위수령의 해석과 입법방향 (The Interpretation and Legislative Direction of Garrison Decree)

초록

위수령에 대한 시민사회의 끊임없는 문제제기에도 불구하고 법학계의 위수령에 대한 연구는 매우 미미하여 규범의 개별적 내용은 물론 전체적인 의미가 무엇인지 분석하여 입법방향을 제시하는 노력은 거의 없었다고 해도 과언이 아니다. 위수령은 여전히 우리나라의 군사법제의 하나로 자리 잡고 있고, 절차적으로 유효한 규범으로 존재하고 있다. 계엄과 같은 극단적 수단에 의하지 않고도 행정관청의 요청에 따라 군이 치안을 유지하고 공공의 안녕질서를 유지할 수 있는 제도적 장치는 여전히 필요하다는 주장도 있다. 이와 같이 위수령은 과거 권위주의 정부시절의 남용사례와 수많은 비판에도 불구하고 현재까지 유효하게 존재하고 있으며, 비상경찰상황을 규율하는 규범의 하나로 사실상 자리 잡은 상태이다. 위수령에 대한 무지와 오해 또한 특별한 개선 없이 계속되고 있다.
본 논문은 이러한 문제의식을 가지고 위수령의 개별적 내용의 해석과 비판적 검토를 통해 위수령을 둘러싼 논쟁의 방향을 제시하고자 하였다. 위수령의 입법목적은 국내치안에 병력을 출동시키기 위한 것에 있지 않고 본래는 부대의 경비에 관한 일반규정을 마련하는 것에 있었다. 위수령에 규정된 병기사용도 위수근무자의 병기사용으로 군인복무규율상 초병의 무기사용과 같은 내용의 것이다. 병력출동, 병력파견과 같은 내용들은 모두 행정응원에 관한 규정으로서 일반행정기관의 질서유지업무를 보충적으로 지원하는 내용인데, 이를 국가권력이 적극적인 질서행정작용을 군대가 수행할 수 있는 것으로 남용하였던 것이다. 본 논문은 이러한 위수령의 본래적 의미내용을 밝히고, 그러한 의미내용과 달리 남용되었던 전례를 고려하여 위헌적 해석 및 그에 기한 공권력 행사의 가능성을 차단하기 위해 입법적 정비가 있어야 함을 주장하였다.

영어초록

Although civil society raised ceaseless questions on garrison decree, there were very slight studies on garrison decree in the academic world of Jurisprudence. There were few efforts to analyze both the individual contents and overall meanings of norms and so propose their legislative directions. The garrison decree is still established as one of our country's military law system, and still exists as a procedurally effective norm. Some people argue that our country still needs the systematical device through which the military can maintain public peace and order according to the request of administrative offices without having recourse to the extreme means such as martial law. Like this, in spite of many abuses and criticisms in the past authoritarian governments, the garrison decree has existed effectively until the present, and has been established in fact as the norm regulating emergency policy situation. The ignorance and misunderstanding of garrison decree also continues without special improvement.
On the basis of such question consciousness, the purpose of this study is to interpret and examine critically the individual contents of garrison decree and so present the directions of debate around garrison decree. The legislative purpose of garrison decree was not to mobilize military forces to domestic public peace and order, but to prepare originally the general regulation on guarding military units. The use of arms regulated by garrison decree is garrison duty soldiers' use of arms, which is the same as sentries' use of arms according to military standing orders. The contents such as military forces mobilization and military forces dispatch are all the regulations on administration assistance, which support supplementarily the order maintenance duty of general administrative offices. The national power abused such contents as the content that the military could carry out active order administration actions. This study revealed the original meaningful contents of garrison decree, and so considered the precedents abused unlike such meaningful contents, and then argued that legislative arrangement was required to prevent the possibility of exercising governmental authority on the basis of unconstitutional interpretation.
