국제카르텔 역외 형사집행 방법론에 대한 소고 (Criminal Enforcement against International Cartels)

초록

국제카르텔은 국경을 초월하여 다수의 소비자에게 막대한 피해를 입히는 중대 불법행위이다. 국제사회에서는 오래 전부터 국제카르텔에 대한 엄정한 법집행의 필요성을 인식하고, 각국의 법집행 태양이 유사성을 가지고 상호 접근해 가는 이른바 ‘국제적 수렴현상(global convergence)'이 뚜렷하다. 하지만 공정거래위원회, 법무부(검찰)를 비롯한 우리나라 사법․경쟁당국의 국제카르텔에 대한 법집행은 응보(restitution)와 억제(deterrence) 측면에서 아직 부족한 점이 많다.
국제카르텔은 사건 관계인과 증거물이 여러 나라에 산재(散在)되어 있기 때문에 실효적인 법집행을 위해서는 관련 국가 간의 공조가 필수적이다. 특히 국제조약에 의해서 당사국에 법률상 이행 의무가 부과되고, 이행 과정에서 압수수색과 구금 등 강제수사를 활용할 수 있는 형사사법공조와 범죄인인도는 가장 효과적인 국제공조 수단이다.
형사사법공조와 범죄인인도는 자국의 형사사법 주권, 경제적 이해관계, 국민 정서와 연계되어 그 이행 과정에서 요청국과 피요청국 사이에 여러 가지 복잡 미묘한 갈등 상황이 연출될 수 있다. 기술적으로는 쌍방가벌성, 특정성, 일사부재리 등과 관련하여 양국의 판단이 달라질 수도 있다. 하지만, 대상자의 국적을 불문하고 차별 없는 엄정한 법집행만이 그 나라에 대한 국제적 신뢰를 이끌어냄과 동시에 궁극적으로 자국의 이익을 수호할 수 있는 길임을 명심해야 한다.
형사사법공조와 범죄인인도의 성패를 실질적으로 좌우하는 것은 당사국, 특히 사법당국 간의 신뢰관계이다. 사법당국 간 협력을 강화하기 위해서는 효율적인 제도 설계 이상으로 실무자의 전문성과 실무적 운용의 묘를 살리는 것이 중요하다. 그 시작은 사법당국의 ‘적법절차(due process)’에 대한 철저한 보장과 실천이며, ‘호혜평등’에 입각한 적극적인 공조 이행을 통해서 비로소 그 결실을 맺을 수 있을 것이다.

영어초록

International cartels are serious cross-border offences that cause grave damage to a number of consumers. The international community has long recognized the need for strict law enforcement against these cartels and, thus, the ‘global convergence’ of law enforcement is becoming more evident. However, the law enforcement against international cartels conducted by the Korean Fair Trade Commission(KFTC) and the Ministry of Justice(KMOJ), is insufficient in the aspects of restitution and deterrence.
Considering the widely scattered evidence across borders, a collaboration of relevant countries is inevitable for the effective law enforcement of international cartels. In this regard, the mutual legal assistance(MLAT) and the extradition are the most effective tool for international cooperation, as the parties shall be under legal obligation by the international treaty, enabling compulsory investigations such as search and seizure or detention during the implementing procedure.
MLATs and extradition could be related to the criminal sovereignty, economic interests and public sentiment. Therefore, the requesting and requested countries may face some complex and sensitive conflicts during the procedure. The judgments from the parties concerned may differ depending on the technical aspects such as, double criminality, specificity and double jeopardy(non bis in idem). Nonetheless, the each country should note that the strict and impartial law enforcement regardless of the nationality of the stakeholder will be the sole path to win the trust of the international community and, ultimately, to protect domestic companies and people. The trust between judicial authorities of concerned countries is a key to the success of MLATs and extradition. In this respect, the importance of developing the expertise of the working-level officials and enhancing their management skills outweigh that of designing an effective cooperation system between judicial authorities. This will begin with the thorough guarantee and implementation of ‘due process’ and it will bear fruits through active cooperation based on ‘reciprocal equality’ with an aim to ensure MLATs and extradition.
