독립행정위원회 설치ㆍ운영 입법에 대한 헌법학적 검토 ― 독립성ㆍ전문성 등 설치 요건 체계화를 중심으로 ― (A Constitutional Review on the Legislation for the Establishment and Operation of Independent Administrative Commissions)

초록

행정의 독임제 혹은 단일성 원칙은 효율성과 신속성 등을 이유로 근대 행정권의 구성원리로 폭넓게 인정되어왔다. 입법부는 숙의적 의사결정을 위해 다수의 합의제 기관으로 구성해서 운영하지만, 행정부는 한 사람이 책임을 지도록 할 때 효율적으로 운영될 수 있다는 것이다. 하지만 오늘날은 행정에 있어서 전형적인 부처조직에서 탈피해서 독립성과 전문성이 강조되는 민관 거버넌스 형식의 독립행정위원회가 나날이 늘어가는 추세에 있으므로 이것이 왜 필요하고 어떤 점에서 정당화될 수 있는지에 대한 새로운 검토가 요구된다.
본 논문에서는 헌법과 정부조직법에 근거를 둔 전형적인 중앙행정기관으로서의 행정각부 등(부･처･청), 즉 독임제행정기관의 성격을 가지면서 동시에 행정의 계서제를 따르고 있는 기관들을 제외하고, ① 헌법과 정부조직법 제2조 제2항 혹은 개별 법률에 의해 중앙행정기관의 설치 근거를 가지면서, ② 기왕의 행정부처의 계서제와는 독립하여, ③ 해당 소관사무의 전부를, ④ 합의제 내지 위원회 형식으로 수행하는 행정기관을 ‘독립행정위원회’로 보고, 이들 독립행정위원회 설치 및 운영에 있어서 핵심적으로 고려해야할 세부적인 개념요소로 다시 ① 독립성 ② 전문성 ③ 신규성 혹은 비전형성 ④ 다수 전문가의 합의(행정적 숙의) ⑤ 정치적 중립성으로 추출해서, 이들 개념요소들을 기준으로 해서 우리 독립행정위원회의 설치･운영 입법시 고려해야 할 헌법적 기준과 한계에 대해 고찰하면서, 이들이 기존 행정조직과 정치권으로부터 자율성을 확보하여 독립행정의 전문성을 발휘할 수 있는 조건을 모색해본다.

영어초록

The principle of unity in administration has been widely recognized as a fundamental organizing principle of modern administrative power, primarily for reasons of efficiency and promptness. While the legislature operates as a deliberative decision-making body composed of multiple members in a collegial structure, the executive branch is considered to function more efficiently when a single individual assumes responsibility. However, contemporary administrative structures are increasingly shifting away from traditional ministerial organizations, emphasizing independence and expertise through independent administrative commissions within a public-private governance framework. This trend necessitates a renewed examination of why such commissions are needed and how they can be justified.
This paper focuses on independent administrative commissions, excluding typical central administrative agencies such as government ministries, departments, and agencies (bu, cheo, cheong), which are based on the Constitution and the Government Organization Act, and follow hierarchical administration. Instead, the study defines independent administrative commissions as agencies that: ① have a legal basis for their establishment under Article 2, Paragraph 2 of the Government Organization Act or other statutes, ② operate independently from the existing hierarchical structure of government ministries, ③ handle the entirety of their respective jurisdictions, and ④ function in a collegial or commission format.
The study further extracts key conceptual elements crucial to the establishment and operation of independent administrative commissions, namely: ① independence, ② expertise, ③ novelty or non-traditional characteristics, ④ administrative deliberation through consensus among multiple experts, and ⑤ political neutrality.
Using these conceptual elements as criteria, the paper examines the constitutional standards and limitations that must be considered when legislating the establishment and operation of independent administrative commissions in Korea. Furthermore, it explores the conditions under which these commissions can secure autonomy from existing administrative organizations and political influence, thereby ensuring the professionalism of independent administration.
