2021. 9. 24. 제정된 「기후위기 대응을 위한 탄소중립·녹색성장 기본법(탄소중립기본법)」은 IPCC의 권고를 비롯한 주요 국가들의 탄소중립 정책과 입법 동향을 반영하여 2050년까지 탄소중립을 달성하겠다는 목표를 선언한 법이다. 이 법에는 기존 「저탄소 녹색성장 기본법」에서의 기후변화 대응·적응, 에너지 정책, 온실가스 감축 등에 관한 정책과 시책 외에도 정의로운 전환에 관한 내용이 새롭게 등장했다는 것이 특징이다.
에너지 전환의 대표적인 예로 제시되는 석탄화력발전의 폐지나 원자력발전의 비중이 장기간에 걸쳐 점진적으로 이행된다면 큰 무리가 없겠지만, 2050년까지 탄소중립을 달성하기 위해서는 상당한 속도로 산업체계를 개편할 수밖에 없다. 앞서 향후 10년에서 30년 이내에 급격하게 탄소중립을 이행하려면, 그에 따른 산업·일자리·지역경제에 대한 영향을 감소할 수 있도록 대응 방안이 마련되어야 한다.
정의로운 전환은 급격한 에너지 전환에 대한 대응방안으로서 탄소중립 목표를 이행하는 과정에서 지역과 산업에 대한 부담을 사회적으로 분담하고, 관련된 이해관계자의 직·간접적인 피해를 최소화하면서 산업체계를 개편하자는 것을 의미한다. 탄소중립과 정의로운 전환을 연결한 정책 기조는 미국의 ‘그린뉴딜 결의안(Green New Deal Resolution)’과 우리나라의 ‘신고리 5ㆍ6호기 공론화 후속조치 및 에너지전환(탈원전) 로드맵(에너지전환 로드맵)’ 및 ‘3차 녹생성장 5개년 계획’에서 지역․산업 보완대책을 마련한 것과도 일맥상통한다.
기후변화․기후위기 대응의 일환인 탄소중립은 우리가 달성해야 할 목표이기는 하지만, 탄소중립 관련 정책은 해당 산업의 특성에 따라 화석연료의 다소비 업종, 대규모 탄소배출 업종, 에너지집약적인 업종 등에는 부정적인 영향을 미칠 것이다. 「탄소중립기본법」에서는 정의로운 전환에 관하여 기후위기 사회안전망의 마련, 정의로운전환 특별지구의 지정, 사업전환 지원, 자산손실 위험의 최소화, 국민참여 보장을 위한 지원, 협동조합 활성화, 정의로운 지원센터의 설립 등의 시책을 제시하고 있으나, 그 내용은 선언적이고 추상적인 조문으로 마련되어 있어, 「탄소중립기본법」의 규정만으로는 정의로운 전환에 대한 구체적 시책을 이행할 수 있는 단계는 아닌 것으로 보인다.
에너지 전환은 화석연료를 기반으로 하는 현행 중앙집중형 에너지공급 시스템을 탈탄소 전원(電源)으로 개편하는 것이어서 전력시장, 전기요금, 전력계통 등에 변화가 불가피하다. 또한 분산형 에너지 체계 구축과 에너지소비 효율 향상이 수반되어야 한다. 이를 위해서는 발전(發電) 분야와 산업 분야에 대한 대책이 각각 모색되어야 한다.
에너지 전환과 정의로운 전환은 기후 위험과 에너지 위기를 야기하지 않는 에너지 이용을 도모하고, 사회구성원 모두가 기본적인 에너지 서비스를 향유하며, 에너지 빈곤을 해소하는 것이다. 또한 탄소중립 사회로 연착륙이 될 수 있도록 화석연료와 석탄화력․원자력 발전에 의존하고 있는 지역경제의 문제를 해결하기 위한 노력이 필요하다. 이를 위해서는 녹색산업이나 녹색일자리를 보다 구체적인 범위로 확정하여, 재교육 및 재훈련을 통한 고용 전환을 준비해야 한다.

영어초록

The Framework Act on Carbon Neutrality and Green Growth for Response to the Climate Crisis (Carbon Neutrality Framework Act) enacted on September 24, 2021 reflects the carbon neutral policies and legislative trends of major countries, including the recommendations of the IPCC. The Act declared the goal of achieving carbon neutrality by 2050. In addition to the policies and plans related to climate change response and adaptation, energy policy, and greenhouse gas reduction in the existing Framework Act on Low Carbon, Green Growth, this Act is characterized by the introduction of new content on just transition.
If the abolition of coal-fired power generation or the reduction of nuclear power generation, which are presented as representative examples of energy conversion, is gradually implemented over a long period of time, there will be no great difficulty. In order to achieve carbon neutrality by 2050, however, there is no choice but to reorganize the industrial system at a considerable rate. In order to rapidly implement carbon neutrality within the next 10 to 30 years, countermeasures must be prepared to reduce the resulting impact on industries, jobs, and the local economy.
Just Transition is a response to the rapid energy transition. In other words, it means to socially share the burden on the region and industry in the process of implementing the carbon neutrality goal, and to reorganize the industrial system while minimizing direct and indirect damage to related stakeholders. The policy direction linking carbon neutrality and just transition is based on regional and industrial supplementary measures in the US 'Green New Deal Resolution', Korea's 'Energy Transition Roadmap' or '3rd Green Growth Plan'.
Carbon Neutrality is a goal that we must achieve to prepare for the climate crisis. However, policies related to carbon neutrality will have a negative impact on industries that consume a lot of fossil fuels, large-scale carbon emission industries, and energy-intensive industries. The “Carbon Neutrality Framework Act” suggests policies for a just transition, such as the establishment of a social safety net, designation of a special district for just transition, support for business conversion, minimization of risk of asset loss, support for guaranteeing public participation, vitalization of cooperatives, and establishment of a just support center. These articles are declarative and abstract in their content, so they are insufficient to implement specific policies for a just transition.
Energy transition and just transition are to expand the use of renewable energy that does not cause a climate crisis, to enjoy basic energy services for all members of society, to share the burden generated in the transition process socially, and to minimize damage to the vulnerable. In order to successfully achieve a just transition, it is necessary to make an effort to solve the problems of the local economy that is dependent on fossil fuels and coal-fired and nuclear power generation so that a soft landing can be achieved as a carbon-neutral society. In addition, it is necessary to prepare for employment conversion through re-education and retraining by defining green industries and green jobs in a more specific scope.
