초록

1세대 당 1대 이상의 자동차를 보유하고 있을 정도로 최근 자동차의 수가 급격하게 증가하고 나아가 도로 사정의 악화됨에 따라 교통사고율이 꾸준히 증가하고 있다. 이는 엄청난 사회적 비용의 발생으로도 이어지고 있다는 점에서 이에 대한 대책의 필요성이 지속적으로 강조되고 있다. 이와 관련 늘어나고 있는 교통사고의 신속하고 원만한 해결과 피해자에 대한 실제적이고 효과적인 구제를 도모하기 위한 방안이 본격적으로 논의되고 있는데 특히 교통사고 처리의 비용 합리화를 달성하기 위한 방안으로 자동차 보험 정책이 주목을 받고 있다. 이에 따라 우리 입법은 자동차 가입 강제를 법제화하고 있는데 이는 우리나라를 비롯한 다른 나라의 일반적인 자동차 보험 정책이기도 하다. 즉 계약자유의 원칙이 여전히 유효한 상황에서 이를 제한하는 자동차보험 강제가입 정책은 사회적으로 용인되고 있으며 행복추구권, 특히 일반적 행동자유권 침해라는 비판으로부터도 자유로운 것이 사실이다. 즉 현재 자동차 보험가입을 강제하는 것의 타당성과 필요성은 일반적으로 인정되고 있다.
당해 지점에서 주목하여야 하는 것은 자동차보험 가입을 유인하기 위한 정책 방향 설정이라고 보아야 하며 이에는 자동차 보험 비가입차량에 대한 단속과 비가입자의 가입을 유인하기 위한 실효적인 정책 방향 설정이 특히 중요하다고 보아야 한다. 하지만 이는 헌법적합성의 문제라기보다는 적정성 혹은 합목적성의 문제라는 점에서 비교법적 연구의 필요성을 인정할 수 있고 다각적인 자동차 보험정책을 추진하고 있는 영국의 경험이 우리에게 던져주는 시사점이 상당할 것이다. 특히 영국의 경우 자동차 보험에 대한 강제가입 정책을 기반으로 차량 미가입자에 대한 강력한 제재를 통하여 가입을 유인하고 있으며 데이터베이스를 기반으로 자동차 미가입 차량에 대한 단속을 실제화하고 있다. 뿐만 아니라 자동차 보험 자동 갱신 등 상당히 다양한 보험 정책을 통하여 자동차 가입을 다각적으로 유인하고 있다. 단조로운 제재를 통하여 자동차 보험 미가입자에 대한 규율을 도모하고 있는 우리에게 시사하는 바가 크다고 생각된다.

영어초록

The traffic accident rate has been steadily increasing as the number of cars has increased rapidly and road conditions have deteriorated these days. The necessity of measures for the situation is continuously emphasized in that this leads to enormous social costs. In this regard, several measures to resolve the growing number of traffic accidents effectively and quickly and to seek practical and efficient relief for victims are being discussed in earnest, especially focusing on automobile insurance policies as a method to achieve cost rationalization of traffic accidents. Accordingly, our legislations provide the mandatory automobile insurance, which is also a general automobile insurance policy in other countries, including us. In other words, while the principle of liberty of contract is still effective in our legal fields, the mandatory automobile insurance policy that restricts the liberty is being socially accepted and is free from criticism that it is a violation of the constitutional right to pursue happiness, especially the right to freedom of action to one’s will power. In other words, the validity and necessity of forcing automobile insurance are generally admitted.
What should be noted at this point is the policy direction to induce mandatory automobile insurance and it should be emphasized particularly that it is important to crack down on vehicles not taking up mandatory automobile insurance policy and to establish effective policies to induce mandatory automobile insurance as mentioned above. However, this is not a matter of constitutionality, but of adequacy or desirability, so the necessity of comparative legal study can be adopted, and the British experience in promoting various automobile insurance policies will have significant implications for our concerned policy. In particular, in the case of the UK, based on the compulsory automobile insurance policy, it is attracting taking up the insurance throughout the strong sanctions against those who do not taking up the mandatory automobile insurance policy, and based on the database on the automobile insurance, the effective crackdown on the vehicles which are not insurance product is realized. In addition, those who do not taking up the mandatory automobile insurance policy are induced to take up the insurance in various ways, namely through quite a variety of insurance policies such as automatic renewal of automobile insurance. I think such a British experience has great implications for us, who are promoting sanctions for those who do not take up the mandatory auto insurance through monotonous sanctions.
