초록

디지털화와 공급망불안정은 2020년부터 나타난 두가지 큰 변화이다. 대면으로하던 운송계약의 체결은 온라인으로 처리된다. 계약을 도와주던 중간자인 포워더는 더 이상 필요없어진다. 웹사이트에 다양한 정보들이 제공되기 때문이다. 미국의 내륙수송 인프라의 부족 혹은 마비로 선박이 항구에 대기하여 공급을 줄이는 효과가 나타났다. 이로 인하여 운임은 폭등했다. 선박은 구하기가 어려워졌고 정시성도 대폭 낮아졌다.
이런 두가지 문제가 해상법에 미치는 영향과 개선책을 알아보았다. 계약운송인과 실제운송인으로 복잡하던 운송의 단계가 단일화될 것이다. 전자화를 이용하여 선박의 소유와 운송예약권을 자유롭게 매매가 가능하게 할 수 있을 것이다. 컨테이너 박스에 IOT를 부착하여 위치를 확보하여 담보가치를 높일 수 있다. 선복의 부족과 높은 운임은 장기운송계약을 체결하여 완화할 수 있다. 소형화주는 장기운송계약을 체결할 수 없으므로 업종별 화주협회를 결성하여 화주협회가 정기선사와 장기운송계약을 체결할 수 있도록 해야한다. 컨테이너 박스 반납 지체료는 법적 성질을 손해배상의 예정으로 보아야한다. 그리하여 법원은 감액이 가능하다. 국제종합물류계약을 규율하는 조약이 없기 때문에 이를 조약화하는 작업을 서둘러야한다. 국내법으로라도 추가하면서 이를 국제표준으로 할 수도 있을 것이다. 위 두문제를 해결하여 관련당사자들에게 법적 안정성과 예측가능성을 부여하는 상법의 기능을 다해야한다.

영어초록

Digitalization and unstableness of the supply chain are two features during 2020 and 2021 under the Pendemic. Entering into the contract for the carriage of goods in the mode of face-to-face is substituted by the mode of on-line. The freight forwarder is no longer needed in the process of entering into contract for the carriage. It is because lots of good information is provided by on-line website of the shipping company. The short labors suply due to COVID-19 in the US land transportation caused delay in delivery of cargo at harbor, which, in turn, forced the vessels to stay at the port area laden with cargo on board. The supply chain in the world was affected negatively by this kind of bottleneck. The freight sharply increased and no vessel space was available.
What will be the effect of these two circumstances on the maritime law? The stage of entering into the contract will be shortened because the shipper is likely to find the carrier easily on the website of the carrier. There will be no more two carrier such as the contractual carrier and actual carrier. Owing to the digitalization, the owning the vessel and using the space of the vessel will be more common than it is. Fitting IOT will enhance the value of the container box as a collateral. The unstableness in the liner shipping business can be overcomed by the use of the shipper's association. The service contract is a useful tools fo the benefit of both the carrier and the shipper. However, the shipper without large quantity of the cargo will not be allowed to enter the contract. It can be achieved by small shipper's collaboration. They will gather their cargoes in the name of the shipper's association. The shipper's association are able to enter into the service contract with large cargo quantity. The legal nature of the detnetion charge is a kind of damages caused by the breach of the shipper's interest. The detention charges are controlled by the FMC in the US. Imposing detention charge not in accordance with the FMC rules and Shipping Act will be null and void. The international convention on the total logistics contract is needed to be established as soon as possible. Korea may promulages the total logistics contract domestically in advance than international community. By solving the above two circumstances, we are required to provide forseability and stableness to the stakeholders involved in the maritime business.
