance to the union, would enjoy both local autonomy in most legal and administrative matters and strong federal military and diplomatic support in fighting off Native Americans. From the outset, then, the American federal system was firmlycommitted to the continued dispossession of indigenous people, awarding the autonomous colonizing efforts of settlers by upholding their political and constitutional rights with the federal republic’s highest authority, and in return continually enlarging its boundaries by adding new colonial states built by settlers.
