번역/번안의 분기-『장한몽』과‘번안의 독창성(originality)’ (The division of translation and adaptation : Janghanmon and `originality of adaptation')

초록

이 글은 조중환의 『장한몽』을 중심으로 번안의 용어가 가시화되지 않았던 1910년대 번안의 존재 방식의 의미를 저작권법제의 번안 개념과 관련하여 분석하려는 것이다.
1908년 한국에 적용된 일본의 저작권법에는 번안이 명시되었다. 1900년대에도 한국에서는 오늘날 번안으로 범주화할 수 있는 글쓰기 방식이 이루어져 왔다. 이러한 사실에서 번안이 가시화되지 못한 현상을 한국의 번역/번안의 역사에서 이해하려는 것이다. 여기에는 법제에서 규정하는 번역/번안의 개념적 규범화와 외국문학을 수용하는 글쓰기 관습의 문제가 작용할 것이다.
이러한 맥락에서 조중환의 번안소설이 번역과 ‘신소설’로 다른 명칭으로 제시되는 과정에 주목했다. 『쌍옥루』는 원작의 ‘동일성’이 유지된다는 의미에서 ‘소극적 번안’ 태도인 반면, 『장한몽』은 원작의 ‘동일성’을 해체하여 ‘신저작물’을 생성하기 위한 ‘적극적 번안’ 의 태도를 취했다. 다시 말하면, 번안의 태도는 저작자의 권리와 관련되어 양자는 ‘텍스트에 대한 소유 의식’에서도 차이가 있다. 이러한 점에서, 『장한몽』은 번안의 ‘창의성’에 대한 자각에서 기존의 번안 소설과 확연하게 다르다. 이는 번역과 번안의 분기를 내포하는 것이다.
또한 저작권의 시각에서 『장한몽』 성립을 분석했다. 그 결과, 원작 『곤지키야샤』의 “표제 및 내용 형식의 의장의 변경”을 통해 “신저작물‘”이 생성되는 과정이 규명되었다. 이는 번안의 창의성의 구축 과정으로서의 의의가 있다. 즉 저작권법제는 번안의 오리지널의 틀을 주조한 것이다.

영어초록

The purpose of this article is to examine the significance of the existence method of adaptation in connection with the concept of adaptation in the copyright law in the early 1910s when the term of adaptation still didn't gain ground, focusing on Janghanmon by Cho, Chung-hwan.
In 1908, the Japanese Copyright Act, which had been applied in Korea, referred to adaptations. A writing style which can be categorized as an adaptation at the present day had been practised in Korea in the 1900s.
From these two propositions, this paper attempts to shed light on the phenomenon that an adaptation was not able to be visible in the history of the translation / adaptation of Korea. This may be attributed to the writing customs that accepted the foreign literature and the conceptual standards for translation /adaptation prescribed in legislation.
In this context, this thesis has focused on the the process in which the adaptation novel of Cho Chung-hwan was shown by different appellations of `translation' and 'Shinsoseol(new novel)'. While in Ssangokmu, the adaptation took a moderate attitude in order to maintain an `identity' of the original, in Janghanmon it assumed an 'aggressive attitude' to dismantle an `identity' of the original toward generation of 'a new publication'. In other words, as for the attitude of adaptation, which was tied to the author's right, these two types were different in ‘possession consciousness of the text'. In such aspect, Janghanmon is markedly different from existing adaptation novels in terms of consciousness to the originality of adaptation. This means that the division between translation and adaptation occurred.
Furthermore, this article has analyzed the establishment of Janghanmon in the ligh of the copyright. As a result, in this paper the process of the generation of Janghanmon emerged through the modification of ‘a title and the design of contents and form’ of the original, konjikiyashya. This has the meaning as the construction process of the originality of adaptation. That is to say, copyright legislation had created a framework for `originality of adaptation'.
