소지류 한문산문의 표현 기법과 글쓰기 전략 -실용문 용례집 『변정문(卞正文)』을 중심으로- (Expression Techniques and Writing Strategies of Chinese Literature in Petition －Focusing on Practical Text Collection『Byunjungmoon』－)

초록

이 논문은 소지류 한문산문의 표현 기법과 글쓰기 전략을 살펴보기 위해서 필사본 『변정문』에 수록된 <보성김동장>과 <임실평당민장>, <강진기보평농민등장>, <진안민등장>을 대표 작품으로 선정하여 분석을 실시하였다. 표현 기법 측면에서는 판결자의 공감을 이끌어 내기 위해서 역설법, 문답법, 도치법, 설의법, 반복법, 열거법, 대구법, 대조법 등의 수사법과 고사와 속담 등을 활용하였다. 그리고 단락 구성에서는 모두 기승전결의 4단 구성을 취하여 탄원의 핵심적인 논리를 효과적으로 전개하고 있다. 개인 간의 소송을 다룬 앞의 두 문서는 기(起)에 해당하는 단락에서는 맨 처음 사건의 전말을 요약하여 제시하였고, 승(承)에 해당하는 단락에서는 이를 부연하여 자초지종을 상세하게 설명하고 있는데 이때 상대의 악행과 신의 없는 행동을 조목조목 나열하고 자신의 불쌍한 처지를 강조하여 피해자의 입장을 변호한다. 전(轉)에 해당하는 단락에서는 상대의 속셈을 간파하여 무고의 목적을 밝히고 논리적으로 반박하고 있다. 또 상대에 비해 자신의 정당성과 약자의 처지를 강조하고 상대의 비도덕성을 부각시키고 있다. 결(結)에 해당하는 단락에서는 정확한 판결에 의한 선처를 호소하면서 상대에 대해서는 엄격한 처벌을 요청하고 있다. 단체 소송을 다룬 뒤의 두 문서는 양상이 조금 다르다. 소송 상대가 있는 <강진기보평농민등장>은 앞의 문서들과 비슷하지만 <진안민등장>은 소송의 상대가 따로 있는 문서가 아니기 때문에 전(轉)에 해당하는 단락에서 각 항목에 대해 문제점을 제시한 뒤에 원인을 파악하고 해결 방법을 제안하는 구성을 취하고 있다. 또 상대방의 비도덕성이나 논리적 허점을 폭로하는 대신에 판결자를 칭찬하고 찬양하고 있다. 글쓰기 전략 측면에서는 탄원서 쓰기 전략에서 크게 벗어나지 않았다. 자신을 약자로 가장하는 전략은 모든 문서에서 사용되었고 소송의 상대가 있는 경우에는 상대의 논리적 허점을 밝히고 비도덕성을 폭로하고 있다. 그런데 이것들은 소송 상대와 나를 차별화하는 전략이다. 덧붙여 판결 권한을 가지고 있는 수령을 칭찬하는 전략도 있다. 소송은 피고와 원고, 판결자가 삼각구도를 그리기 마련이다. 자신은 약자[나이, 돈, 신분 등]이자 피해자이며 도덕적[善, 信]으로 우위에 있음을 강조하고 상대는 가해자이자 강자이며 비도덕적[惡, 不信]으로 설정되며 판결자는 칭찬과 찬양을 통해 공명정대하고 현명한 판단력이 요구되어 진다.

영어초록

In order to examine the expression techniques and writing strategies of the literary works of Soji, this paper was analyzed by selecting "Boseong Kim Dong Jang", "Limsil Pyeongdang Village People's Jang", "Gangjin Kibopyeong Farmers' Deungjang", and "Jinan Village People's Deungjang" contained in the manuscript "Byeon Jeong-moon". In terms of expression techniques, investigations such as paradox, question-and-answer, dochi, seol-ui, repetition, enumeration, Daegu, and contrast methods were used to elicit sympathy from the judges, as well as testaments and proverbs. In addition, all four-tier composition of the prevailing decision is taken in the composition of the paragraph, effectively developing the core logic of the petition. The previous two documents dealing with lawsuits between individuals summarized and presented the whole story of the first event in the paragraph corresponding to the gi(起), and the paragraph corresponding to the seung(承) explains the self-inflicted situation in detail. At this time, the victim's position is defended by listing the other's misdeeds and actions without trust in detail and emphasizing his poor situation. The paragraph corresponding to the jeon(轉) reveals the purpose of the innocent by detecting what the other person is up to and refutes logically. It also emphasizes one's legitimacy and the situation of the weak compared to the other person and highlights the other's immorality. In the paragraph corresponding to the gyeol(結), they appeal for leniency by accurate judgment and ask for strict punishment against the other party. The two documents after dealing with group litigation are slightly different. "Gangjin Kibopyeong Farmers' Deungjang" where the opponent of the lawsuit is located is similar to the previous documents, but "Jinan Village People's Deungjang" is not a separate document for the opponent of the lawsuit, so after presenting problems for each item in the paragraph corresponding to the jeon(轉), the cause is identified and a solution is proposed. In addition, instead of exposing the other's immorality or logical loopholes, it praises and praises the judge. In terms of writing strategies, it did not deviate significantly from the plea writing strategy. The strategy of pretending to be the weak has been used in all documents, and if there is a counterparty to the lawsuit, it reveals the logical loopholes of the opponent and reveals immorality. These are strategies that differentiate themselves from the litigant. In addition, there is a strategy to praise the recipient who has the authority to judge. In a lawsuit, the defendant, the plaintiff, and the judge draw a triangular structure. He emphasizes that he is the weak(age, money, status, etc.), the victim, and the moral(善, 信), and the opponent is set as the perpetrator, the strong man, and the immoral(惡, 不信), and the judge is required to have fair and wise judgment through praise and praise.
