원자력안전행정체계에 관한 법제 고찰 - 원자력안전위원회를 중심으로 - (A Legal Study on the Nuclear Safety Administration System - Focused on the Nuclear Safety Commission -)

초록

일본 후쿠시마 원자력사고와 최근 우리나라 원자력발전소의 원전부품 납품 비리, 정전사태, 노후 원자력발전소의 재가동 승인여부 등과 관련하여 국민들의 원자력안전에 대한 관심이 높아졌고 이에 대한 불안감도 높아지고 있다. 독일 등의 일부 국가에서는 원전 폐기를 선언하고 있지만 우리나라의 경우는 부족한 에너지자원, 기후협약에 따른 저탄소 에너지원을 확보해야 한다는 현실적 문제로 인하여 당분간은 원자력발전을 주요 에너지원으로 사용하는 것이 불가피하다. 이런 상황 하에서 원자력 사용으로 인한 리스크를 줄여나가는 것이 중요한데 이를 위해서는 최근 개정된 원자력 안전에 관한 법령과 행정체계에 대해 알아보고 문제점들을 검토해 보아야 한다.
한편, 2013년 3월 정부조직개편으로 인하여 많은 논란 속에 「원자력안전위원회설치 및 운영에 관한 법률」의 개정도 이루어 졌는데 원자력안전위원회가 대통령 직속의 장관급 위원회에서 국무총리 산하 차관급 위원회로 지위가 낮아지게 되었다. 과연 차관급인 원자력안전위원회가 원전의 운영을 책임지고 있는 장관급 산업통상자원부를 상대로 원자력발전의 안전과 관련한 사항들을 독립적, 중립적으로 판단할 수 있을까라는 의문과 함께 후쿠시마 사고 이후 원자력안전규제에 있어 독립성을 강조하는 세계적 흐름에 타당하지 않다.
원자력안전위원회 위원 선정과 관련하여 모든 위원을 위원장이 추천하도록 한 것을 4명의 위원을 국회의 추천으로 구성토록 한 것은 긍정적으로 평가할만하다. 하지만 원자력발전의 안정적인 지속적인 이용·발전을 위해서는 원자력안전위원회의 보다 높은 독립성, 투명성, 전문성이 요구된다. 이를 위해서는 우선 관련 법령에서 위원장, 위원에 대한 자격 요건을 추상적으로 규정하고 있는 것을 구체화하는 것이 필요하며, 원자력안전에 있어서 가장 핵심적인 권한을 가지고 있는 원자력안전위원회 위원장의 경우에는 국회 인사청문회를 실시를 명시하도록 하여 독립성과 전문성을 확보하도록 하여야 한다. 또 원자력발전소의 설치 지역의 주민대표나 혹은 지방자치단체들이 현실적으로 원자력안전위원회에 참여할 수 있는 방안을 검토하여 원자력안전문제에 있어 투명성과 신뢰성을 가지도록 제도적 장치를 마련하여야 할 것이다.

영어초록

Regarding the nuclear accident at Fukushima in Japan and Korea’s recent electrical outage in nuclear plants and approval for the reoperation of decrepit nuclear plants, people’s interest in nuclear safety has increased, and also anxiety has been raised accordingly. Some countries like Germany have declared nuclear plant abolition; however, in Korea, we think we should secure low carbon energy sources due to our practical issues like lack of energy sources or the climatic change convention; therefore, it is unavoidable for a while for us to use nuclear power as our chief energy source. Under the situation, it is crucial to reduce the risk resulted from the utility of nuclear power. And to do so, we have to examine the recently revised legislation regarding nuclear safety and the administrative system and also look into the problems.
Meanwhile, in March, 2013, within severe controversy, 「Nuclear Safety Commission Installation and Operation Act」 was revised through the governmental reorganization. And the Nuclear Safety Commission was degraded to the vice-ministerial committee under the prime minister’s office from the ministerial committee of the presidential. It is questionable if the vice-ministerial Nuclear Safety Commission can really make decisions independently as well as neutrally about the issues related with the safety of nuclear power generation against the Ministry of Trade, Industry and Energy that takes charge of the operation of nuclear plants. Besides, regarding the nuclear safety regulations set after the nuclear accident at Fukushima, it is not valid to the global trend valuing independence.
And about selecting members of the Nuclear Safety Commission, it can be positively evaluated that they have changed the rule from the chairman to recommend all the commission members to the National Assembly to recommend 4 commission members. However, to realize stable as well as sustainable utility and development of nuclear power, even greater independence, transparency, and reliability are required to the Nuclear Safety Commission. To do so, first, it is needed to concretize qualifications for the chairman and commission members as the relevant laws and regulations define them rather abstractively. And about nuclear safety, as the chairman of the Nuclear Safety Commission has the highest authority, it is necessary for them to secure independence as well as expertise by stating that they have to attend the parliamentary confirmation hearings. Also, it is needed to devise measures to have the resident representatives or local governments in the regions where nuclear plants are installed actually join in the Nuclear Safety Commission so as to lay the institutional framework through which they can have transparency and reliability regarding nuclear safety issues.
